DAF DISCUSSIONS - BAVA METZIA 21

Donny Rudansky asked:

that when they start saying all the proofs by the first Ta'shema. but the first Ta'shema only says peiros mefuzarim but doesnt say hari eilu shelo and by all the other Ta'shemas it says Hari eilu shelo

Donny Rudansky, cedarhurst

The Kollel replies:

The Gemara does not say that the ruling in this case is Harei Eilu Shelo, but the Mishnah does indeed say that this is the ruling in this case. The Gemara just quotes the case of the Mishnah, and relies on us to know that the Mishnah rules Harei Eilu Shelo in this case.

I do not know why the Gemara does not quote the ruling in this case, whereas in the other cases the Gemara quotes the Gemara gives the ruling as well.
