KELIM THAT WERE SWITCHED WITH ANOTHER'S (Yerushalmi Perek 10 Halachah 1 Daf 43a)

(a)

(Tosefta): If one's Kelim were switched with another's in the Uman's (craftsman's) house, he may use them, [but even so] he goes and seeks his [he did not acquire through Shinuy Reshus, just he may use them];

ááéú äàáì àå ááéú äîùúä àì éùúîù áäï àìà éöà åéá÷ù àú ùìå.

[If they were switched] in the mourner's house or in the banquet house, he may not use them. Rather, he goes and seeks his.

Chiyah explained [that the Tosefta discusses] only [an Uman like] Bar Kora, that anyone who takes from him takes with permission, and anyone who leaves with him leaves with permission [for him to sell it. (b)

Thieves who committed a burglary and repented are obligated to return [what they took]. If one of them repented, he is obligated to return his (what he took). If he took and gave [to the other thieves], he pays for all of them.

(c)

(Beraisa): If one stole and fed the theft to his children, whether they are adults or minors, they are exempt from paying. If he left it in front of them, whether they are adults or minors, they are obligated to pay;

(d)

Sumchus says, adults are obligated, and minors are exempt.

(e)

If the adults said 'we do not know whether or not our father made a final calculation with you' (returned everything that he owes to you), they are exempt.

Question (R. Ba bar Mamal): Exert yourself [and you will find the answer]! If [their father] left land in front of them, they do not get away with saying 'we do not know whether or not our father made a final calculation with you'!

Question (Rav Sheshes): [If so,] even minors, we should claim so for them in Beis Din! How can you answer (why does the first Tana obligate them when their father left in front of them?)

Answer (R. Mana): The case [in which adults are exempt] is when they claimed 'we do not know...' is when they say 'we know that our father made a calculation with you, but we do not know what was the outcome.' (We cannot claim so for minors.)
