USING AN ACCESS PATH (Yerushalmi Halachah 3 Daf 19b)

משנה מי שיש לו בור לפנים מביתו של חבירו נכנס בשעה שדרך בני אדם נכנסין ויוצא בשעה שדרך בני אדם יוצאין

(a)

(Mishnah): If a person owns a pit in someone's house, he can enter and leave at normal times (when others would do the same).

ואינו מכניס בהמתו ומשקה מבורו אלא ממלא ומשקה מבחוץ

1.

He may not bring in his animal to drink from the pit; rather, he must fill utensils and take them outside for the animal to drink.

זה עושה לו פותחת וזה עושה לו פותחת

2.

Each person can make a key.

מי שיש לו גינה לפנים מגינתו של חבירו נכנס בשעה שדרך בני אדם נכנסין ויוצא בשעה שדרך בני אדם יוצאין

(b)

If Reuven owns a garden inside Shimon's garden, he may enter and leave at normal times.

ואינו מכניס לתוכה תגרים ולא יכנס מתוכה לתוך שדה אחרת

1.

He may not bring merchants into the garden, nor may he enter Shimon's garden in order to access another person's field.

והחיצון זורע את הדרך

2.

Shimon is permitted to plant seeds on the path.

נתנו לו דרך מן הצד מדעת שניהן נכנס בשעה שהוא רוצה ויוצא בשעה שהוא רוצה ומכניס לתוכה תגרים

(c)

If Shimon received a path on the side of Reuven's field (with the agreement of both of them), he may enter and leave whenever he wishes and he may bring merchants there.

ולא יכנוס מתוכה לתוך שדה אחרת וזה וזה אינן רשאין לזורעה:

1.

He may not enter Reuven's field in order to access another person's field and neither of them may plant there.

גמרא תני החיצון אין זורע את הדרך דו א"ל מעלל אנא שרע.

(d)

(Gemara) - Beraisa: If they agreed to use a path on the side of the field, neither may plant there - the inner neighbor can tell the outer neighbor, "I would like to enter my field from this side as if not, rather than trample on your garden, I will have to walk all way around!"

הפנימי אין זורע את הדרך דו אמר ליה את חייס על דידך ודייש על דידי

(e)

The inner neighbor also may not plant on the path, as the outer neighbor will tell him, "You will have pity on your plants and then trample on my plants!"
