THE CONDUCT BETWEEN BEIS HILLEL AND BEIS SHAMAI (Yerushalmi Halachah 1 Daf 4a)

[דף ד עמוד א] אף על פי שנחלקו ב''ש וב''ה בצרות ובאחיות ובגט ישן ובספק אשת איש ובמקדש בשו''פ והמגרש את אשתו ולנה עמו בפונדקי (והאשה מתקדשת בדינר ובשוה דינר) לא נמנעו בית שמאי לישא נשים מבית הלל ולא בית הלל מבית שמאי אלא נוהגין באמת ובשלום שנאמר (זכריה ח) והאמת והשלום אהבו

(a)

Even though B''S and B''H disagree over the following cases, they did not refrain from marrying women from the other group. Rather they acted with truth and peace, as the pasuk states (Zecharia 8, 19), "...love truth and peace''.

1.

The cases are:

i.

Co-wives: B''S - a co-wife of an ervah may do yibum; B''H prohibit it. (1st perek of Yevamos)

ii.

Sisters: 4 brothers - two of them married sisters; if those brothers died, their wives must do chalitzah not yibum. If they did yibum R. Eliezer says - B''S - they may remain married; B''H - they must separate. (4th perek of Yevamos)

iii.

Old Get: If a man divorced using a get for which the couple were in seclusion after it was written - B''H - it is invalid; B''S - it is valid. (8th perek of Gitin)

iv.

"Doubtfully married'': B''S - one may only allow miyun (refusal of marriage) for a betrothed girl (whose father died and she was married by brothers/mother - it is referred to here as doubtful marriage); B''H - whether betrothed or fully married it is allowed. (13th perek of Yevamos)

v.

Marrying using the value of a Perutah: B''H allow it; B''S require a dinar to be used. (1st perek of Kidushin)

vi.

A divorced couple who were secluded in an inn: B''S do not require a second get; B''H require it. (8th perek of Gitin)

(b)

Question: These cases involve potentially producing mamzerim and you say that they did not refrain from marrying each other?

היך עבידא קידש הראשון בשוה פרוטה והשני בדינר על דעתהון דבית שמאי מקודשת לשני והוולד ממזר מן הראשון על דעתהון דבית הלל מקודשת לראשון והוולד ממזר מן השני

Example: If one man married her using a Perutah and a second man married her using a dinar, according to B''S she married to the second man and the first man's child is a mamzer; according to B''H she is married to the first and the second man's child is a mamzer!

(c)

Answer (R. Yaakov bar Acha citing R. Yochanan): B''S would act stringently (that they themselves would always marry using a dinar, but in the above case, they would prohibit her to both husbands until she received a divorce from the first one).

Question: If so, B''H should marry women from B''S since B''S agree to be stringent; B''S should not marry wives from B''H since they do not agree to the leniency of B''H...?

רבי יוחנן בשם רבי ינאי אילו ואילו כהלכה היו עושין

Answer (R.Yochanan citing R. Yanai): They both acted according to the stringent opinion of the two and only disagreed over the theoretical halachah.

אם כהלכה היו עושין בדא תנינן שלחו בית שמאי ופחתוה שבית שמאי אומרין עד שיפחות רובה

Question: How can you claim that they both acted like the stringent opinion of the two? (The Mishnah in Mikvaos cites a dispute between B''S and B''H about a hollow stone under a stream of rainwater coming from the mountains. B''H held that as long as there is a small hole in the side of the stone connecting to the Mikveh, the Mikveh is kosher. B''S held that it is only kosher if the entire side of the stone had been removed). There was such a case (where the people were using the Mikveh that was connected to a stone with only a small hole) and B''S sent messengers to break off the entire side of the stone! (This shows that B''H were acting leniently and using it, even though B''S held that the Mikveh was not kosher.)

אמר רבי יוסי בי רבי בון עד שלא בא מעשה אצל בית הלל היו בית שמאי נוגעין בו [דף ד עמוד א (עוז והדר)] משבא מעשה אצל בית הלל לא היו בית שמאי נוגעין בו

Answer (R. Yosi bei R. Bun): They did in fact disagree in action as well as theory, but when a case came to them for which the other one was stringent and they were lenient, they would inform the stringent one about their behavior and the stringent one would not touch the (tameh) item.

Support (R. Aba Mari): This is correct! The Mishnah does not say that they retroactively declared all of the tahor items to be tameh but rather, it was only from that point onwards.

(i)

R. Yosi bei R. Bun: Rav and Shmuel disagreed - one said that they both acted according to the stringent opinion of the two. The other one said that each group followed their own rulings.

Question: If each followed their own rulings, how could they marry each other, thereby causing potential mamzerim?

המקום משמר ולא אירע מעשה מעולם

Answer: It never happened that one ruled leniently when the other was stringent.

כהדא דתני כל הרוצה להחמיר על עצמו ולנהוג כחומרי ב''ש וכחומרי ב''ה על זה נאמר (קוהלת ב) והכסיל בחושך הולך

Support (Beraisa): If a person wishes to follow the stringencies of both B''H and B''S, about such a person the pasuk states (Koheles 2, 14), "the fool walks in the darkness''.

כקולי אילו וכקולי אילו נקרא רשע

If he wishes to follow the leniencies of both, he is referred to as wicked.

אלא או כדברי ב''ש כקוליהן וכחומריהן או כדברי בית הלל כקוליהן וכחומריהן

2.

Rather, he should follow B''S for both their stringencies and leniencies or he should do the same for B''H. (This Beraisa shows that it is fine to follow one opinion but if one is stringent for both opinions he is a fool.)

הדא דתימר עד שלא יצאת בת קול משיצאת בת קול לעולם הלכה כדברי בית הלל וכל העובר על דברי בית הלל חייב מיתה

(m)

This permission to choose which opinion to follow was only before the Heavenly voice declared that the halachah follows Beis Hillel, but afterwards, one who transgresses the words of B''H is liable to die.

תני יצאת בת קול ואמרה אילו ואילו דברי אלהים הן אבל הלכה כדברי ב''ה

Beraisa: A Heavenly voice declared that both are the words of Hash-m, but the Halachah follows B''H.

THE VALUE OF A PERUTAH (Yerushalmi Halachah 1 Daf 4a)

וכמה היא פרוטה אחד משמונה באיסר האיטלקי.

(a)

The Mishnah taught: How much is a Perutah? 1/8th of an Italian isar.

תני האיסר אחד מעשרים וארבעה בדינר כסף דינר כסף אחד מעשרים וארבעה לדינר זהב

Beraisa: An Isar is 1/24th of a silver dinar; a silver dinar is 1/24th of a gold dinar.

תני רבי חייה סילעא ארבעה דינרין שש מעה כסף דינר שני פונדיון מעה שני איסרין פונדיון שני מסומיסין איסר שני קרדיוניטס מסומס שני פרוטות קרדיונטס סלקין א' משלשים ושנים למעה

(c)

Beraisa (R. Chiya): A sela = 4 dinarim; a dinar = 6 silver ma'ah; a ma'ah = 2 pundions; a pundion = 2 isars; an isar = 2 musmasin; a musmas = 2 kardionists; a kardionist = 2 perutas. According to this, one Perutah is 1/32th of a ma'ah.

R. Zeira: In the days of R .Sima the Rabbis evaluated that a Perutah is 1/24th of a ma'ah.

Beraisa (R. Shimon ben Gamliel): A ma'ah = 3 drusa; a drusa = 2 nitzim; butzah = 2 shamin; shamin = 2 perutos. Therefore a Perutah is 1/24th of a ma'ah.

R. Chanina/R. Mana disagree: R.Chanina - the value of copper (i.e. the copper Perutah) remains constant, but the value of silver fluctuates.

Question: What about R. Chiya's statement, that a sela = 4 dinar?

Answer (source given by Chilfai - Mishnah in Bava Metzia): How much can be lacking from a sela (a coin that is gradually worn down) without it being honaya (overcharging) if he used it as if it was a full sela? (A ma'ah= 4 issar and a dinar= 6 ma'ah; therefore an issar is 1/24th of a dinar). R. Meir says - An issar (and there are 4 issar in a selah).

Question: What about R. Chiya's statement that 6 silver ma'ah are a dinar?

Answer (source given by Chilfai - Mishnah in Arachin): Ona'ah (overcharging) is 4 ma'ah, as there are 24 ma'ah in a sela)- i.e. if the item was a sela and he overcharged 4 ma'ah, which is 1/6th of the item. (Since there are 4 dinar in a sela, there must be 6 ma'ah in a dinar.)

Question: What about R. Chiya's statement that are 2 pundions in a ma'ah?

Answer (source given by Chilfai - Maseches Arachin): (If a person consecrates his ancestral field, its value is calculated based on the maximum the number of years that remain until Yovel, which is 49 years, based on a price of 50 shekel (sela) per area of land in which one could plant a 'chomer' of barley. If he consecrated it during the yovel cycle, he pays a sela + a pundion (a pundion is 1/48th of a sela) per year (per 50 chomer area). (Since a sela = 24 ma'ah and a sela = 48 pundions, there must be 2 pundions in a ma'ah.

Question: What about R. Chiya's statement that there are 2 issar in a pundion?

אמר לון אוף אנן תנינתה המניח איסר ואכל עליו חציו והלך לו למקום אחר והרי הוא יוצא בפונדיון מוסיף עליו עוד איסר

(q)

Answer (source given by Chilfai - Maseches Maaser Sheni): One who set aside an issar coin (in order to redeem the sanctity of Maaser Sheni upon it from produce that he cannot bring to Yerushalayim) and he continued to redeem onto it and consume that produce up until half the issar; if he went elsewhere, where the issar is worth a pundion, (since the remaining 1/2 issar that he had not used is now worth a full issar), he may continue to redeem an additional issar onto that coin. (This shows that there are usually 2 issar in a pundion.)

Question: What about R. Chiya's statement that there are 2 musmasin in an issar; 2 kardionists in a musmas and 2 perutos in a kardionist?
