ANOTHER ACTION AFTER MA'AMAR (Yerushalmi Perek 5 Halachah 2 Daf 31b)

מתני' כיצד עשה מאמר ביבמתו ונתן לה גט צריכה הימינו חליצה

(a)

(Mishnah): How is this? If a Yavam gave a Ma'amar to his Yevamah and then a Get, she needs Chalitzah;

עשה מאמר וחלץ צריכה הימינו גט

(b)

If he gave a Ma'amar then did Chalitzah, she needs a Get;

עשה בה מאמר ובעל הרי זו כמצותה:

(c)

If he gave a Ma'amar and had Bi'ah, this is proper fulfillment of the Mitzvah.

גמ' הדא אמרה שהגט פוטר יותר ממה שקנה מאמר

(d)

(Gemara) Inference: A Get exempt more than a Ma'amar acquires.

אם תאמר אין הגט פוטר יותר ממה שקנה מאמר. (יבם) [צ"ל ייבם - חשק שלמה, ספר ניר]

If you would say that a Get does not exempt more than a Ma'amar acquires, he should [be able to] do Yibum!

אמר לא יפטור גיטי אלא מה שקנה מאמרי.

(e)

Question: If he said "my Get should exempt only what my Ma'amar acquired" [what is the law]?

ואפילו מה שקנה (מאמרי לא פטר גיטי) [צ"ל מאמרו לא פטר גיטו - חשק שלמה]. כריתות אין זו כריתות.

(f)

Answer: Even what his Ma'amar acquired, his Get did not exempt it. [A Get must be] "Kerisos" (totally severing), and this is not Kerisos [so he can do Yibum - SEFER NIR, CHESHEK SHLOMO].

A Pasul Chalitzah (e.g. after a Ma'amar; also a Get is needed, like our Mishnah teaches) exempts.

Question: For what does it exempt? (Also a Get is needed!)

Answer: If another came and was Mekadesh the Tzarah, Kidushin takes effect in her.

Question: [If he gave a Ma'amar then did Chalitzah, and before he gave a Get] another was Mekadesh her, [do we say that] since Zikah of the Mes was uprooted from her, Kidushin takes effect in her?

או מאחר שהיא צריכה גט למאמרו לא תפשי בה קידושין.

Or, since she needs a Get due to the Ma'amar, Kidushin does not take effect in her?

א"ר בא בר ממל הדא אמרה שמצוה לקדש ואח"כ לבעול.

Answer (R. Ba bar Mamal): (Our Mishnah says that Ma'amar and Bi'ah is the proper Mitzvah.) This teaches that [also for a regular wife,] the Mitzvah is to be Mekadesh, and have Bi'ah afterwards;

מה אם שאין כתוב בה קידושין את אומר הרי זו כמצותה האשה שכתוב בה קידושין לא כ"ש:

If [for a Yevamah], about whom Kidushin is not written, you say 'this is its Mitzvah' (to be Mekadesh first), a [regular] wife, about whom Kidushin is written, all the more so!

ANOTHER ACTION AFTER GET (Yerushalmi Perek 5 Halachah 3 Daf 32b)

מתני' נתן גט ועשה מאמר צריכה גט וחליצה

(a)

(Mishnah): If he gave a Get and then a Ma'amar, she needs a Get and Chalitzah;

נתן גט ובעל צריכה גט וחליצה

(b)

If he gave a Get and had Bi'ah, she needs a Get and Chalitzah;

נתן גט וחלץ אין לאחר חליצה כלום:

(c)

If he gave a Get and did Chalitzah, nothing is needed after Chalitzah.

גמ' גט למאמרו וחליצה לזיקתו.

(d)

(Gemara): [In the Reisha] she needs a Get for his Ma'amar, and Chalitzah for his Zikah.

הדא אמרה ביאה פסולה אינה פוטרת.

(e)

Inference: (The middle clause teaches that if he gave a Get and had Bi'ah, she needs a Get and Chalitzah.) This teaches that a Pasul Bi'ah does not exempt.

איתא חמי חליצה פסולה פוטרת וביאה פסולה אינה פוטרת.

(f)

Question: How is this? (In Halachah 2 we learned that) Pasul Chalitzah exempts. Pasul Bi'ah does not exempt?!

חליצה על ידי שעיקרה פסולה פוטרת ביאה על ידי שאין עיקרה פסולה אינה פוטרת.

Answer: Chalitzah, since its essence is Pasul (forbids Yibum, if it is Pasul - PNEI MOSHE), it exempts. Bi'ah, since its essence is not Pasul, does not exempt (if it is Pasul).

ולא תפטור בה לקול ותפטור בה לחומר.

(h)

Question: [Granted, Pasul Bi'ah] should not exempt to be lenient, but it should exempt to be stringent!

Question: For what [stringency should it exempt]?

שאם בא אחד וקידש את הצרה תפשו בה קידושין.

Answer: If a [stranger] came and was Mekadesh the Tzarah, Kidushin should take effect in her.

אמר ר' יודן קיימתיה כל יבמה שאין כולה לחוץ לעולם היא בפנים עד שתצא לחוץ:

Answer (R. Yudan): I answered this - any Yevamah who is not totally outside (she is not permitted to a Zar), she is always inside (Kidushin does not take effect on her) until she goes out (through Chalitzah. MEICHAL HA'MAYIM - if Get is only mid'Rabanan, mid'Oraisa Bi'ah was proper Yibum, and Kidushin takes effect on the Tzarah! The Yerushalmi holds that Get is mid'Oraisa.)

NOTHING TAKES EFFECT AFTER CHALITZAH (Yerushalmi Perek 5 Halachah 4 Daf 32a)

מתני' חלץ ועשה בה מאמר נתן גט ובעל או בעל ועשה מאמר נתן גט וחלץ אין אחר חליצה כלום

(a)

(Mishnah): If he did Chalitzah, then gave a Ma'amar or a Get or had Bi'ah; or, if he had Bi'ah, then gave a Ma'amar or a Get or did Chalitzah, nothing takes effect after Chalitzah.

[דף לב עמוד ב] אחד יבמה אחת וא' שתי יבמות:

The same applies whether there is one Yevamah or two.

גמ' אף על פי שאמרו אין חליצה אחר חליצה אבל ביאה שלאחר חליצה פוסלתה מן הכהונה.

(b)

(Gemara): Even though they said that Ein Chalitzah after Chalitzah, Bi'ah after Chalitzah disqualifies to Kehunah.

בלא כך אינה פסולה מן הכהונה.

(c)

Question: Without [the Bi'ah], is she not disqualified to Kehunah?!

Note: The Bavli holds that a Chalutzah is forbidden to a Kohen only mid'Rabanan. If so, we could have answered that the Bi'ah forbids her mid'Oraisa. Perhaps the Gemara preferred to show how it forbids to Terumah, which she was totally permitted until now. (PF) Or, perhaps the Yerushalmi holds that the Torah forbids a Chalutzah to a Kohen (HA'GAON RAV C. KANIEVSKY, SHLITA).

אלא פסולה מלוכל בתרומה.

(d)

Answer #1: Rather, she is disqualified from eating Terumah [e.g. a Bas Kohen; had she not remarried him, she would have returned to eat Terumah of her father's house].

הבא על חלוצתו (חלוצתו פסולה) [צ"ל פסלה - קרבן העדה] מלאכל בתרומה.

(e)

Objection: One who had Bi'ah with his Chalutzah, did he disqualify her from eating Terumah?! (Chayavei Lavim disqualify only when he is an "Ish Zar", i.e. from birth he was forbidden to her!)

אלא כשבאו אחיו עליה.

(f)

Answer #2: Rather, if his brother had Bi'ah with her [he disqualified her from eating Terumah, for Kares forbids the Bi'ah].

ניחא כמאן דמר הוא אינו חייב על חלוצה. והאחין חייבין על חלוצה

Question: This is fine for the opinion that [the Choletz] is not Chayav [Kares] for the Chalutzah, but the brothers are Chayav [Kares] for the Chalutzah;

ברם כמאן דמר בין הוא בין אחין אינן חייבין על חלוצה.

However, according to the opinion that both he and the brothers are not Chayav for the Chalutzah [how can we answer]?

אלא כשבא על הצרה.

(h)

Answer #3: Rather, he had Bi'ah with the Tzarah [Kares forbids the Bi'ah].

ניחא כמאן דמר הכל מודין בצרה שהוא חייב.

(i)

Question: This is fine for the opinion that all agree that he is liable for the Tzarah;

ברם כמאן דמר הוא אינו חייב לא על חלוצה ולא על הצרה.

However, according to the opinion that he is not liable for the Chalutzah and not for the Tzarah [how can we answer]?

אלא כשבאו אחין עליה.

Answer #4: Rather, [one of] his brothers had Bi'ah with [the Tzarah].

ניחא כמאן דמר בין הוא בין אחין אינן חייבין על החלוצה אבל חייבין על הצרה.

Question: This is fine for the opinion that both [the Choletz] and the brothers are not Chayav for the Chalutzah, but they are Chayav for the Tzarah;

ברם כמאן דמר בין הוא בין אחין אינן חייבין לא על החלוצה ולא על הצרה.

However, according to the opinion that both [the Choletz] and the brothers are not liable for the Chalutzah and not for the Tzarah [how can we answer]?

אלא כר"ע דר"ע אומר יש ממזר בחלוצה.

Defense of Answer #1: It is like R. Akiva, who says that Yesh Mamzer from a Chalutzah.

Answer #5 (R. Yosi): The case is, her Yavam is a Kohen. He had Bi'ah with her, and made her a Chalalah (for a Chalutzah is forbidden to Kehunah).

נתן גט וחלץ אין אחר חליצה כלום.

(Mishnah): If he gave a Get and did Chalitzah, nothing takes effect after Chalitzah.

ולא כבר תנינן אין לאחר חליצה כלום.

(o)

Question: Was it not taught already (Mishnah 3) that nothing takes effect after Chalitzah?

בגין ניתנינה דבתרא אחד יבמה ואחד שתי יבמות.

(p)

Answer: Since it taught after this (our Mishnah) "whether there is one Yevamah or two" (it repeated that nothing takes effect after Chalitzah, i.e. even when there are two Yevamos).

אילו המקדש חלוצתו שמא [צ"ל לא - קרבן העדה] תפשו בה קידושין.

(q)

Question: If one was Mekadesh his Chalutzah, does Kidushin not take effect in her?! (Ma'amar is Kidushin. Why does it not take effect after Chalitzah?)

תיפתר אי כרבי שלא לדעת

(r)

Answer #1: We can say that it is like Rebbi [and the Ma'amar was given] Bal Korchah (against her will. He holds that Ma'amar acquires a Yevamah Bal Korchah, but all agree that Kidushin is only with her consent, like it says below - RIDVAZ.)

או דברי הכל במתכוין לקנותה לשום מאמר יבמתו ואינה יבמתו.

Answer #2: It is like everyone. He intended to acquire her due to Ma'amar in his Yevamah, and she is not his Yevamah (he did not intend for regular Kidushin).

א"ר בא [דף לג עמוד א] ותני כן המאמר קונה בין לדעת בין שלא לדעת דברי רבי

Support (R. Ba - Beraisa): A Ma'amar acquires with Da'as (consent) or without Da'as. Rebbi says so;

וחכמים אומרים אין קונין אלא לדעת.

Chachamim say, it acquires only with Da'as.

מודה רבי בקדושין שאינן קונין אלא לדעת

Rebbi agrees that Kidushin is only with Da'as.

Question: What is Rebbi's reason?

ביאה קונה ומאמר קונה מה ביאה קונה בין לדעת בין שלא לדעת אף המאמר קונה בין לדעת ובין שלא לדעת.

Answer: Bi'ah acquires, and Ma'amar acquires. Just like Bi'ah acquires with or without Da'as, also Ma'amar acquires with or without Da'as.

וכמה דר' אומר המאמר קונה בין לדעת בין שלא לדעת כך הוא אומר הגט פוטר בין לדעת בין שלא לדעת.

(w)

Question: Just like Rebbi says that Ma'amar acquires with or without Da'as, [does he say that] so Get exempts with or without Da'as?

ולמה רבי אומר המאמר קונה בין לדעת בין שלא לדעת שכן ביאה בגדול קונה בין לדעת ובין שלא לדעת.

Answer: Why does Rebbi say that Ma'amar acquires with or without Da'as? It is because Bi'ah of an adult acquires [a Yevamah] with or without Da'as;

Should a Get exempt without Da'as? Chalitzah exempts only with Da'as!
