TOSFOS DH Kivan d'Lo Yaris Lah Kari v'Lo Anu (cont.)

(a)

Rejection: There, Rabanan fined him that he cannot annul;

1.

However, a widow to a Kohen Gadol, just like they did not fine her [to forfeit] her Kesuvah, for she has a Kesuvah, like we said above (85a), similarly they did not fine [to withhold from her husband] annulment of her vows.

2)

TOSFOS DH v'Ocheles b'Gino Terumah bi'Terumah mid'Rabanan

(SUMMARY: Tosfos explains why we cannot say that she eats Terumah mid'Oraisa.)

(a)

Implied question: Why don't we establish it to permit even Terumah mid'Oraisa, because this is [like] a minor eating Nevelos? (We need not be concerned if minors transgress.)

1.

Note: R. Akiva Eiger (114b) points out that Tosfos holds that surely, Beis Din need not stop a minor from an Isur mid'Rabanan. He questions this from the last line of Perek Cheresh, which wanted to prove that Beis Din is commanded to stop minors from eating Neveilos, since the Mishnah forbids a Cheresh to keep his Chereshes wife when she is Achos Zekukaso.

(b)

Answer #1: Below (113b, 114a) we ask whether or not Beis Din is obligated to prevent minors [from eating Isur], and this was not resolved.

(c)

Answer #2: "She eats due to him" connotes that even when she matures she eats due to this (her marriage to him), even though he did not yet have Bi'ah [with her after maturity, to make the marriage mid'Oraisa].

3)

TOSFOS DH Achal Terumah Teme'ah Meshalem v'Chulei

(SUMMARY: Tosfos explains why no one exempts due to Kam Lei bid'Rabah Minei.)

(a)

Assertion: Regarding Terumah, we cannot exempt [a Zar who ate b'Shogeg, from payment] due to Kam Lei bid'Rabah Minei (one who is liable different punishments for one action receives only the more severe one);

1.

This is even according to Abaye, who holds (Kesuvos 30b) according to R. Nechunya ben Hakanah that even Misah b'Yedei Shamayim is like Misas b'Yedei Adam (i.e. Aveiros for which Beis Din executes) for [exemption from] payment.

(b)

Explanation #1: This is because regarding Terumah, the verse explicitly reveals [that he pays] - "va'Yasaf Chamishiso Alav."

(c)

Explanation #2 (R. Yitzchak): This is because payment for Terumah is Kaparah, so Kam Lei bid'Rabah Minei does not apply;

1.

Source (Terumos 7:4 - Mishnah): Even if the Kohen wanted to pardon, he cannot pardon.

2.

Even if [a Zar] ate his own Terumah (e.g. he inherited it from his grandfather, who is a Kohen), he must separate for himself principal proper to become Kodesh.

(d)

Support: Pesachim 32a connotes like this. According to R. Yosi, who permits Hana'ah from Chametz during Pesach, one who eats Terumas Chametz during Pesach b'Mezid is exempt from payment according to R. Nechunya ben Hakanah;

1.

If he ate b'Shogeg, he must pay, even though the verse did not reveal about Kares! This is because b'Shogeg, the payment is for Kaparah.

(e)

Possibility #1: Perhaps if he ate Terumah (not Chametz) b'Mezid, he is exempt according to R. Nechunya ben Hakanah, for b'Mezid, the payment is not for Kaparah, for the Kohen can pardon it, like it says in Terumos (7:1).

(f)

Possibility #2: Or, he is liable, for once he lifted it he acquired it, like it says in Kesuvos (31b).

4)

TOSFOS DH b'Shogeg Tashlumav Tashlumin v'Chulei

(SUMMARY: Tosfos explains that "Shogeg" refers to how he ate.)

(a)

Explanation #1 (Rivan): "Shogeg" and "Mezid" refer to how he ate, but the payment is Mezid (he intentionally pays Tamei produce).

(b)

Rejection: If so, b'Mezid, why is it not payment? One can pay [anything], even bran, for the payment does not become Kodesh!

(c)

Explanation #2 (Ri): Rather, "Shogeg" and "Mezid" refer to the payment, like Rashi explained.

(d)

Implied question: The Gemara asked "if he was Mezid, why is the payment invalid? He should be blessed!...

1.

[If he pays b'Mezid, but ate b'Shogeg], when he pays Tamei Chulin, it becomes Tamei Terumah! (The Kohen cannot eat it. Why should the Zar be blessed?)

(e)

Answer: Even so, he should be blessed, for he loses. He pays more than the value of what he caused the Kohen to lose.

5)

TOSFOS DH Chisurei Michsera v'Chulei Achal Terumah Tehorah v'Chulei

(SUMMARY: Tosfos resolves this according to the opinion that one pays an equal value to what he ate.)

(a)

Question: If he pays according to the value, when he pays here Tamei Chulin, why is it valid payment?

1.

It becomes Tamei Terumah, and it is not worth like the Tahor Terumah that he ate!

(b)

Answer: He pays so much Tamei Chulin, that when it becomes Tamei Terumah, it is worth for burning like the Tahor Terumah that he ate.

(c)

Implied question: When he does so b'Mezid, why do we fine him, since what he pays is worth as much as the Terumah [that he ate]?

(d)

Answer: It is because he pays something that people are not eager to buy.

6)

TOSFOS DH Azil Kohen u'Mekadesh Ishah v'Chulei

(SUMMARY: Tosfos explains why we did not ask how the Terumah reverts to be Chulin.)

(a)

Question: Why don't we ask that mid'Oraisa it is payment, and it becomes Terumah, and Rabanan say that it is not payment, and it is Chulin and it is permitted to Zarim? (I.e. also this shows that Chachamim can uproot Torah law!)

(b)

Answer (Ri): He could have said that "it is not payment" means that it returns to the owner, but really it is Terumah.

(c)

Question: What is the question from Kidushin? Perhaps it is because Hefker Beis Din Hefker, like he said above (89b)!

(d)

Answer (Ri): It is not appropriate to say so here. The Kohen did nothing wrong. Why should we be Mafkir his property?!

7)

TOSFOS DH v'Ha Hacha demid'Oraisa Artzuyei Meratzeh d'Tanan Al Mah ha'Tzitz Meratzeh v'Chulei

(SUMMARY: Tosfos points out that elsewhere, we resolved the Beraisos differently, and resolves this with our Sugya.)

(a)

Question: In Menachos (25b) and Pesachim (80b) we ask these Beraisos against each other. Ravina and Rav Shila answered;

1.

One said that whether the Tum'ah was b'Shogeg or b'Mezid, if Zerikah was b'Shogeg, Hurtzeh (the Korban is accepted), but not if the Zerikah was b'Mezid;

2.

The other said oppositely. (Whether the Zerikah was b'Shogeg or b'Mezid, it is Hurtzeh only if the Tum'ah was b'Shogeg, but not if it was b'Mezid.)

3.

Here, it connotes that one Beraisa gives the Torah law, and the other is mid'Rabanan!

(b)

Answer (Ri): There, we cannot answer that this that was taught "whether b'Mezid or b'Shogeg" is mid'Oraisa, but mid'Rabanan, b'Mezid is not Hurtzeh;

1.

Since it was taught Stam, this connotes that it comes to teach Halachah in practice. Whether b'Shogeg or b'Mezid, it is Meratzeh even mid'Rabanan.

2.

Also here, it is proven that since it was taught that the Tzitzis is Meratzeh, both for Shogeg and Mezid of Tum'ah according to one opinion, or Zerikah according to the other opinion, mid'Oraisa we cannot distinguish;

i.

[Mid'Oraisa] it is Meratzeh for both of them, both for Shogeg and Mezid.

(c)

Explanation (Ri): They (Ravina and Rav Shila) argue about the following:

1.

One holds that there is more reason to fine about Tum'ah b'Mezid, for it is the beginning of the Pesul, and he did not do a Mitzvah when he was Metamei it;

2.

The other holds that there is more reason to fine about Zerikah [b'Mezid], for he offers something Tamei to Hash-m. This is a greater disgrace.

8)

TOSFOS DH v'Al ha'Basar

(SUMMARY: Tosfos explains how Ritzuy Tzitz helps for meat.)

(a)

Implied question: According to the opinion that we offer blood even if there is no meat [to be eaten], what is the relevance that the Tzitz is Meratzeh for [Tamei] meat?

(b)

Answer: It makes it considered like Tahor, to enable it to become Pigul, and to remove Me'ilah from it, like it says in Pesachim (78a);

1.

However, the Tzitz is not Meratzeh to permit eating the meat. This is proven there.

9)

TOSFOS DH Bein b'Yachid Bein b'Tzibur

(SUMMARY: Tosfos explains that this is like the opinion that Tum'ah Dechuyah b'Tzibur.)

(a)

Explanation: This is like the opinion that Tum'ah is Nidcheh b'Tzibur (we must offer Korbanos Tzibur in Taharah as much as possible);

1.

According to the opinion that Tum'ah is Hutrah (wholly permitted) b'Tzibur, we do not require Ritzuy Tzitz. This is proven in Pesachim (78a).

90b----------------------------------------90b

10)

TOSFOS DH Kulhu Nami Shev v'Al Ta'aseh Hu

(SUMMARY: Tosfos explains why Sadin is Shev v'Al Ta'aseh.)

(a)

Question: Tzitzis on a linen garment is not Shev v'Al Ta'aseh! If one covers himself with a Talis that is obligated, and it has no Tzitzis, he overtly transgresses!

(b)

Answer: At the time he puts it on, he is still not obligated until he is wrapped in it.

1.

"Kesuscha" connotes that you are already covered in it. "Asher Techaseh Bah" comes for a different Drashah, like we say in Menachos (41a);

2.

After he is covered, and is obligated, it is Shev v'Al Ta'aseh [not to affix Tzitzis].

(c)

Question: In Berachos (20a), it connotes that when he is wearing Sha'atnez and does not remove it, this is not considered Shev v'Al Ta'aseh, rather, an overt act!

(d)

Answer (Ri): Sha'atnez is different, for the primary Isur is when he puts it on. He put it on b'Isur;

1.

Here, there is no Chiyuv until after he is covered, like I explained.

(e)

Question: We bless Lehis'atef b'Tzitzis. This connotes that at the time of covering himself, he does the Mitzvah!

1.

Also, from the word Lehis'atef, Bahag proved that we hold that Tzitzis is an obligation on the person [wearing the garment. There is no Mitzvah on the garment, i.e. one need not put Tzitzis on a garment he is not wearing.

11)

TOSFOS DH v'Ligmar Minei

(SUMMARY: Tosfos discusses how we could have learned from Eliyahu.)

(a)

Question: There is different, for Hash-m told [Eliyahu] through prophecy to transgress. How can we learn from there to transgress due to an enactment of Rabanan, not based on Hash-m's word?!

(b)

Answer: Since through prophecy it is permitted for a current need, the same applies not through prophecy, for now [after Moshe], a prophet cannot change [Torah law], like we learn in Megilah (2b) from verses.

(c)

Question: It says in Sanhedrin (89b) that an established prophet is different.

1.

Citation (89b): If you would not say so, how did Yitzchak heed Avraham [to consent to be a Korban] on Har ha'Moriyah? [And] how did others rely on Eliyahu and slaughter a Korban outside the Mikdash? (Aruch l'Ner - the verses say that Eliyahu offered it. The Gemara understands that others slaughtered it.)

2.

Summation of question: Why must we say that Eliyahu was an established prophet? [The conclusion of our Sugya] connotes that also Beis Din may transgresses to fence a matter (prevent greater transgressions)!

(d)

Answer (Ri): Because he was established to be a prophet, they relied on his promise that fire will come down;

1.

They slaughtered Kodshim b'Chutz based on his promise that in his merit and Tefilah fire will descend from Shamayim, and this will fence a matter; Hash-m's name will be sanctified in public, and through this Yisrael will change their ways for the better.

12)

TOSFOS DH Kol ha'Mekadesh a'Daita d'Rabanan Mekadesh

(SUMMARY: Tosfos says where he explained this.)

(a)

Reference: I explained this in Gitin (33a). [See also Tosfos Bava Basra 48b.]

13)

TOSFOS DH Taima Mai Amur Rabanan Metzi'as ha'Ishah l'Ba'alah Mishum d'Lo Tihavi Lei Eibah

(SUMMARY: Tosfos explains that both Metzi'ah and earnings are due to both food and enmity.)

(a)

Question: In Kesuvos (66a), it says that her Metzi'ah is like extra earnings through difficulty.

1.

Inference: Her Metzi'ah is in exchange for food, just like her earnings, for we compare it to extra earnings. Here, it connotes that her Metzi'ah is due to enmity!

2.

However, we can say that also her earnings are due to enmity, like it says in Kesuvos (58b);

3.

Citation (58b): He holds that Rabanan primarily enacted food, and earnings are due to enmity.

(b)

Question: Since Metzi'ah and earnings are both due to food and enmity, why did the Gemara here say that Metzi'ah is due to enmity, and that earnings are because he feeds her?

1.

It should have given one reason for both of them! (Tosfos ha'Rosh - the primary enactment of earnings was so that he will feed her generously. They enacted also Metzi'ah, to avoid enmity.)

14)

TOSFOS DH Haysah Bas Yisrael Nifselah Min ha'Kehunah Peshita

(SUMMARY: Tosfos resolves why above, this was not obvious.)

(a)

Question: Why is this obvious? Above (35a), we needed to deduce from our Mishnah that an Eshes Yisrael who was raped is Pesulah to Kehunah!

(b)

Answer (Ri): There, we needed to deduce only because even though she is permitted to her husband, she is forbidden to Kehunah;

1.

Here, since our Mishnah teaches that she is forbidden to her husband mid'Rabanan, for it says "she must leave both of them", obviously she is forbidden also to Kehunah, for mid'Rabanan we apply to her also "v'Nitme'ah"!
