PLACING AN EIRUV IN A TREE (Yerushalmi Halachah 4 Daf 9b)

נתנו באילן למעלה מעשרה טפחים אינו עירוב

(a)

If he placed the Eiruv in a tree above 10 Tefachim, it is not an Eiruv (as he cannot retrieve it on Shabbos, since it has been put in a different domain).

למטה מעשרה טפחים עירובו עירוב ואסור לטלטלו

(b)

If he placed it in a tree below 10 Tefachim, it is a valid Eiruv but he cannot move it (as he will be making use of the tree by removing it).

למטה מג' מותר

(c)

If placed below 3 Tefachim, it may be removed (as there is no prohibition against using a tree under 3 Tefachim).

וקשיא אם עירובו עירוב יהא מותר לטלטלו ואם אסור לטלטלו לא יהא עירוב

(d)

Question: If it is a valid Eiruv, it should be permitted to move and if it is prohibited to move, it should not be a valid Eiruv (if one cannot retrieve it, how can it be a valid Eiruv)?

ראוי הוא לעבור על השבות ולוכל

(e)

Answer: One could transgress the Rabbinic prohibition of using a tree by removing it during Bein Hashmashos to eat.

מעתה אפילו למעלה מעשרה

(f)

Question: If so, it should be valid even if it is above ten (as the Eiruv is located in a Makom Patur - an area that is less than 4X4 Tefachim that is exempt from the laws of transferring on Shabbos; and he is located below it in the Public Domain; he should therefore be able to retrieve it)?

Answer (Rav Yehudah quoting Shmuel): The tree trunk is 4 Tefachim wide (so the Eiruv is located in a full private domain and may not be removed).

R. Mana: It applies when the public domain fully surrounds it (it is invalid as there is no way to retrieve it).

באומר שביתתי תחתיו

(i)

Also, for it to be invalid, he must have said, "My dwelling place is under this tree"; if he would have said "My dwelling place is above", he would be allowed to use it.

תני נתנו בכלכלה ותלויו באילן למעלה מי' טפחים אינו עירוב

Beraisa: If the Eiruv was placed in a basket and hung on a tree above 10 Tefachim, it is not a valid Eiruv.

למטה מי' טפחים עירובו עירוב ואסר לטלטלו

(k)

If the basket was placed below 10 Tefachim, it is a valid Eiruv but he may not move it.

למטה מג' מותר

(l)

If the basket was placed below 3 Tefachim, it is permitted.

קשיא אם עירובו עירוב יהא מותר לטלטלו ואם אסור לטלטלו לא יהא עירובו עירוב

(m)

Question: If the Eiruv is valid, he should be permitted to move it; if it may not be moved, it should be invalid?

ר' אחא בשם רבי חיננא ראוי הוא להפכה ולבטל רשות היחיד שבה

Answer (R. Acha quoting R. Chinana): (Since the basket is long) He is able to tip it until one side is below ten Tefachim and no longer a private domain (and he could take it during Bein Hashmashos since doing so would only be Rabbinically prohibited).

Question (R. Yosa): Can we learn from here that a bench that is ten Tefachim tall and four Tefachim wide that is located in a public domain can be tipped out of the public domain, and therefore, it is a valid location for an Eiruv and can be moved?

תמן תנינן שתים בידי אדם ואחת באילן או שתים באילן ואחת בידי אדם כשירה ואין עולין לה ביום טוב

Our Mishnah taught: If two walls are made by man and one is made in the tree; or two are made in the tree and one is made by man, it is valid but he may not climb into it on Yom Tov.

הכא את אמר כשירה ואין עולין לה בי"ט. והכא את אמר עירובו עירוב ומותר לטלטלו

Question: Here you say that it is valid but he may not climb into it on Yom Tov and here you say that it is a valid Eiruv and permitted to move?

אמר רבי ירמיה כאן מלמעלן כאן (מלמטן) [מן הצד]

Answer (R. Yirmiyah): One is where the Sukah is above (inside the tree) and one is on the side.

הדא ילפה מן ההיא וההיא ילפה מן הדא

Sukah learns from Eiruvin and Eiruvin learns from Sukah -

הדא ילפה מן ההיא שאם היה נתון בצידו של אילן שעירובו עירוב ומותר לטלטלו

Sukah learns from Eiruvin that if the Eiruv was positioned on the side of the tree, it is a valid Eiruv and permitted to carry.

וההיא ילפה מן הדא [דף י עמוד א] שאם היו שתי יתידות יוצאות וסיכך על גביהן שהיא כשירה ועולין לה בי"ט

Eiruvin learns from Sukah that if there were two pegs protruding and he rested Schach on top of them, it is a valid Sukah and he may climb into it on Yom Tov.

אמר רבי יוסה בין הכא בין תמן מן הצד היא

R.Yosa: Both here and there it is on the side.

Question: What is the law?

כההיא דאמר ר' יעקב בר אחא בשם ר' זעירה דר"ש בן אלעזר היא. דתני רשב"א אומר מותר להשתמש על צידדי בהמה בשבת

(v)

Answer (R. Yaakov bar Acha quoting R. Zeira): It follows R. Shimon ben Elazar who said in a Beraisa that it is permitted to use the 'sides' of an animal on Shabbos.

היא צידדי בהמה היא צידדי אילן

(w)

Conclusion: The sides of an animal are the same as the sides of a tree.
