1)

HOW MANY LEVELS OF TUM'AH ARE THERE? (Yerushalmi Perek 5 Halachah 2 Daf 21b)

מתני' בו ביום דרש רבי עקיבה [ויקרא יא לג] וכל כלי חרש אשר יפל מהם אל תוכו כל אשר בתוכו יטמא אינו אומר טמא אלא יטמא לטמא את אחרים

(a)

(Mishnah): On that day (when R. Elazar ben Azaryah became Nasi, and all were permitted to enter the Beis Medrash), R. Akiva expounded "if (a Sheretz) will fall into any earthenware Kli, any food in the Kli Yitma (will become Tamei." The Torah wrote Yitma, for this can be read Yetamei); it will be Metamei others;

לימד על ככר השני שמטמא את השלישי

This teaches that a loaf that is a Sheni (second degree Tum'ah, i.e. a Rishon (something that touched a source of Tum'ah) makes another food a Shlishi (third degree Tum'ah).

אמר ר' יהושע מי יגלה עפר מעיניך רבן יוחנן בן זכאי שהייתה אומר עתיד דור אחר לטהר את ככר השלישי שאין לו מקרא מן התורה והרי עקיבה תלמידך הביא לו מקרא מן התורה שהוא טמא שנאמר כל אשר בתוכו יטמא:

R. Yehoshua: Who will uncover the earth from your eyes, R. Yochanan ben Zakai! You said, [perhaps] a later generation will be Metaher a Shlishi loaf, for no verse teaches this. R. Akiva, your Talmid, brought a verse from Torah that it is Tamei - "Kol Asher b'Socho Yitma"! (RAMBAM on Mishnah 5 - even though R. Akiva was the Talmid of R. Yochanan ben Zakai's Talmid, he said 'your Talmid', due to R. Akiva's greatness.)

גמ' רבי יוסי בי רבי בון אמר רב ושמואל חד אמר בין בתרומה בין בחולין אמר ר' עקיבה. וחורנה אמר בתרומה אבל לא בחולין. ולא ידעין מאן אמר דא ומאן אמר דא.

(b)

(Gemara - R. Yosi bei R. Bun) Question: Rav and Shmuel - one of them said, R. Akiva discussed both Terumah and Chulin. The other said, R. Akiva discussed Terumah, but not Chulin. We do not know who said this, and who said this.

מן מה דמר רבי יוסי בשם ר' יונה אמרי לה רב בשם ר' חייה רובא השלישי בא מחמת השרץ. הוי אמר הוא דו אמר בין בתרומה בין בחולין אמר ר' עקיבה.

Answer: Since R. Yosi said in the name of R. Yonah, they say that Rav said in the name of R. Chiyah Ruba, a Shelishi [of Tum'ah] comes due to a [Kal v'Chomer from a] Sheretz, this shows that Rav said that R. Akiva discussed both Chulin and Terumah.

מתניתא פליגא על רב אוכל מעשר שהוכשר במשקה ונגע בו טבול יום או ידים מסואבו' מפרישין ממנו תרומת מעשר בטהרה מפני שהוא שלישי והשלישי טהור בחולין.

(d)

Question: A Beraisa argues with Rav! A food of Ma'aser that was Huchshar through a liquid, and a Tevul Yom or dirty (Tamei) hands touch it, one may separate Terumas Ma'aser from it b'Taharah, for it is a Shelishi, and a Shelishi of Chulin is Tahor.

פתר להקל הוא בידים שהן מדבריהן.

(e)

Answer: We are lenient about hands. [Their Tum'ah] is mid'Rabanan.

והא תנינן טבול יום.

(f)

Question: The Beraisa mentioned also a Tevul Yom!

תיפתר בטבול יום בית הפרס.

(g)

Answer #1: He is a Tevul Yom [after immersing due to Tum'as] Beis ha'Peras (a field in which a grave was lost or plowed. Its Tum'ah is mid'Rabanan.)

א"ר זעירא ואפי' תימר בטבול יום דבר תורה שנייא היא דכתיב טהור טמא טהור לחולין מבעוד יום ולתרומה משתחשך.

Answer #2 (R. Ze'ira): You can even say that he is a Tevul Yom mid'Oraisa. Here is different, for it says [about him] "Tahor" and "Tamei" - he is Tahor for Chulin during the day (once he immersed), and for Terumah after dark.

התיב ר' חגיי קומי רבי יוסי או נימר טהור במגע וטמא באכילה.

(i)

Question (R. Chagai, to R. Yosi): Perhaps we should say that he is Tahor for touching, and Tamei (forbidden) for eating!

אמר ליה כלים אמורים בפרשה. אית לך מימר גבי כלים טהורים במגע וטמאים באכילה.

Answer (R. Yosi): The Parshah discusses Kelim. Can you say that Kelim are Tahor for touching, and Tamei for eating?!

מתניתא מסייעא לרב הראשון שבחולין טמא ומטמא והשיני פוסל ולא מטמא והשלישי נאכל בנזיד הדמע.

Support (for Rav - Mishnah): The first (a Rishon l'Tum'ah) in Chulin is Tamei and Metamei [others]. The Sheni is Pasul, and is not Metamei. The Shelishi may be eaten with a mixture of Terumah.

[דף כב עמוד א] הא לעשותו דמע אסור.

Inference: One may not make [a Shelishi] Terumah. (If a Shelishi of Chulin were totally Tahor, one would be allowed to make it Terumah!)

ואמור דבתרה הראשון והשיני שבתרומה טמאין ומטמאין. והשלישי פוסל ולא מטמא. והרביעי נאכל בנזיד הקודש.

Question (Seifa): The Rishon and Sheni of Terumah are Tamei and Metamei. The Shelishi is Pasul and is not Metamei. The Revi'i may be eaten with a mixture of Kodesh.

אין תימר הא לעשותו קודש אסור. אשכחת מימר מחלפה שיטתיה דרב

If you will [similarly infer] that it is forbidden to make [a Revi'i] Kodesh, Rav contradicts himself!

דמר רבי בא בשם רב שלישי בא מחמת השרץ והרביעי מותר לעשותו קודש שלא אמרו רביעי בקודש אלא בקדשי המקדש מקודשין.

i.

(R. Ba citing Rav): A Shelishi comes from [a Kal v'Chomer from] a Sheretz, and a Revi'i, one may make it Kodesh! They said that there is a Revi'i of Kodesh only for Kodshei ha'Mikdash that are [already] Kodesh (e.g. meat of Korbanos).

אמר רבי חונה ולא בתרומה אנן קיימין. ותרומה אסור לעשותה קודש שלא להמציא בה תקלה.

(m)

Answer (R. Chunah): Does [the Mishnah] not discuss Terumah? One may not make Terumah Kodesh, lest he bring it to Takalah (it will not be eaten in time).

ואמור דבתרה הראשון והשיני והשלישי שבקודש טמאים ומטמאים והרביעי פסול ולא מטמאה. והחמישי נאכל בנזיד הקודש

(n)

Question (Seifa): The Rishon, Sheni and Shelishi of Kodesh are Tamei and Metamei. The Revi'i is Pasul and is not Metamei. The Chamishi may be eaten with a mixture of Kodesh.

אין תימר הא לעשות קודש אסור. וכי יש חמישי בקודש.

If you will [similarly infer] that it is forbidden to make [a Chamishi] Kodesh, is there a Chamishi in Kodesh?!

ואת אמר לית כן והכא לית כן.

2.

Conclusion: You cannot [infer so]. And [also] here you cannot [infer that a Shelishi of Chulin has Tum'ah, therefore one may not make it Terumah. We explained this like PNEI MOSHE.]

THE SOURCE FOR THE LEVELS OF TUM'AH (Yerushalmi Perek 5 Halachah 2 Daf 22a)

[צ"ל ר' הילא בשם - שערי תורת ארץ ישראל] רבי יוחנן השלישי בא מחמת השרץ מותר לעשותו תרומה.

(a)

(R. Heila citing R. Yochanan): A Shelishi that comes due to a [Kal v'Chomer from a] Sheretz, one may make it Terumah.

בעי קומוי אפילו כר"ע.

Question: Is this even like R. Akiva?

רבי יוסי בשם ר' הילא ואפילו כר"ע.

2.

Answer (R. Yosi citing R. Heila): It is even like R. Akiva. (R. Akiva expounded a Shelishi only for Terumah.)

ולמה.

3.

Question: What is the reason?

טבול יום פסיל. והשיני פסיל. מה טבול יום אינו פוסל את החולין מלעשותן תרומה אף השני אינו פוסל את החולין מלעשותן תרומה.

Answer: A Tevul Yom disqualifies, and a Sheni disqualifies. Just like a Tevul Yom does not disqualify Chulin from making it Terumah, also a Sheni does not disqualify Chulin from making it Terumah.

ר' יוסי בשם ר' יוחנן שלישי בא מחמת שרץ אסור לעשותו תרומה ומותר לעשותו קודש.

(b)

(R. Yosi citing R. Yochanan): A Shelishi that comes due to a Sheretz, one may not make it Terumah, (because Tevel from which one must separate Terumah, it is like Terumah regarding Tum'ah), but one may make it Kodesh.

ר' זעירא בעא קומי ר' יסא מטמא בקודש ואת אמר אכן.

(c)

Question (R. Ze'ira, to R. Yosa): [A Shelishi] is Metamei (makes a Revi'i) in Kodesh, and you say so?!

אמר ליה משום מעלה.

(d)

Answer (R. Yosa): This is a Mailah (a mere stringency mid'Rabanan).

אמר רבי שמואל בר רב יצחק עיקר טומאתו בקודש משום מעלה.

(e)

(R. Shmuel bar Rav Yitzchak): The entire Tum'ah [of a Shelishi] in Kodesh is [mid'Oraisa, but it is a Mailah. (This Mailah does not apply to Chulin.)

אמר רבי יוסי ולמה הוא מטמא בקודש משם מעלה.

(f)

(R. Yosi): Why is [a Shelishi] Metamei Kodesh? This is due to a Mailah.

אמר ר' יודן (ואפילו) [צ"ל אתי - נועם ירושלמי] כרבנן דאינון אמרין אין השלישי בחולין ולמה הוא אמור מטמא בקודש משם מעלה.

(g)

(R. Yudan): [R. Yochanan's teaching] is like Rabanan, who say that there is no Shelishi in Chulin. Why is it Metamei in Kodesh? This is due to a Mailah. (We explained this like NO'AM YERUSHALMI.)

אמר ליה רבי יוסי ולית אנן צריכין שמעין ליה מן בר נש רב.

(h)

(R. Yosi): We need not hear this from a great Chacham! (Obviously, according to R. Akiva, who says that a Shelishi of Chulin is Tamei, one may not make it Kodesh!)

[דף כב עמוד ב] תמן אמרין ממה שקילס רבי יהושע את ר' עקיבה הדא אמרה הלכה כיוצא בו.

(i)

There (in Bavel) they say that from R. Yehoshua's praise of R. Akiva [in our Mishnah], this teaches that the Halachah follows him.

רבנן דקיסרין אמרין למדרשו קילסו. אבל למעשה אין הלכה כיוצא בו.

(j)

(Rabanan of Kisarin): He praised him for his Drashah, but in practice, the Halachah does not follow him;

דמר ר' אחא רבי מיישא בשם רבי לעזר [אין] לוקין על השלישי שבמעשר ואפילו כרבי (עקיבה) [צ"ל שמעון - נועם ירושלמי] אינן לוקין.

(R. Acha citing R. Maisha citing R. Lazar): One is not lashed for eating a Shelishi of Ma'aser [Sheni]. Even according to R. Shimon [who says that one is lashed for eating Tamei Ma'aser], he is not lashed.

למה

2.

Question: What is the reason?

טבול יום פוסל והשיני פוסל מה טבול יום אין לו מגע אצל החולין. אף השיני אין לו מגע אצל החולין.

Answer: A Tevul Yom disqualifies, and a Sheni disqualifies. Just like a Tevul Yom has no [consequence] of touching regarding Chulin, also a Sheni has no [consequence] of touching Chulin;

אמר רבי אלעזר כמיניין החולין כך מיניין המעשר.

4.

(R. Elazar): Like the number [of levels of Tum'ah] of Chulin, so is the number [of levels of Tum'ah] of Ma'aser.

ואתייא כיי דמר רבי יונה רבי אימי בשם רבי שמעון בן לקיש בכל חולין אנן קיימין ואהן פירקא מעשר אינון.

5.

This is like R. Yonah said citing R. Imi citing Acha citing Reish Lakish.(A Mishnah in Chulin teaches that if one slaughtered a Chayah and no blood came out, one may eat the meat with Tamei hands. We infer that if it was Huchshar through blood, it is forbidden, even though hands are a Sheni and a Chayah is Chulin!) Our tractate discusses Chulin - does this Perek discuss Ma'aser?!

אמר ר' יוסי ואפילו ראשון שבו אינו מחוור. לא (אוכל) [צ"ל תאכל - קרבן העדה] אין כתיב כאן אלא [דברים כו יד] לא אכלתי.

(k)

Question (R. Yosi): Even [lashes for] a Rishon [l'Tum'ah of Ma'aser] is not clear. It does not say [a command] 'Lo Sochal' rather, "Lo Achalti"!

אמר רבי אבא מרי (מניין) [צ"ל מכיון - גליוני הש"ס] דכתיב [שם יג] ככל מצותך אשר צויתני כמי (שאינו) [צ"ל שהוא - קרבן העדה] מחוור.

(l)

Answer (R. Aba Mari): Since it says "k'Chol Mitzvosecha Asher Tzivisani" - it is like [a command] that is clear.

רבי אבהו בשם רבי מנא מפני מה אמרו השיני שבחולין מטמא משקה חולין מפני הידים שהן מדבריהן מטמאות משקה חולין. שיני שהוא מדבר תורה לא כל שכן.

(m)

(R. Avahu citing R. Mana): Why did they say that a Sheni of Chulin is Metamei a liquid of Chulin? It is due to hands, which mid'Rabanan are Metamei a liquid of Chulin. A Sheni mid'Oraisa, all the more so [it is Metamei a liquid of Chulin]!

אי מה הידים ספיקן לטמא את אחרים (טמא אף המשקין ספיקן לטמא את אחרים טמא) טהור אף השיני ספיקו לטמא אחרים טהור.

Suggestion: Just like hands, a Safek whether or not they were Metamei others, it is Tahor, also a Sheni, a Safek to be Metamei others should be Tahor! (He holds that we are more stringent about a Sheni.)

התיב ר' חנינא לרבי מנא הרי אוכל אוכלין טמאין ושותה משקין טמאין ספיקן לטמא את אחרים טמא והמשקין היוצא מהן ספיקן לטמא את אחרים טמא.

2.

Rejection (R. Chanina, to R. Mana): (You cannot compare them. When the entire decree is due to Safek, we are stringent about a Safek.) One who eats Tamei food or drinks Tamei liquids (he becomes Tamei mid'Rabanan), a Safek whether or not he was Metamei others, it is Tamei. Liquids that come from [his body], a Safek to be Metamei others is Tamei.

[דף כג עמוד א] והא שיני שהוא דבר תורה ספיקו לטמא את אחרים טהור.

3.

[Will you say that] a Sheni, which is mid'Oraisa, a Safek to be Metamei others is Tahor?!

אמר ר' מנא קומי ר' חנינה ולא בתרומה אנן קיימין

(n)

Question (R. Mana, to R. Chaninah): [One who eats Tamei food becomes Tamei -] is this not [due to concern] for Terumah? (You cannot learn from there to be stringent about Chulin!)

אמר ליה ואפילו תימר בתרומה אנן קיימין מה אית ליה טמא יטמא דבר תורה לא ר' עקיבה.

(o)

Answer (R. Chanina): Even if you will say that he discusses Terumah - who holds that Tamei (a Sheni) Yitma (is Metamei others) mid'Oraisa? Is it not R. Akiva? (According to Chachamim, there is no source to be more stringent about Terumah than Chulin. We explained this like MEICHAL HA'MAYIM.)

תמן אמרין שתי שאילות שאלן חגי הנביא אחת השיבו אותו כראוי ואחת לא השיבו לו כראוי.

(p)

There (in Bavel), they say that Chagai ha'Navi asked two questions. They answered one properly, and one incorrectly;

[חגי ב יב] הן ישא איש בשר קודש בכנף בגדו. כנף תחלה. בשר קודש שני. לחם ונזיד שלישי. ויין ושמן ומאכל רביעי. וכי יש רביעי בקודש.

"Hen Yisa Ish Besar Kodesh bi'Chnaf Bigdo [v'Noga bi'Chnafo El ha'Lechem v'El ha'Nazid v'El ha'Yayin v'El ha'Shemen v'El Kol Ma'achal ha'Yikdash]" - the corner [of his garment] is a Rishon. The Kodesh meat is a Sheni. The bread or Tavshil is a Shelishi. The wine, oil or food is a Revi'i. [Chagai asked], is there a Revi'i in Kodesh?

ויענו הכהנים ויאמרו לא. לא השיבו אותו כראוי שיש רביעי בקודש.

"Va'Ya'anu ha'Kohanim va'Yomru Lo." They did not answer him properly, for there is a Revi'i in Kodesh.

[שם יג] ויאמר חגי אם יגע טמא נפש בכל אלה היטמא אם תהיה כנף טמא נפש ונגעה בכל אלה היטמא.

"Va'Yomer Chagai Im Yiga Temei Nefesh b'Chol Eleh ha'Yitma" - if the corner was Tamei Mes, and it touched all of these, does it become Tamei?

ויענו הכהנים ויאמרו יטמא. השיבו אותו כראוי.

i.

"Va'Ya'anu ha'Kohanim va'Yomru Yitma" - they answered him properly;

דמר ר' ירמיה רבי חייה בשם ר' יוחנן קודם עד שלא גזרו רביעי בקודש שאלן.

(R. Yirmeyah citing R. Chiyah citing R. Yochanan): He asked them before they decreed a Revi'i in Kodesh. (They answered both questions correctly, unlike Chachamim of Bavel said.)

ולמה הוא מקללן

1.

Question: [If so,] why did he curse them?

כאינש דבעי עילה על חבריה וביתא מה אכפה ליה

2.

Answer: This is like one who seeks a pretext against his friend. [He cursed them] because they did not care about the Bayis (they abandoned rebuilding it).

לא. דו אמר ואשר יקריבו שם טמא הוא.

3.

Question: Why did he say "va'Asher Yakrivu Sham Tamei Hu"?

כמה דמר רבי סימון בר זבדי גולגולתו של ארנן היבוסי מצאו תחת המזבח.

4.

Answer: It is like R. Simon bar Zavdi said - they found the skull of Arnon ha'Yevusi (David bought his granary to build the Beis ha'Mikdash there) under the Mizbe'ach. (In Bayis Sheni, they made the Mizbe'ach bigger; it was under the addition. We explained this like ALEI TAMAR.)

ר' אחא בשם רבי אבא בר כהנא בקיאין היו בהיסטות ולא היו בקיאין במדפות.

(r)

(R. Acha citing R. Aba bar Kahana): They were experts in the laws of Tum'as Heset; they were experts in the laws of Madafos (clothes that get a light Tum'ah to be Metamei food and drink).

[חגי ב יב] הן ישא איש בשר קודש. שאלן טמא מת מטמא בהיסט.

(s)

"Hen Yisa Ish Besar Kodesh" - he asked them whether a Mes is Metamei through Heset (moving it).

ויענו הכהנים ויאמרו לא. השיבו אותו כראוי שאין טמא מת מטמא בהיסט.

1.

"Va'Ya'anu ha'Kohanim va'Yomru Lo." They answered him properly, for a Mes is not Metamei through Heset.

שאלן טמא מת עושה מדף.

He asked them whether a Tamei Mes makes a Madaf;

ויענו הכהנים ויאמרו יטמא. לא השיבו אותו כראוי [דף כג עמוד ב] שאין טמא מת עושה מדף.

"Va'Ya'anu ha'Kohanim va'Yomru Yitma" - they answered him improperly, for a Tamei Mes does not make a Madaf. (We explained this like PNEI MOSHE.)
