WHAT BECOMES FORBIDDEN TO A SOTAH (Yerushalmi Perek 1 Halachah 2 Daf 4a)

תני רבי אומר שלש טומאות אמורות בפרשה אחת לבעל ואחת לבועל ואחת לתרומה.

(a)

(Beraisa - Rebbi): Tum'ah is written three times in the Parshah [of Sotah -] one [teaches that she becomes forbidden] to her husband, one [teaches Isur] to the Bo'el, and one for Terumah.

לתרומה מצינו אשה שהיא אסורה לביתה ומותרת בתרומה.

Question: [Why do we need a verse to teach that she becomes forbidden] to Terumah? Do we find a woman forbidden to her husband, and permitted to Terumah?!

למה לא אילו בת כהן שנישאת לישראל ונאנסה שמא אינה מותרת לביתה ואסורה לאכול בתרומה.

Answer: Why not?! If a Bas Kohen married a Yisrael and was raped, is she not permitted to her husband and forbidden to Terumah (even she will be widowed?! Likewise, a woman could be forbidden to her husband, and permitted to Terumah! Therefore, we need a verse to teach that adultery forbids her to Terumah.)

לא מצינו אשה שהיא אסורה לביתה ומותרת לוכל בתרומה.

(d)

Rebuttal: We do not find a woman forbidden to her husband, and permitted to Terumah. (Sometimes she is forbidden to Terumah even though she is permitted to her husband. All the more so when she is forbidden to her husband, she is forbidden to Terumah! We explained this like PNEI MOSHE.)

אמר רבי אבין איתאמרת אחת לבעל ואחת לבועל ואחת ליבם.

Correction (R. Avin): It was said that one [verse teaches Isur] to her husband, one to the Bo'el, and one to the Yavam (if her husband died, she is forbidden to do Yibum).

אמר ר' יוסי בי רבי בון מתניתא אמרה כן ואם מת חולצת ולא מתייבמת.

Support (Mishnah): If her husband dies, she does Chalitzah, not Yibum.

תנא ר' יעקב בר אידי קומי רבי יונתן [במדבר ה כ] ואת כי שטית תחת אישך פרט לאונסין.

(R. Yakov bar Idi, in front of R. Yonason - Beraisa): "V'At Ki Satis Tachas Ishech" excludes Ones (if she was raped).

Question: How do we learn from this?

אמר ליה מה תחת אישך לרצון. אף כאן לרצון.

Answer (R. Yonason): Just like "Tachas Ishech" is willingly, also here it is willingly.

סוטה כשם שהיא אסורה לבעל כך אסורה לבועל. כשם שהיא אסורה לאחיו של בעל כך היא אסורה לאחיו של בועל.

A Sotah - just like she becomes forbidden to her husband, she becomes forbidden to the Bo'el. Just like she is forbidden to her husband's brother (she may not do Yibum), she is forbidden to the Bo'el's brother (if the Bo'el transgressed and married her, and he died).

יכול כשם שצרת סוטה אסורה לאחיו של בעל כך אסורה לאחיו של בועל.

Question: Perhaps just like the Tzarah of a Sotah is forbidden to the husband's brother, so she is forbidden to the Bo'el's brother!

נישמעינה מן הדא האשה שהלך בעלה למדינת הים ובאו ואמרו לה מת בעליך. הויא לה יבם כאן ויבמה ומת ואח"כ בא בעלה אסור בה ומותר בצרתה. אסור בה ומותר באשת אחיו.

Answer: We learn from the following [Tosefta]. If a woman's husband went overseas, and they told her 'your husband died', and she had a Yavam here, and he did Yibum, and died, and afterwards her husband returned, he is forbidden to her and permitted to her Tzarah. He is forbidden to her and permitted to his brother's wife;

ואשת אחיו לא כצרת סוטה היא. הדא אמרה שצרת סוטה מותרת לאחיו של בועל.

Is his brother's wife not like the Tzarah of a Sotah (the 'Yibum' was really Zenus)? This teaches that Tzaras Sotah is permitted to the Bo'el's brother.

Limitation (R. Yudah): [This Tosefta] is like Rabanan there (in Bavel);

דמר רבי הילא תניי תמן כל העריות אינן צריכות גט חוץ מאשת איש בלבד.

(R. Heila): It was taught there teaches that all Arayos who married do not need a Get, except for Eshes Ish [who remarried according to a ruling of Beis Din];

ר"ע אומר [דף ד עמוד ב] אף אחות אשתו ואשת אחיו

R. Akiva says, even Achos Ishto and Eshes Achiv. (The first Tana does not require a Get for Eshes Achiv. This shows that one who mistakenly did Yibum is not considered a Sotah.)

ברם רבנן דהכא.

Question: However, according to Rabanan here [we cannot explain the Tosefta]!

רבי חייה בשם רבי יוחנן הכל מודין באשת אחיו שהיא צריכה הימינו גט משום הילכות אשת איש קנה בה ערוה היא. וערוה פוטרת צרתה.

(R. Chiya citing R. Yochanan): All agree that Eshes Achiv needs a Get, due to laws of Eshes Ish (the mistaken Yibum was also a case of Eshes Ish). He acquired her, and she is Ervah; Ervah exempts her Tzarah.

אמר רבי חיננא אפי' כרבנן דהכא אתי' היא בה קנסו לא קנסו ביורשיה.

Answer (R. Chinena): It is even according to Rabanan here. [Just like we say that] they fined her, and they did not fine her heirs, [similarly they fined the Yevamah, and they did not fine her Tzarah].

אמר רבי חנניה בריה דרבי הילל. אין כרבנן דתמן יהא מותר בה.

(R. Chananyah brei d'R. Hillel): (The first Tana of the Tosefta is only like Rabanan here.) If it were like Rabanan there, [the Yavam] would be permitted to her (the Yevamah, after her husband truly died)!

רבי זעירא בשם רבי יוחנן צרת סוטה אסורה וצרת גרושה מותרת לביתה.

(R. Ze'ira citing R. Yochanan): Tzaras Sotah is forbidden, and Tzaras Gerushah (i.e. Tzaras Machzir Gerushaso after she remarried) is permitted to her house (Yavam).

רבי יעקב בשם רבי יוחנן כל הצרות מותרות חוץ מצרת סוטה.

(R. Yakov bar Acha citing R. Yochanan): All Tzaros are permitted, except for Tzaras Sotah. (He discusses Tzaros of women forbidden not due to Ervah.)

שמואל אמר גרושה עצמה מותרת לביתה.

(Shmuel): Gerushah (i.e. Machzir Gerushaso) herself is permitted to her house (the Yavam, even though she became forbidden to her husband).

Question: Does [R. Yochanan] argue [with Shmuel]?

בגין דהוון עסיקין בצרות לא אדכרון גרושות.

Answer: (No.) Because they were discussing Tzaros, [R. Yochanan taught only about Tzaros; he] did not mention the law of] Gerushos (i.e. Machzir Gerushaso herself).

Question: Why is Tzaras Sotah forbidden?

רבי יוחנן אמר מריח ערוה נגעו בה.

(w)

Answer #1 (R. Yochanan): This is due to the scent of (she resembles) Ervah.

רב אמר מפני שכתוב בה טומאה כעריות:

Answer #2 (Rav): It is because Tum'ah is written about her, like about Arayos (therefore her Tzarah is forbidden, just like Tzaras Ervah).

WE BELIEVE ONE WITNESS OF TUM'AH (Yerushalmi Perek 1 Halachah 3 Daf 4b)

מתני' אילו אסורות לוכל בתרומה האומרת טמאה אני לך ושבאו לה עדים שהיא טמאה והאומרת איני שותה ושבעלה אינו רוצה להשקות' ושבעלה בא עליה בדרך

(a)

(Mishnah): In the following cases she is (forever) forbidden to eat Terumah: she says 'I am forbidden to you'; witnesses testified that she became Temei'ah; she refuses to drink; her husband refuses to make her drink; her husband had Bi'ah with her on the way [to Yerushalayim, after the seclusion].

כיצד הוא עושה לה מוליכה בבית דין שבאותו המקום ומוסרין לו שני תלמידי חכמים שמא יבא עליה בדרך

(b)

How does he do [after warning and seclusion? Her husband] takes her to the local Beis Din. They send two Chachamim [to accompany them to Yerushalayim], lest he have Bi'ah with her on the way (which is forbidden, and would prevent the water from testing her).

רבי יהודה אומר בעלה נאמן עליה:

R. Yehudah says, [this is not needed]. He is trusted not to have Bi'ah with her.

גמ' מתני' לא [צ"ל אתיא אלא - קרבן העדה] כמשנה הראשונה

(d)

(Gemara): Our Mishnah is only like Mishnah Rishonah;

דתנינן תמן בראשונה היו אומרים שלש נשים יוצאות ונוטלות כתובה

The Mishnah there [at the end of Nedarim] teaches, initially, they said that in three cases of women [who demand divorce, Beis Din forces the husband, and] they are divorced and receive the Kesuvah:

האומרת טמאה אני לך.

[A Kohen's wife says] I am Tamei [forbidden] to you (I was raped. One who willingly was Mezanah would not receive a Kesuvah. According to Mishnah Acharonah, she is not believed at all, and she is permitted even Terumah);

שמים ביני לבינך

3.

Shamayim is (a judge) between me and you (that you cannot have children);

[דף ה עמוד א] ונטולה אני מן היהודים.

4.

I forbid myself to have Bi'ah with any Yisrael.

אמר ר' אבין ואפילו תאמר כמשנה האחרונה מ"מ יש רגלים לדבר.

(e)

Rebuttal (R. Avin): We can even say that it is like Mishnah Acharonah. [There, nothing supports her claim. Here], in any case there are Raglayim l'Davar (circumstantial evidence that she was defiled).

CONDITIONS FOR THE WATER TO TEST HER (Yerushalmi Perek 1 Halachah 3 Daf 5a)

תני [במדבר ה כ] מבלעדי אישך פרט לשקדמה (שכבת זרע) [צ"ל שכיבה - קרבן העדה] אחרת לאישך.

(a)

(Beraisa): "Mi'Bal'adei Ishech" excludes when another man had Bi'ah [with you] before your husband.

אמר רבי אילא כענין שנאמר [שם כח כג] מלבד עולת הבוקר.

(b)

(R. Ila): Just like it says "Milvad Olas ha'Boker" (Olas ha'Boker precedes other Korbanos, also here, "mi'Bal'adei Ishech" means that Bi'ah with her husband preceded Bi'ah with the Bo'el).

והא תנינן כשם שהמים בודקין אותה כך הן בודקין אותו. כשם שהיא אסורה לבעל כך היא אסורה לבועל. וכשם שהיא אסורה לאחיו של בעל. כך היא אסורה לאחיו של בועל.

(c)

Question (Beraisa): Just like the water tests her (kills her if she was Mezanah), so it tests him (the Bo'el). Just like she becomes forbidden to her husband, she becomes forbidden to the Bo'el. Just like she is forbidden to her husband's brother (she may not do Yibum), she is forbidden to the Bo'el's brother;

כשם שהמים בודקין אותה על כל ביאה וביאה שהיא מקבלת את בעלה לאחר הבועל כך הן בודקין אותו.

Just like the water tests her for every Bi'ah that she has with her husband after [she had Bi'ah with] the Bo'el (her death is more painful), so it tests him (the Bo'el. This shows that the water works even if her husband had Bi'ah with her after the Zenus, unlike our Mishnah!)

ר' אבין בשם רבי הילא כאן ביודע כאן בשאינו יודע.

(d)

Answer (R. Avin): Here (our Mishnah) discusses when [her husband] does not know [that she was secluded]. Here (the Beraisa) discusses when he knows.
