EARTHENWARE SHARDS (Yerushalmi Halachah 7 Daf 56b)

מתני' חרס כדי ליתן בין פצים לחבירו דברי ר''י

(Mishnah - R. Yehudah): The Shi'ur for [shards of] Cheres is to put between pillars [so they will not lean];

רמ''א כדי לחתות בו את האור

R. Meir says, it must be big enough to stoke coals;

ר' יוסי אומר כדי לקבל רביעית

R. Yosi says, it must hold a Revi'is.

R. Meir: There is a hint, but not a proof for my opinion - "v'Lo Yimatzei vi'Mchitaso Cheres Lachtos Esh mi'Yakod.''

R. Yosi: That is not a proof! (The verse says that even my Shi'ur is important --) "v'Lachsof Mayim mi'Geve''!

(Gemara - R. Yochanan): One may be Mekadesh [Mei Chatas] in [a shard of Cheres].

Question (R. Lazar): Why does Reish Lakish say that one may not be Mekadesh in it?

מפני שאינו מקבל טומאה.

Answer #1: It is because it is not Mekabel Tum'ah.

הרי כלי גללים וכלי אבנים וכלי אדמה הרי אינן מקבלין טומאה ומקדשין בהן.

Rejection: Kelim of dung and of stone are not Mekabel Tum'ah, and one may be Mekadesh in them!

אלא משום שאינו מקבל רביעית.

Answer #2: Rather, [one may not be Mekadesh in it] because it does not hold a Revi'is.

Rejection: Doesn't Reish Lakish agree about a small whole Kli Cheres of any size, that one may be Mekadesh in it?

הוי לית טעמא אלא משום שאין עליו תואר כלי.

Answer #3: Rather, the reason is because it does not have the form of a Kli.

וקשיא על דר' יוחנן. לפסול את (הגוייה) [צ''ל המקוה - שערי תורת ארץ ישראל] אינו פוסל. ולקדש מקדשין בו.

Question (against R. Yochanan): [Such a Kli] does not [make water inside Mayim She'uvim to] disqualify a Mikveh (Mikva'os 4:3), and one may be Mekadesh in it?!

Answer: [R. Yochanan] holds like R. Yosi, who says [there] that Cheres of any size (water inside is She'uvim, and disqualifies a Mikveh).

Question: R. Yosah said so only about a whole Kli. Does he discuss a broken Kli?!

R. Chiyah taught a Beraisa that supports R. Yochanan (Tosefta Kelim 7:17 says that one may be Mekadesh in Cheres shards that receive any amount), and R. Shimon ben Yochai taught a Beraisa that supports Reish Lakish.

TUM'AH OF IDOLATRY (Yerushalmi Perek 9 Halachah 1 Daf 57a)

מתני' א''ר עקיבה מנין לעכו''ם שהיא מטמא במשא כנדה

(a)

(Mishnah - R. Akiva) Question: What is the source that an idol has Tum'as Masa (one who moves it becomes Tamei? The first Mishnayos of our Perek are unrelated to Shabbos. There were taught because they resemble Mishnah 3, which discusses the source to be Mechalel Shabbos for a recently circumcised baby.)

שנא' [ישעי' ל כב] תזרם כמו דוה צא תאמר לו [דף ע עמוד א (עוז והדר)] מה נדה מטמא במשא אף עכו''ם מטמא במשא:

Answer: "Tizrem Kemo Davah Tzei Tomar Lo'' - just like a Nidah has Tum'as Masa, also idolatry has Tum'as Masa.

גמ' כתיב תועבה בנדה. וכתיב תועבה בעכו''ם. וכתיב תועבה בשרצים.

(c)

(Gemara): It is written 'To'evah'' about Nidah, "To'evah'' about idolatry, and "To'evah'' about Sheratzim;

כתיב תועבה בנידה [ויקרא יח כט] כי כל אשר יעשה מכל התועבות האלה וגו'. תועבה בעכו''ם [דברים ז כו] ולא תביא תועבה אל ביתך וגו'. תועבה בשרצים [שם יד ג] לא תאכל כל תועבה. אבל אין אני יודע לאיזה מהן הוקשה.

Question: It is written 'To'evah'' about Nidah - "Ki Kol Asher Ya'aseh mi'Kol ha'To'evos ha'Eleh...'' It is written 'To'evah'' about idolatry - "v'Lo Savi So'evah El Beisecha...'' It is written 'To'evah'' about Sheratzim - "Lo Sochal Kol To'evah.'' I do not know to which (idolatry) is equated (to Nidah or Sheratzim)!

ר''ע אומר לתועבה שבנדה הוקשה. מה הנדה מטמא במשא אף עכו''ם מטמא במשא.

Answer #1 (R. Akiva): It is equated to To'evah said about Nidah. Just like a Nidah has Tum'as Masa, also an idol.

אי מה הנדה מטמא באבן מסמא אף עכו''ם מטמא ע''ג האבן מסמא.

Suggestion: Just like Nidah is Metamei through Even Misma (if she sits on a rock she is Metamei garments underneath it, even if the rock is very heavy or is supported on pegs, and she does not weigh down on the garments), idolatry should be Metamei through Even Misma!

ר' זריקן בשם רב יהודה. ואית דאמרין בשם רב חסדא מודה ר''ע לחכמים שאין עכו''ם מטמא ע''ג אבן מסמא.

Rejection (Zerikan citing Rav Yehudah, and some say in the name of Rav Chisda): R. Akiva agrees that idolatry is not Metamei through Even Misma. (For this the Hekesh to Sheratzim helps.)

ורבנן אמרי לתועבה שבשרצים הוקשה מה השרץ מטמא בהיסט אף עכו''ם מטמא בהיסט.

Answer #2: Rabanan say that idolatry is equated to Sheratzim. Just like a Sheretz has [only] Tum'as Heset, also idolatry has [only] Tum'as Heset. (In the Bavli, Tum'as Heset means through moving it. The Yerushalmi uses it to denote touching - PNEI MOSHE.)

Suggestion: Just like k'Adashah (the volume of a lentil) of a Sheretz is Metamei, k'Adashah of idolatry should be Metamei!

ר' זעירה ר''י בר נחמן בשם ר' לעזר ר' אבהו בשם ר' יוחנן [תהילים קו כח] ויצמדו לבעל פעור ויאכלו זבחי מתים. מה המת מטמא בכזית אף עכו''ם מטמא בכזית.

Rejection (R. Ze'ira citing R. Yitzchak bar Nachman citing R. Elazar, and R. Avahu citing R. Yochanan): "Va'Yitzmedu l'Va'al Pe'or va'Yochlu Zivchei Mesim'' - just like k'Zayis of a Mes is Metamei, k'Zayis of idolatry is Metamei.

Suggestion: Just like a Mes is Metamei [one who enters the same tent] from when he enters the tip of his finger, so idolatry should be Metamei from when he enters the tip of his finger!

נתיצה נתיצה מבית המנוגע מה בית המנוגע עד שיכניס ראשו ורובו אף עכו''ם עד שיכניס ראשו ורובו.

Rejection: We learn from [a Gezeirah Shavah] "Nesitzah-Nesitzah'' from Beis ha'Menuga (a house with Tzara'as). Just like Beis ha'Menuga is not Metamei until he enters Rosho v'Rubo (his head or the majority of his body), also idolatry is not Metamei until he enters Rosho v'Rubo.

א''ר חנניה זאת אומרת [דף נז עמוד ב] שאין טומאת עכו''ם מחוורת דלא כן מקישה לקלים ואינו מקישה לחמורים.

(g)

Inference (R. Chananyah): Tum'ah of idolatry is not mid'Oraisa (it is only mid'Rabanan.) If not, would we equate it to what is lenient, and not equate it to what is stringent?!

אמר רבי מנא מחוורת היא ולמה הוא מקישה למת לשרץ ללמד מהם לקלים שבה.

(h)

Rebuttal (R. Mana): It is mid'Oraisa. Why is it equated it to a Mes and a Sheretz? [You must say that] it is to learn from them leniencies in it. (If we learned stringently, we wound not need the Gezeirah Shavah "Nesitzah-Nesitzah.'')

הדא דאת אמר בעכו''ם שבורה. אבל בשלימה אפילו כל שהוא

Limitation: (We said that k'Zayis of idolatry is Metamei.) This refers to broken idolatry, but whole idolatry, even Kolshehu is Metamei.

Source (Rav Huna citing R. Chama bar Guryon citing Rav): The idolatry "Ba'al'' was [the form of] a penis, and it was the size of a pea - "va'Yasimu Lahem Ba'al Bris lei'Lohim.''

What is R. Akiva's reason [to make the primary Hekesh to Nidah]? "Sa'ev Tesa'avenu'' (abhor it as much as possible, i.e. give it the greatest Tum'ah,) like a Nidah.

(Beraisa): They said in the name of R. Elazar, we do not want to call it Amdah (which is honorable); we call it Amidah;

(R. Aba bar Kahana): There (in Bavel) they call a good act "Amdah'', and a urinal "Amidah''.

Question: What does R. Akiva learn from "Tzei Tomar Lo''?

ר' יוסי בי ר' בון רב הונה בשם רב יוסף מיכן שאין אומרים לאדם צא עד שיכניס ראשו ורובו.

Answer (R. Yosi bei R. Bun citing Rav Huna citing Rav Yosef): This teaches that we do not tell a person "leave'' until he enters Rosho v'Rubo (less than this is not Metamei him).
