CONCERN FOR CHATZITZOS IN TEVILAH (Yerushalmi Halachah 1 Daf 33a)

מתני' [דף מ עמוד ב (עוז והדר)] במה אשה יוצאה ובמה אינה יוצאה

(a)

(Mishnah) Question: With what may a woman go out, and what may she not go out with it? (Later Mishnayos will detail what is permitted.)

לא תצא אשה לא בחוטי צמר ולא בחוטי פשתן לא ברצועה שבראשה

(b)

Answer: She may not go out with threads of wool or linen or a ribbon in her head;

ולא תטבול בהן עד שתרפם

She may not immerse with them unless she loosens them.

לא בטוטפת ולא בסנבוטין בזמן שאינן תפורין

(c)

She may not go out with Totefes or Sanbutin (the various ornaments are explained later) if they are not sewn [into a headdress that covers her hair];

ולא בכבול לרה''ר ולא בעיר של זהב ולא בקטלא ולא בנזמים ולא בטבעת שאין עליה חותם ולא במחט שאינה נקובה

(d)

She may not go out with Kavul to Reshus ha'Rabim, nor with Ir Shel Zahav, nor with Katla, nose rings or rings without a stamp, or a needle without a hole;

ואם יצאה אינה חייבת חטאת:

If she went out [with any of these,] she is not Chayav Chatas.

גמ' רב נחמן בר יעקב אמר ע''י שהיא מתרתן שהן חצין בנדתה. והיא שכוחה ומהלכת בהן ארבע אמות.

(e)

(Gemara - Rav Nachman bar Yakov): [Our Mishnah discusses Tevilah, for] since she removes them, for they are a Chatzitzah for [Tevilah from] Nidah, she will forget and walk with (carry) them four Amos [before putting them on].

א''ר מנא בקדמייתא הוינן אמרין על ידי שהיא מתרת את (התפור) [צ''ל הקשור - שערי תורת ארץ ישראל] ולא הוינן אמרין כלום.

(f)

(R. Mana): Initially, we used to say that [they are forbidden] because [if she cannot remove them,] she unties the knot. We were totally wrong;

תני ר' הושעיה חותל של תמרים (קולע) [צ''ל קורע - הגר''ח קניבסקי שליט''א] ומתיר ובלבד שלא יקשור.

(R. Hoshayah - Beraisa): A wicker basket of dates - one may tear or untie the cover on Shabbos, as long as he does not tie.

תמן תנינן אילו חוצצין באדם חוטי צמר וחוטי פשתן והרצועות שבראשי הבנות.

(g)

(Mishnah): The following are a Chatzitzah in a person - threads of wool or linen, and ribbons in girls' heads;

(h)

R. Yehudah says, of wool and of hair are not a Chatzitzah, for the water goes through them.

שמואל אמר לית כאן של שיער. על דעתיה דרבי יהודה אלא של צמר הא של שיער דברי הכל אין חוצצין

(i)

(Shmuel): The text should not say "hair'' in R. Yehudah's words, only of wool. All agree that of hair is not a Chatzitzah.

רבי בא בשם רב יהודה רבי זעירא בשם רבנין [דף לג עמוד ב] היתה נימא אחת חוצצת. שתים ספק. שלש אינן חוצצות.

(j)

(R. Ba citing Rav Yehudah, and R. Ze'ira citing Rabanan): If one hair was tied [to itself], it is a Chatzitzah. Two hairs are a Safek, and three are not a Chatzitzah.

רבי זעירא בעי קשר נימא לחבירתה

(k)

Question (R. Ze'ira): If one hair was tied to another [hair(s), what is the law]?

[דף מא עמוד א (עוז והדר)] אחת היא אחת. לשתים שתים הן. לשלש שלש הן.

Answer: If it was tied to one, this is considered one; to two, this is considered two; to three, it is considered three. (We explained this like PNEI MOSHE.)

רב יהודה אמר זו שהיא ירדת לטבול לנידתה קושרה שערה כזנב הסוס (לעוברה ) [צ''ל לעובדא - אהבת ציון וירושלם, ע''פ אור זרוע] וסמיך עלי.

(m)

(Rav Yehudah): One who descends to immerse from Nidah may tie her hair (if she fears lest it float on the water) like a horse tail, in practice. She may rely on me!

2)

DIFFERENT KINDS OF FORBIDDEN ORNAMENTS (Yerushalmi Halachah 1 Daf 33b)

כהנא שאל לרב מהו מיפק באילין תיכייא.

(a)

Question (Kahana, to Rav): May one go out with chains of threads?

אמר לו כן אמרין אסור לו לאדם לצאת בהמייני.

(b)

Answer (Rav): Do we say so (that it is forbidden)?! Is it forbidden for one to go out with a belt [of a chain of loops?! This is no different.]

רב הונא הורי לאיתתיה דריש גלותא מיתן ליברה דדהבא על קפיליטה.

(c)

Rav Huna ruled for the Reish Galusa's wife that she may put a gold garment on her kerchief [and go out with it. Something that only esteemed women wear, we are not concerned lest she remove it to show it to friends.]

רבי יוחנן הורי לאילין דבית בון תמינא טלייה דמרגליתא על פרגזתא.

(d)

R. Yochanan ruled for women of Bun Temina's house to put a strip with embedded pearls on a silk garment.

א''ר אילא כל המחובר לכסות הרי הוא ככסות.

(e)

(R. Ila): Anything attached to a garment is like the garment. (We are not concerned lest she remove it to show it off.)

ותנינן יוצא הוא בזוגין שבכסותו ואינו יוצא בזוגין שבצוארו.

(f)

Support (Beraisa): One may go out with bells [woven into] his garment, but he may not go out with bells on his neck.

אית תניי תני בין אילו בין אילו מקבלין טומאה. ואית תניי תני בין אילו בין אילו אין מקבלין טומאה.

(g)

Some teach that both of them are Mekabel Tum'ah, and some teach that both of them are not Mekabel Tum'ah

מאן דמר בין אילו בין אילו מקבלין טומאה בשעשה להן אמבולי. ומאן דמר בין אילו בין אילו אין מקבלין טומאה בשלא עשה להן אמבולי.

The one who says that both of them are Mekabel Tum'ah, this is when he made a clapper. The one who says that both of them are not Mekabel Tum'ah, this is when he did not make a clapper.

ואפי' עשה להם אמבולי יהו טהורין.

(h)

Question: Even if he made a clapper, [sometimes] they should be Tehorim (for they are not for making noise)!

ולא כן א''ר אבהו שמעון בר אבא בשם רבי יוחנן בזוגין שבעריסה. תרין אמוראין

Didn't R. Avahu say in the name of Shimon bar Aba citing R. Yochanan, that bells on a crib - two Amora'im [argued about them];

חד אמר מוליך ומביא ובלבד שלא ישמיע את הקול. וחרנה אמר אם (השמיע) [צ''ל משמיע - שערי תורת ארץ ישראל] את הקול אסור ואם לאו מותר.

One said that he may carry [the crib,] as long as he does not [intend to] make noise. The other said, if he makes noise it is forbidden, and if not (it is plugged up) it is permitted. (All forbid wearing a garment on Shabbos with a bell that makes noise. If so, it is not for making noise. It should be Tahor!)

תמן אם אינן עשויין להשמיע את הקול בשבת. עשויין הן להשמיע את הקול בחול. ברם הכא אם אין עשוין להשמיע קול לא בחול ולא בשבת מפני מה עשה להן אמבולי:

(i)

Answer: There (a crib), even if it is not made to make noise on Shabbos, it is made to make noise on weekdays. However, here (a Shabbos garment), if it is not made to make noise, not on Shabbos and not on weekdays, why did he make a clapper?! (Surely he intended to make noise at some time, therefore it receives Tum'ah. We explained this mostly like PNEI MEIR.)

(j)

(Mishnah): She may not go out with Totefes.

רבי בון בר חייה קובטירה. דבר שהוא נותן במקום הטוטפת:

(k)

(R. Bun bar Chiyah): This is like a crown. It is something put in the place of Totafos (Tefilin).

ולא בסנבוטין.

(l)

(Mishnah): She may not go out with Sanbutin.

These are colored threads that rest on the Totefes.

(Mishnah): She may not go out with Kavul.

This is a wool cap worn under the hairnet.

(p)

(Beraisa - R. Shimon ben Elazar): She may [go out with Kavul].

ר' אחא בשם כהנא אתיא דרבי שמעון בן לעזר כרבי.

(q)

(R. Acha citing Kahana): R. Shimon ben Elazar holds like Rebbi;

כמה דרבי אמר דבר שהוא טמון מותר. כן רבי שמעון בן לעזר אמר דבר שהוא טמון מותר.

Just like Rebbi says that something that is Tamun (concealed under another garment) is permitted, R. Shimon ben Elazar permits something that is Tamun.
