However, [Moshe], why should he separate due to Safek (lest Hash-m speak with him)?

וי''ל דלהם נמי איכא ספיקא שמא לא תפלוט

Answer: Also [Yisrael] have a Safek. Perhaps their wives will not emit [semen];

[Moshe] made a Kal v'Chomer as follows. Yisrael, [Hash-m] fixed a time for them. If so, they did not need to separate due to [the man being a Ba'al] Keri, for one day suffices [to become Tahor from Keri]. Even so, due to concern for emission [of their wives], which is lenient (the Tum'ah did not originate in their bodies), they needed to separate;

Answer (R. Tam): If he separated due to Hash-m's command, and not on his own initiative, how did Aharon and Miryam censure him? It says "va'Tdaber Miryam v'Aharon b'Moshe"!

אלא ודאי מתחלה פירש ממנה לגמרי משה מדעתו ואע''ג דהסכים הקב''ה על ידו מ''מ נתרעמו עליו לפי שאילו לא פירש מדעתו לא היה הקב''ה מסכים דבדרך שאדם הולך בה מוליכין אותו

Rather, surely at first he totally separated from her on his own initiative, and even though Hash-m agreed with him, [Aharon and Miryam] censured him, for had he not separated from his own initiative, Hash-m would not have agreed, for in the direction that a person goes, [from Shamayim] they lead him.

[Aharon and Miryam thought so,] for Hash-m did not tell Aharon and Miryam to separate, even though he spoke also with them!

Question: The Midrash connotes that they did not know for a long time that he separated. Regarding Eldad and Meidad who were having prophecy, Miryam said "fortunate are their wives, that their husbands were appointed leaders over the Tzibur!"

Question: What is his source that at Marah they were commanded about Shabbos? Perhaps Ka'asher Tzivcha refers to the Parshah of manna. We find laws of Shabbos written there - "Es Asher Tofu Afu..."!

וי''ל משום דבכיבוד אב ואם נמי כתיב כאשר צוך ומסתמא כי היכי דהאי כאשר צוך במרה הכי נמי האי

Why is this called the first Shabbos? They were commanded in Marah, and this (collecting manna on Shabbos) was not the first Shabbos [after they were commanded], for first it says "va'Yis'u me'Eilim va'Yavo'u (El Midbar Sin)" (and there they complained about lack of food, and Hash-m promised to give manna to them), and we say below that that day was Shabbos! (Sefas Emes - the day that they left Eilim is not counted as the first Shabbos, for Hash-m commanded them to travel, and not observe Shabbos!)

ועוד מקשים דמשמע מתוך הפסוקים ששתי שבתות היו קודם ראשונה כשנסעו מאילם

Question #2: The verses connote that there were two Shabbosos before (the Shabbos that they desecrated) - the first was when they traveled from Eilim;

And after that Shabbos manna fell for them, and it says "va'Yhi ba'Yom ha'Shishi Laktu Lechem Mishneh... va'Yanichu Oso Ad ha'Boker... va'Yomer Moshe Ichluhu ha'Yom [Ki Shabbos ha'Yom]... Sheshes Yamim Tilketuhu... va'Yhi ba'Yom ha'Shevi'i Yatz'u Min ha'Am Lilkot..."

Inference: (Moshe told them on Shabbos "eat it today", and on the seventh day, people went to gather it. If it was that same day, why does it say "on the seventh day"? Rather, it was the next Shabbos.) This was the third Shabbos after Marah!

TOSFOS DH v'Amar Rav Yehudah Ka'asher Tzivcha b'Marah

Explanation: This verse (Ka'asher Tzivcha) is in Sefer Devarim (in Aseres ha'Dibros). We cannot say that it means "like I commanded you at Matan Torah (the first time Hash-m said Aseres ha'Dibros)", for Moshe was telling [Bnei Yisrael about what happened in the Midbar] only in order, and in all (of Aseres ha'Dibros) it is not written Ka'asher Tzivcha [except for Shabbos and Kivud Av v'Em].

TOSFOS DH a'Techumin Lo Ifkod

Rejection: It connotes that according to everyone, at least at Sinai they were commanded about Techumim. "Techumim" is not precise. Rather, it refers to Hotza'ah. [In the Midbar] they took with them everything that they had;

One opinion holds that they were commanded about Hotza'ah, and one opinion holds that they were not commanded about Hotza'ah.

Implied question: In Parshas Man it is written "Al Yetzei Ish mi'Mekomo", and we expound from this Hotza'ah in Eruvin (17b)!

And according to the opinion that they were commanded (in Marah), even though [Al Yetzei] was said in Marah, it was written there (in Parshas Man), like I explained.

TOSFOS DH v'Oso Yom Chamishi b'Shabbos Hayah v'Chulei

ואם כן ברביעי שחטו פסחיהם ונמצא בשבת שעברה לקחו פסחיהן שאז היה בעשור לחדש

Explanation: If so, Shechitas Korban Pesach was on Wednesday. It turns out that on the previous Shabbos, they took (bought or designated) their animals for Pesach, for this was the 10th of the month;

ועל כן קורין אותו שבת הגדול לפי שנעשה בו נס גדול כדאמרינן במדרש (שמות רבה פ' בא)

This is why it is called Shabbos ha'Gadol, for a great miracle occurred, like it says in the Midrash;

כשלקחו פסחיהם באותה שבת נתקבצו בכורות אומות העולם אצל ישראל ושאלום למה היו עושין כך אמרו להן זבח פסח לה' שיהרוג בכורי מצרים

When they took their Pesachim, Bechoros of the nations gathered to Yisrael and asked what they were doing. They said "it is Zevach Pesach to Hash-m. He will kill the Bechoros of Mitzrayim";

הלכו אצל אבותיהם ואל פרעה לבקש ממנו שישלחו ישראל ולא רצו ועשו בכורות מלחמה והרגו מהן הרבה הה''ד למכה מצרים בבכוריהם

[The Bechoros] went to their fathers and to Paro, to ask him to send Yisrael, and they did not want to. The Bechoros made a war, and killed many [Mitzriyim]. The verse "l'Makeh Mitzrayim bi'Vchoreihem" (He strikes Mitzrayim through their firstborn) alludes to this.

This verse was written after manna already fell for a week, when the Nesi'im told Moshe that they collected double, for it says "va'Yomer Moshe Ichluhu ha'Yom... Sheshes Yamim Tilketuhu", and the manna already fell from the previous Sunday!

Answer (Ri): Even though it was not said until afterwards, in any case it is properly proven that Moshe forgot to tell them, and he said "I should have told you what Hash-m said when he gave the manna, that you will gather it six days." If so, [the first day that it fell, i.e. the day after He promised,] was Sunday.

Answer #1: It is because we say in the Midrash (Bamidbar Rabah 12:9) that all seven days of the Milu'im (inauguration of the Mishkan, which began seven days before Rosh Chodesh Nisan) Moshe erected the Mishkan and dissembled it.

Answer #2: It is because the Midrash refers to erection of the Mishkan. It means that that day of erection of the Mishkan, it received 10 other crowns.

Implied question (R. Yitzchak): There was no need to say eight deficient months. Rather, there were seven deficient months, and Iyar of that year was full, like it says above! (Maharsha - Rabanan hold that Rosh Chodesh Sivan was on Monday. If Nisan was full and Iyar was Chaser, like they normally are, the previous Rosh Chodesh Nisan was on Friday. There must be eight Chaser months from Nisan to Nisan, in order that the next year, it will be on Sunday. However, we said above that Rabanan agree that Rosh Chodesh Nisan was on Thursday, but Iyar was full. If so, Rabanan agree with R. Yosi that there were seven Chaser months, so that the next year it was on Sunday!)
