SUMMARY

1. Rebbi Yehudah ben Bava says that the walls of a yard make it a Reshus ha'Yachid only if the owner dwells there in some way.

2. Rebbi Yehudah argues that even having a reservoir in the yard (#1) makes it a Reshus ha'Yachid.

3. Rebbi Akiva says that even if there is nothing in the yard (#1) for the purpose of residential dwelling, it is a Reshus ha'Yachid.

4. Rebbi Eliezer: If the yard (#1) has no usage for residential dwelling, one may carry in it only if it is a square.

5. Rebbi Ilai said that he heard from Rebbi Eliezer that the only requirement is that the yard (#1) must be square.

A BIT MORE

1. For example, if the owner has a home in the yard, even if he does not usually live there, the yard is considered a Reshus ha'Yachid.

2. Rebbi Yehudah requires less actual dwelling to make the yard a Reshus ha'Yachid. Accordingly, even a function that is useful for dwelling makes the yard a Reshus ha'Yachid.

3. It has the status of a Reshus ha'Yachid as long as it is smaller than an area slightly more than 70 by 70 and a fraction Amos. The position of the Tana Kama (18a) is very similar.

4. Rebbi Eliezer: The maximum amount of area to which this applies is only slightly more than 70 by 70 Amos, and the shape of the area may only be a square up to 70 by 70 Amos. Rebbi Yosi: The shape of the area is irrelevant.

5. Rebbi Ilai said that Rebbi Eliezer did not say that the area must be 70 by 70 Amos. Rather, even if it is much larger than that it is permitted, as long as it is square.
