SHEVUOS 35 (15 Teves) - dedicated by Dr. Moshe and Rivka Snow in memory of Rivka's mother, Rebbetzin Leah bas Rav Yosef (Rabinowitz), the Manostrishtcher Rebbetzin, whose Yahrzeit is 15 Teves.

SUMMARY

1. Two witnesses swear falsely that they are not aware of testimony about a person who promised to give his friend money. They are exempt from a Korban.
 
2. If two people swear that they will testify when they become aware of testimony, they are exempt from a Korban.
 
3. A person is in a synagogue and says in front of a group of people, which includes the two witnesses, "I put you under oath that if you are aware of testimony, you shall testify." The witnesses are exempt from a Korban.
 
4. The claimant was among a group of people and was standing next to two witnesses and said, "I put under oath all of you who are standing here, that if you are aware of testimony, you shall testify." The witnesses are Chayav a Korban.
 
5. If a servant of the claimant or defendant put under oath two witnesses that if they know testimony for the claimant they shall testify, they are exempt from a Korban.
 
6. If a claimant puts witnesses under oath and says, "I am Metzaveh/Oser/Koval on you with a Shevu'ah," they are Chayav a Korban.
 
7. If a claimant puts witnesses under oath and says, "I am putting you under oath with one of the Kinuyim (such as Kel or Shakai)," they are Chayav a Korban.
 
8. If the first two letters of "Elokim" or of "Yud-Kay-Vav-Kay" have been written, they may not be erased, but the first two letters of "Shakai" or "Tzevakos" may be erased.
 
9. The prefix of the name of Hashem may be erased. There is a disagreement about whether the suffix of the name of Hashem may be erased.
 
10. There is a disagreement about whether hosting guests is more important than receiving the Shechinah.

A BIT MORE

1. The person could change his mind and decide not to give the money, in which case the testimony would have no monetary significance. The Chiyuv Korban for Shevu'as ha'Edus exists only when the witnesses' failure to testify cost a person money.
 
2. Even if he fails to testify when he becomes aware of the testimony, he is exempt from a Korban because the Shevu'ah preceded the testimony.
 
3. Even if the claimant was standing next to the two witnesses and they responded "Amen" to the Shevu'ah, they are exempt from a Korban since he did not identify them.
 
4. When he said, "All of you who are standing here," he identified the witnesses among the group of people. Therefore, if they responded "Amen" to the Shevu'ah and failed to testify, they are Chayav a Korban.
 
5. Since the claimant himself was not the one to put them under oath, they are exempt from a Korban.
 
6. If he says to them, "I am putting you under oath by the heaven and the earth," they are exempt from a Korban.
 
7. Even if he uses the Kinuy of "Chanun" or "Rachum", they are Chayav because his intent is to make them swear by Hashem, Who is Chanun and Rachum.
 
8. The first two letters of "Elokim" and of "Yud-Kay-Vav-Kay" are also names of Hashem in their own right, and thus they may not be erased. The first two letters of "Shakai" and "Tzevakos" are not names of Hashem and may be erased. Rebbi Yosi maintains that even the entire name of "Tzevakos" may be erased because it is a reference to Klal Yisrael, not to Hashem.
 
9. The Tana Kama maintains that the suffix of the name of Hashem may be erased. Acherim maintain that it may not be erased because the name of Hashem which precedes it gives it sanctity.
 
10. Chanina, the nephew of Rebbi Yehoshua, and Rebbi Elazar ben Azaryah in the name of Rebbi Elazar ha'Moda'i maintain that hosting guests is more important. When Hashem appeared to Avraham on the third day of the Milah, Avraham asked Hashem to wait while he welcomed guests.
