SHEVU'OS 9 - Dedicated for a Refu'ah Sheleimah for Eliezer Lipa ben Yetta, by his brother and sister in law.

SUMMARY

1. There is a disagreement whether someone who was unaware that he was Tamei and he ate Kodesh or entered the Mikdash, is Chayav to bring a Korban Oleh v'Yored.

2. Rebbi Yishmael and Rebbi Meir maintain that the goats of the Musafim which are brought on Yom Kipur, Yom Tov, and Rosh Chodesh all atone for the transgression of eating Kodesh and entering the Mikdash.

3. Rebbi Yehudah maintains the goats of the Musafim of both Rosh Chodesh and Yom Tov atone for a person who was completely unaware that he ate Kodesh or who entered the Mikdash in a state of Tum'ah.

4. Reish Lakish maintains that Hashem says the goat of the Musaf of Rosh Chodesh "shall be an atonement for Me, because I diminished the size of the moon."

5. Even if it will eventually become known that a person ate Kodesh or entered the Mikdash in a state of Tum'ah the goats of the Musafim and the Yom Tov atone according to Rebbi Yehudah.

6. The Tzitz atones for a Korban if the flesh of the Korban was brought while it was Tamei.

7. Rebbi Shimon maintains the goat of the Musafim of Rosh Chodesh atones for a Tahor who ate Kodesh which was Tamei.

A BIT MORE

1. The Tana of the Mishnah learns that the obligation to bring a Korban Oleh v'Yored applies only when the person was aware that he was Tamei and subsequently forgot and ate Kodesh, or entered the Mikdash. Rebbi Yishmael says that even if the person was unaware that he was Tamei prior to the transgression, he is obligated to bring a Korban when he becomes aware of his transgression.

2. The Korbanos all atone for eating Kodesh and entering the Mikdash in a state of Tum'ah when the person was aware that he was Tamei after the transgression but not prior to the transgression, or he was not aware at all that he was Tamei. They also atone for a Tahor who eats Kodesh that is Tamei.

3. However, Rebbi Shimon maintains that only the goat of the Musaf of Yom Tov atones for one who was completely unaware that he was Tamei, but not the goat of Rosh Chodesh.

4. The Korban is brought as an appeasement to the moon for having been diminished during the six days of creation.

5. Even if the person was seen entering the Mikdash or eating Kodesh in a state of Tum'ah and will soon be notified, since he has not yet been notified the goats of Rosh Chodseh and Yom Tov atone for his sin. The goats of Rosh Chodesh and Yom Tov atone for the sin of a person who was seen entering the Mikdash or eating Kodesh in a state of Tum'ah, but he has not yet been notified.

6. If the flesh, fats or blood of a Korban was brought on the Mizbe'ach while they were Tamei, the Tzitz atones for the Korban. The owner of the Korban fulfills his obligation with the Korban and he does not need to bring another Korban.

7. Rebbi Shimon deduces the atonement of the goat of Rosh Chodesh from the atonement of the Tzitz. Just as the Tzitz atones for flesh that is Tamei, the goat of Rosh Chodesh atones for a Tahor who ate flesh which was Tamei.
