Question

SUMMARY

Both the Yavam and the Yevamah must have Kavanah for the Chalitzah.

If the Yavam is tricked into the Chalitzah with an offer of compensation, it is a valid Chalitzah even if the money is not given.

If the Yavam was tricked and thought the Chalitzah was an act of marriage, it is not a valid Chalitzah, but she is Pesulah to the brothers.

If a person escaped from jail, reached a river, and promised the ferry-driver a Dinar for his services, he must pay only the going rate. (1)

If the Yavam is tricked into giving a Get, the Get is Pasul if the condition is not fulfilled.

If Beis Din forces a man to give a Get or to do Chalitzah and he says that he wants to do it, it is valid.

If Beis Din forces a person to bring a Korban that he is obligated to bring and he says that he wants to do it, it is a valid Korban.

The Tana'im disagree about whether the Beis Din may perform Chalitzah or Mi'un if they do not recognize the Yevamah or the Mema'enes. (2)

The Parshah of the Chalitzah is read in Lashon ha'Kodesh.

The judges say the words "Beis Chalutz ha'Na'al," but not the students. Rebbi Yehudah says that everyone standing there says it.

If the Rekikah and Chalitzah were done in the wrong order, the Chalitzah is valid.

When Mar Zutra wrote a Shtar Chalitzah, he made lines in the parchment and he wrote out the entire Parshah of Chalitzah.

If the wind blows the spit of the Yevamah away from the face of the Yavam, the Chalitzah is not valid. (3)

A BIT MORE

1. He can claim that he was only joking when he mentioned the exaggerated rate.

2. Rav Sechorah: The Beis Din may perform the Chalitzah or Mi'un without recognizing the parties. Therefore, they may not write the Shtar Chalitzah or Mi'un without recognizing the parties because of the concern that the parties might bring the Shtar to another Beis Din who will rely on the Shtar without ascertaining that the holder of the Shtar is in fact the Yevamah or the Mema'enes. Rava: The Beis Din may not perform the Chalitzah or Mi'un without recognizing the parties. Therefore, the witnesses may write the Shtar Chalitzah or Mi'un without recognizing the parties, and we are not concerned that the Beis Din made a mistake and went ahead with the Chalitzah or Yibum even though they did not recognize the parties.

3. If the Yevamah is short and the Yavam is tall, it is a valid Rekikah even if the wind carries it, since it is in front of the face of the Yavam as soon as it leaves the mouth of the Yevamah.

BRIEF INSIGHT

PAYMENT TO A DOCTOR

The Gemara says that if a person escaped from jail, reached a river, and promised the ferry-driver a Dinar for his services, he must pay only the going rate, because he can say he was joking. The Ramban says that we learn from this Din that when somebody is ill and his friend has a medicine that can cure him, and the sick man promises his friend a huge sum for the medicine, he must pay only the true value of the medicine. However, if his friend is a doctor and he used his skills to cure the patient, the patient must pay the full amount, because the doctor is selling him his skills which are worth a lot of money.

QUICK HALACHAH

THE MI'UN OF A KETANAH

The Beis Din of the Mi'un must recognize the Ketanah and her husband. Therefore, any witnesses of the Mi'un may write her a Get Mi'un, even though they do not recognize her, because certainly the Beis Din recognizes her. B'Di'eved, if the Beis Din recognizes only the woman and not the husband, it is sufficient. The Beis Din must also know for a fact that she is still a Ketanah. (Shulchan Aruch EH 155:8-9)
