LEAVING SLAVERY IN THE SEVENTH YEAR (Yerushalmi Halachah 2 Daf 6a)

כתיב (שמות כא) שש שנים יעבד יכול יוצא בסוף שש תלמוד לומר ובשביעית יצא יכול יצא בסוף שבע ת''ל שש שנים יעבד הא כיצד עובד כל שש ויוצא בתחילת שבע

(a)

The pasuk states (Shemos 21, 2), "...six years he shall work''. I might think that he leaves at the end of the sixth year, so the pasuk teaches "and in the seventh he shall go free''; I might think that he leaves at the end of the seventh, so the pasuk teaches "six years he shall work''. How is this? He works for the entire six years and leaves at the beginning of the seventh.

ובשביעית יצא בשביעית של מכירה לא שביעית של עולם

"...and in the seventh he shall leave'' - this refers to the seventh year since his sale, not the seventh (Shemita) year of the world.

את אומר שביעית של מכירה או אינה אלא שביעית של עולם

Question: How do you know this?

כשהוא אומר שש שנים יעבד הרי שש שנים אמורות הא מה אני מקיים ובשביעית יצא שביעית של מכירה לא שביעית של עולם

Answer: If the pasuk says "for six years he shall work'' i.e. six full years, why must it then say "and in the seventh he shall leave''? To teach that he leaves in the seventh year of his sale rather than the seventh year of the world.

Question: Perhaps one could conclude the opposite, that it says "and in the seventh etc.'' to teach that even if he was sold at the beginning the sixth year (of the Shemita cycle), he leaves at the beginning of the seventh year...?

אמר ר' זעירא בשם רב הונא ובשביעית כתיב

Answer (R. Zeira citing Rav Huna): The pasuk says, "and in the seventh'' - to continue the previous case, that sometimes he does continue to work during the Shemita year, for example, if he was sold at the beginning of the sixth year.

אמר רבי חונה [דף ו עמוד ב (עוז והדר)] אם אימר את שביעית של עולם אם כן מה היובל בא ומוציא

Question (R. Chuna): If the pasuk means that he goes free in the seventh year of the world, what would the additional freedom of Yovel achieve?!

אמר רבי יוחנן בר מרייה [דף ו עמוד ב] אתייא כמאן דאמר אין היובל עולה ממיניין שני שבוע ברם כמאן דאמר היובל עולה ממיניין שני שבוע פעמים שהוא בא באמצע שני שבוע

R. Yochanan bar Maraya: It must follow the opinion that the Yovel year does not count in the seven year cycle. However, according to the opinion that Yovel does count (which also means that the 50 years of Yovel are only counted from the year after Yovel, it could be that Yovel and) freedom of the slave might occur in the middle of the seven year cycle.

Rabbanan of Kisarin: Even according to the opinion that Yovel does not count in the seven year cycle, we can answer that the seventh year releases the regular Jewish slaves and Yovel releases the nirtza slaves (see earlier 14-4)(d)).
