TOSFOS DH HA LAN HA L'HU

(Summary: Tosfos proves his explanation of 'Ha Lan Ha L'hu' and elaborates.)

(a)

Support: And so we find in the first Perek in Shabbos, (Daf 9b) where, in connection with 'When is considered the beginning of a meal?', Rav says 'When one washes one's hands', and Rebbi Chanina, 'when one loosens one's belt'.

1.

Support (cont.): ... and the Gemara explains there 'Ha Lan, Ha L'hu' - and although Rebbi Chanina was from Eretz Yisrael, he was definitely speaking to Talmidim from Bavel ...

2.

Support (concl.): ... as the Gemara says there 'Once our Babylonian colleages loosen their belts, we do not trouble them (to Daven Ma'ariv)' - implying that the B'nei Bavel used to loosen their belts.

(b)

Introduction to Question: There is a Kashya however, from the Gemara in Keitzad Mevorchin (B'rachos, Daf 44a) where Rav Chisda says 'al ha'Aretz ve'al ha'Peirosehah', and Rebbi Yochanan, 'al ha'Aretz ve'al ha'Peiros' ...

1.

Introduction to Question (cont.): ... and where, in answer to the Kashya on Rav Chisda 'They (the B'nei Eretz Yisrael) eat and we recite the B'rachah?' the Gemara answers 'Reverse the opinions'.

2.

Question: What is the Kashya? Perhaps, although Rav Chisda was from Bavel, he was speaking to Talmidim from Eretz Yisrael, and Rebbi Yochanan, to the B'nei Bavel, like in all the other places?

(c)

Answer: The Gemara knew that on that occasion, Rav Chisda had no Talmidim from Eretz Yisrael learning by him.

(d)

Refutation of Question: It seems to ha'Rav Yitzchak however, that the Kashya from Keitzad Mevorchin is not difficult ...

1.

Refutation of Question (cont.): ... because when it comes to eating and B'rachos, the Din requires everybody to recite the B'rachos according to the local Minhag, even if he is not a resident of that place ...

2.

Refutation of Question (concl.): And that explains why the Gemara asks why Rav Chisda, who was from Bavel, recited 'al Peirosehah", which apparently, refers to the fruit of Eretz Yisrael?

2)

TOSFOS DH YESER ALAV TEHILIM SHEMONAH ETC. (This Dibur belongs further on after DH 'Nikre'u')

(Summary: Tosfos queries the statement.)

(a)

Question: It is clear that the Chumash has more Pesukim, because, even if every Pasuk in Tehilim comprised three words, there would not be as many Pesukim as in the Chumash? (Tosfos Yeshanim)].

3)

TOSFOS DH LO TZ'RICHA L'YOMI

(Summary: Tosfos disagrees with Rashi's explanation:

(a)

Explanation #1: Rashi explains that 'This refers to the days of the week - two days Mikra, two days Mishnah and two days Gemara'.

?' The

(b)

Refutation: This is not correct however, because in that case, the Gemara could still ask 'Who knows how long he will live?'?

(c)

Explanation #2: The explanation must therefore be that one must divide each day into three.

1.

Minhag #1: Therefore Rav Amram Ga'on instituted the current Minhag that, every day, before Pesukei de'Zimrah, one recites some Mikra, some Mishnah and some Gemara.

2.

Minhag #2: Rabeinu Tam however, maintains that we rely on the Gemara in Sanhedrin (Daf 24a) that 'Bavel is a mixture of Mikra, Mishnah and Gemara, since the Talmud Bavli is a mixture of all of them.

4)

TOSFOS DH NIKR'U SOFRIM

(Summary: Tosfos cites two explanations.)

(a)

Explanation #1: Rashi explains by quoting the Pasuk in Divrei ha'Yamim 1, chapter 2) "And the families of Sofrim who dwelt in Ya'abetz".

(b)

Explanation #2: However, the Yerushalmi in Shekalim (Perek 5 explains that they tended to turn the entire Torah into numbers ...

1.

Examples: Such as 'The Avos Melachos number thirty-nine (Shabbos, Daf 73a) and 'Four Avos Nezikin' (Bava Kama, Daf 2a), and other similar cases.

5)

TOSFOS DH AL TEGAMGEM V'TOMAR LO

(Summary: Tosfos reconciles this with the Sugya in Eilu Metzi'os.)

(a)

Question: When the Gemara in Bava Metzi'a (Daf 23b) states that 'A Talmid-Chacham may deviate from the truth regarding Masechta' ...

(b)

Answer: ... Rabeinu Tam explains this to mean that if one is asked whether one has learned a specific Masechta, he should not answer proudly that he has, as if to show how much he has learned ...

1.

Answer (cont.): But if he is asked a D'var Halachah or someone needs him to teach them a Gemara, his answer should be on the tip of his tongue, without stammering.

(c)

Implied Question: Nor can this be compared to the statement of Mar (in Maseches Derech Eretz Zuta, 3) of getting into the habit of saying 'I don't know'', to avoid getting caught out and proven to be a liar' ...

(d)

Answer: Since that is referring to secular knowledge.

(e)

Conclusion: Though even when it comes to Divrei Torah, one should not boast that one knows something, only what one knows, one should instruct and teach to one's Talmidim.

TOSFOS DH IM BARZEL HU MISPOTZETZ

(Summary: Tosfos clarifies this statement and a similar statement in Sanhedrin.)

(a)

Question #1: The Pasuk implies that it is the hammer that fragments the rock and breaks it?

(b)

Question #2: And similarly, in Perek Dinei Mamonos (Sanhedrin, Daf 34a) when the Gemara states that 'Just as a hammer divides into many sparks, so too, do words of Torah divide into many concepts?

(c)

Answer to Question #2: The Rashbam however, has the text 'Mechalek' (divides others) and not 'Mischalek' (is divided).

(d)

Answer #1 to Question #1: Some commentaries have the text here 'If it is iron, it melts, and if it is a rock, it fragments, as the Pasuk says "Are My words not like fire, and like a hammer that fragments the rock" - in that the fire melts metal and the hammer breaks up the rock.

(e)

Answer #2 to Question #1: But Rabeinu Tam explains that it is the rock that fragments the iron, and what the Pasuk means is that 'the hammer is fragmented by the force of the rock' ...

(f)

Proof: Like the story cited by Medrash (Rabah in Eichah) - of someone who took a saphirre to examine it; He placed it on an anvil and struck it with a mallet; The mallet broke and the anvil shattered - but the sapphire remained intact' (See Masores ha'Shas).

7)

TOSFOS DH SHE'YESH R'SHUS ACHERIM ALEHAH

(Summary: Tosfos clarifies the statement.)

(a)

Implied Question: Even though the fact that the work of her hands goes to her husband is only mi'de'Rabbanan (Kesuvos, 58b) ...

(b)

Answer: ... the fact remains that she is not under her father's jurisdiction, but under that of her husband.
