THE HETER TO WRITE TOFSIM (Yerushalmi Perek 3 Halachah 2 Daf 15b)

מתני' הכותב תופסי גיטין צריך שיניח מקום האיש ומקום האשה ומקום הזמן

(a)

(Mishnah): One who writes Tofsim of Gitin (the part that is the same for anyone) must leave blank the names of the husband and wife, and the date (until the husband tells him to write);

שטרי מלוה צריך שיניח מקום המלוה ומקום הלוה ומקום המעות ומקום הזמן

(b)

One who writes Tofsim of loan documents must leave blank the names of the lender and borrower, the amount of the loan, and the date;

שטרי מקח וממכר צריך שיניח מקום הלוקח ומקום המוכר ומקום המעות ומקום השדה ומקום הזמן מפני התקנה

(c)

One who writes Tofsim of sale documents must leave blank the names of the buyer and seller, the price, the field and the date, due to an enactment.

רבי יהודה פוסל בכולן

(d)

R. Yehudah says, all of these are Pasul;

רבי אלעזר מכשיר בכולן חוץ מגיטי נשים שנאמר וכתב לה לשמה:

R. Elazar says, all are valid, except for Gitin, for it says "he will write for her" - Lishmah.

גמ' ר' יוחנן אמר כתב תרפו בטופס כשר.

(Gemara - R. Yochanan): If one wrote the Toref (i.e. 'you are permitted to every man') in the Tofes, it is Kosher.

ר"ל אמר כתב תרפו בטופס פסול.

(Reish Lakish): If he wrote the Toref in the Tofes, it is Pasul.

מתניתא פליגא על (רבי יוחנן) [צ"ל ר"ל - קרבן העדה] הכותב טופסי גיטין צריך שיניח מקום האיש ומקום האשה והזמן.

Question: Our Mishnah argues with Reish Lakish! One who writes Tofsim of Gitin must leave blank [only] the names of the husband and wife, and the date! (He may write the Toref.)

Answer: [He must leave blank] the Toref with [the names and date].

וקשיא על דר' יוחנן אם בשכתב תרפו בטופס בדא חכמים מכשירין.

Question (against R. Yochanan): If he wrote the Toref in the Tofes, would Chachamim be Machshir?!

רבי ירמיה בשם ר' זעירה מפסולו את למד הכשירו אילו כתב כולו לשמה ושם האיש ושם האשה שלא לשמה שמא אינו פסול. ודכוותה כתב כולו שלא לשמה ושם האיש ושם האשה לשמה כשר.

Answer (R. Yirmeyah citing R. Ze'irah): From the Pesul you learn the Hechsher. If he wrote it totally Lishmah, and the husband's name and the wife's name Lo Lishmah, it is not Pasul?! Similarly, if he wrote it totally Lo Lishmah, and the husband's name and the wife's name Lishmah, it is Kosher.

ר' יוסי שאל לרבי ירמיה הגע עצמך שזיווג.

Question (R. Yosi, to R. Yirmeyah): Exert yourself [and you will find the answer]! If Ziveg (the scribe wrote names in the Get, and at the same time, a man of this name said that he wants that scribe to a Get for his wife with that name, what is the law? - MEICHAL HA'MAYIM)

אמר ליה כן. אמר (ליה רבי זעירא רבו) [צ"ל לי רבי זעירא רבי - ספר משביח] מכיון שאינו מצוי לזיוג אפי' זיווג כמי שלא זיווג.

Answer (R. Yirmeyah): So told me R. Ze'ira, my Rebbi - since Zivug is not common, even if he was Zivug, it is as if he was not Ziveg. (NO'AM YERUSHALMI - the Yerushalmi holds that all require the Get to be Lishmah. R. Yochanan holds that a Stam Get is Lishmah, i.e. l'Shem divorce, so the husband need not command about the Toref. However, Zivug is not common. Therefore, it is considered that the names were written Lo Lishmah.)

וקשיא על ריש לקיש אם בשלא כתב בטופס תורפו בדא רבי יודה פוסל.

Question (against Reish Lakish): If he did not write the Toref in the Tofes, would R. Yehudah disqualify in this case?!

ר' יוסי ברבי זעירא לעניין אחר עבד לה ר' יודה.

Answer (R. Yosi b'Ribi Ze'ira): R. Yehudah considers [the blank parchment in which the Toref and/or names will be written] like another matter;

ותייא כיי דמר שמעון בר בא בשם רבי יוחנן חלק מקום שני שיטין לעניין אחר אפילו כל שהוא פסול.

This is like Shimon bar Ba said, citing R. Yochanan - if [when witnesses signed, there was] blank space enough for two lines, [in which one could write] another matter, [even if he later filled the space] with any matter, it is Pasul. (We explained this like MEICHAL HA'MAYIM.)

מהו מפני התקנה.

Question: (Our Mishnah said what one who writes Tofsim must leave blank... due to the enactment.) What is 'due to the enactment'?

רבי שבתי בשם חזקיה מפני תקנת בנות ישראל שלא יהו מצויות להתגרש.

Answer #1 (R. Shabsi citing Chizkiyah): It is to help Benos Yisrael, so they will not be prone to be divorced. (If Gitin are not fully ready, perhaps one who decides to divorce will retract before the Get is finished.)

רבי שמואל בר רב יצחק שאל לרבי חייא בר בא כשר ואת אמר אכין. אין תימר פסול ויאות.

(r)

Objection (R. Shmuel bar Rav Yitzchak, to R. Chiya bar Ba): Our Mishnah says that [Tofesim are] Kosher, and you say so?! If you would say that they are Pasul, properly [you could say that it is to impede divorce]!

מאי כדון.

Question: [If so,] what is 'due to the enactment'?

אמר ר' אבון מפני תקנת הליבלר כדי שיהו חייו מצויין לו.

Answer #2 (R. Avin): It is to help scribes, so his income will be available (he can begin writing Gitin before there is any command).

רבי זעירא רב הונא בשם רב הלכה כרבי יודה בגיטין וכרבי אליעזר בשטרות.

(R. Ze'ira citing Rav Huna citing Rav): The Halachah follows R. Yehudah in Gitin, and R. Elazar in documents.

נאמר הלכה כרבי אליעזר

Question: He should say [just] 'the Halachah follows R. Eliezer' (for R. Eliezer is Machshir only documents, but agrees with R. Yehudah that Gitin are Pasul)!

רבי בא בשם רב הלכה כרבי ליעזר בגיטין וכרבי יהודה בשטרות.

(w)

(R. Ba citing Rav): The Halachah follows R. Eliezer in Gitin, and R. Yehudah in documents.

נאמר הלכה כרבי יהודה.

Question: He should say [just] 'the Halachah follows R. Yehudah (for R. Yehudah disqualifies both documents and Gitin)!

אלא בגין דרב ושמואל תרווייהו אמרין הלכה כר' לעזר [צ"ל בגיטין - קרבן העדה] ולא תיסבר מימר אף הכא כן צריך מימר הלכה כרבי יהודה בגיטין וכרבי אלעזר בשטרות:

Answer: [Really, it is like R. Zeira said. He could not say just 'the Halachah follows R. Eliezer', or 'the Halachah follows R. Eliezer in Gitin and documents', for one could err to think that he rules about Edei Mesirah,] because Rav and Shmuel both said 'the Halachah follows R. Eliezer [who says that Edei Mesirah empower a document] in Gitin.' (He mentioned R. Yehudah to show that he rules about Tofsim - SEFER NIR.)
