1. Benzi asks:

The gemara says that according to reish lakish we know the warning for a tamei person who eats kodesh from a hekesh of kodesh lemikdosh, as Rashi says DH Mi'd'Iskish that Mah Mikdash Yesh b'Azharaso Netilas Neshamah Af Azharas Kodesh Yesh b'Azharaso Netilas Neshamah (which is referring to Achilah)

So the question is, that we already know from beforehand in the gemara that according to reish lakish the PUNISHMENT of a person who eats kodesh whilst tamei is from the passuk of v'ha'Nefesh Asher Tochal Basar where it says in that passuk that the punishment for eating kodesh whilst tamei is kares.

So my question is that instead of learning out the punishment of a person who eats kodesh whilst tamei from v'ha'Nefesh Asher Tochal ... let's just learn it all out from the hekesh where we see from this heksh that there is a chiyuv Kares?

2. The Kollel replies:

I think that what we can answer this question with the help of what the Rambam writes in his commentary on the Mishnah, quite near the beginning of this chapter in Makos.

He writes that the Torah does not give a punishment of misah or kores unless there is a simple Lav in that inyan, as Chachomim said (see Yoma 81a) "the Torah does not punish unless it warned first".

It seems that first of all the Torah has to give a warning and only afterwards does it state a punishment. Therefore if we would have learnt out the punishment for eating kodesh from the hekesh, we would not have had anywhere to learn out the warning from, and we always have to have the Azharah first.

I don't really understand Ur first answer, because we ARE learning the warning from the hekesh thats what the gemara is trying to bring from the hekesh so if so my question still remains that lets learn both the warning and the punishment from this hekesh?

4. The Kollel replies:

We find many times that the Gemara says "we have heard about the punishment but where does one learn the warning from?" This suggests that we do not learn the Onesh and the Azharah from the same verse. However we do find above 14a, last line on page, âîø òåðù îàæäøä. But look at Tosfos 14a DH veIdach who seems to say that it is only Rabbi Yitzchak who learns the punishment from the warning. I suggest that according to most opinions one needs separate verses to teach the Onesh and the Azharah.
