 DAF DISCUSSIONS - GITIN 11
1. Joseph Kayeri asks:

When did R. Yochanan permit names of Nochrim in a Get that comes from Eretz Yisrael and a Get that comes from Medinas ha'Yam, and why?

If it comes from medinat hayam then he permits if the names are not muvhakim, because the majority of yehudim are named by their names. But in EretzIsrael he pertmis only lokus velus, because we dont have this rov. All these if it has edei mesirah;.

The mishnah; and beraita in daf 10b are all dealing with cases in which we know with certainty that the get was signed by goym, and because of taht we have the machloket between R Shimon and Chachamim if we can valid a Get with shem muvhak or not, gezeira shem muvhak atu shem lo muvhak, veatu lemismach alayhu.

Is that correct?

2. The Kollel replies:

Shalom Joseph,

Yes -- when the Get is from Eretz Yisrael, then Rebbi Yochanan permits only Sheimos Muvhakin, because Davka then will people not rely on the signatures. But when the Get is from Chutz la'Aretz, where Jews commonly have gentile names, then Rebbi Yochanan is Machshir no matter what the names are, even without Eidei Mesirah, because we assume it was Jews who signed.

May you continue to attain greatness in Torah and Yir'as Shamayim!

Warmly,

Yishai Rasowsky
