BACKING OUT MAKES A DISADVANTAGE (Yerushalmi Halachah 2 Daf 25b)

משנה השוכר את האומנין וחזרו בהן ידן לתחתונה

(a)

(Mishnah): One who hired contractors and they backed out, they have the disadvantage.

אם בעל הבית חזר בו ידו לתחתונה

(b)

If the employer backed out, he has the disadvantage.

כל המשנה ידו לתחתונה וכל החוזר בו ידו לתחתונה:

(c)

Whoever changes (from the agreement) and whoever backs out has the disadvantage.

גמרא רב אמר כי לי בני ישראל עבדי' אין ישראל קונין זה את זה

(d)

(Gemara) - Rav: The pasuk states (Vayikra 25, 55), "The children of Israel are my slaves'', but they cannot acquire each other (and they can therefore back out of a deal).

[דף כו עמוד א] א''ר יוחנן עבד עברי היא מתני'.

R. Yochanan: We learn that one may back out from the case of a Jewish slave who can force his master to accept payment to set him free.

על דעתיה דרב בין פועל בין בעל הבית יכול לחזור בו

According to Rav, both a worker and an employer can back out.

על דעתיה דרבי יוחנן פועל יכול לחזור בו ולא בעל הבית:

According to R. Yochanan, only a worker can back out but not an employer.
