TOSFOS DH ASHER YATZAR ES HA'ADAM B'CHOCHMAH

תוספות ד"ה אשר יצר את האדם בחכמה

(SUMMARY: Tosfos elaborates on the word 'be'Chochmah'.)

בתנחומא ' "ויברא אלהים את האדם": א"ר בון, 'בחכמה' - שהתקין מזונותיו ואח"כ בראו'.

Explanation: The Medrash Tanchuma, commenting on the Pasuk in Bereishis "And G-d created man", cites Rebbi Bun, who states 'with wisdom' - in that He first prepared his sustenance before creating him.

והיינו דאמר בסנהדרין בס"פ אחד דיני ממונות (דף לח.) 'לכך נברא בערב שבת כדי שיכנס לסעודה מיד'.

Support: And this is what the Gemara in Sanhedrin at the end of Perek Echad Dinei Mamonos (Daf 38.) is referring to when it says 'Hashem created Adam on Erev Shabbos so that he should be able to eat his Se'udah immediately'.

וע"כ יסדו 'אשר יצר את האדם בחכמה'.

Conclusion: Which is why they instituted the wording ' ... who created Adam with wisely'.

TOSFOS DH MAFLI LA'ASOS

תוספות ד"ה מפליא לעשות

(SUMMARY: Tosfos pinpoints the wonder of man's creation to which this pertains.)

משום דאמרינן בב"ר "כי גדול אתה ועושה נפלאות, אתה אלהים לבדך".

Source: Because we say in Bereishis Rabah (which commenting on the Pasuk in Tehilim " ... for You are great, and You work wonders; You alone are G-d"), explains as follows:

'אדם עושה נאד, אפילו יש בו נקב אחד מלא מחט סדקית, הרוח יוצא ואינו יכול לשמור בו (יין); והקב"ה ברא נקבים נקבים באדם, ושומר הרוח שאינו יוצא ממנו'.

Explanation: When a man makes a flask, even if it contains just one hole the size of a tiny needle, the air will escape and it can no longer retain (the wine) it. And Hakadosh-Baruch-Hu created a man full of holes, yet the air inside him does not escape!'

TOSFOS DH KI SHAMA KOL TARNEGOLA OMER BARUCH SHE'NASAN LA'SECHVI BINAH LEHAVCHIN

תוספות ד"ה כי שמע קול תרנגולא אומר ברוך שנתן לשכוי בינה להבחין

(SUMMARY: Tosfos explains why it is not necessary to actually have heard the rooster in order to recite the B'rachah.)

והוא הדין אפילו כי לא שמע ...

Clarification: The same applies even if one did not actually hear it ...

דאין ברכה זו אלא להבחנה, ועל הנאת האורה שתרנגול מבחין, והוא נהנה מן האור.

Reason: Since this B'rachah merely concerns the distinction, and on the benefit of the light which the rooster is able to distinguish, as it benefits from the light.

TOSFOS DH KI PARIS SUDRA AL REISHEIH

תוספות ד"ה כי פריס סודרא על רישיה

(SUMMARY: Tosfos first defines the Din of Sudra, then stresses the need to benefit from the object over which one is reciting a B'rachah.)

וה"ה לכל כובע ולכל כסוי.

(a)

Clarification: The same will apply to any hat and to any form of head-covering.

ודוקא כשנהנה.

(b)

Qualification: This is confines however, to where one benefits from it.

אבל אם אינו נהנה, כגון שהוא שוכב על מטתו בבגדיו, לא יברך לא זו ולא 'מלביש ערומים' ולא ברכות כיוצא בהן, כיון שלא נהנה ...

Qualification (cont.): If one does not, such as where one has been lying in bed fully-clothed, one recites neither this B'rachah nor that of 'Malbish Arumim', nor any other B'rachah of this nature.

כדמשמע בפרק שלישי דמגילה (דף כד:) גבי 'מי שלא ראה מאורות מימיו', דכולי עלמא בעי שיהנה מן האורה.

Source: As is implied in the third Perek of Megilah (Daf 24:) regarding the case of 'Someone who has never seen light in his life', since everyone agrees there that one must benefit from the light in order to recite a B'rachah over it.

TOSFOS DH ASHER KIDSHANU B'MITZVASOV V'TZIVANU L'HANI'ACH TEFILIN

תוספות ד"ה אשר קדשנו במצותיו וצונו להניח תפילין

(SUMMARY: Tosfos first explains why 'Lehani'ach' pertains to the Tefilin shel Yad and 'al Mitzvas' to the Tefilin shel Rosh, then explains his Machlokes with Rashi concerning the Gemara in Menachos.)

כיון דתחלת הנחתו בזרועו, יש לו לברך 'להניח', אבל בשל ראש מברך 'על מצות ...' ולא 'להניח' ...

Reason: Since one begins to lay Tefilin on one's arm one recites over the Tefilin shel Yad 'Lehani'ach ... '; whereas on the shel Rosh, one recites 'Al Mitzvas ... ', and not 'Lehani'ach ... '.

שכבר התחיל והניח אחד מהם.

Reason (cont.): Seeing as one has already begun to lay one of them.

ובפ' הקומץ (מנחות דף לו. ושם) אמר - 'לא סח, מברך אחת; סח, מברך שתים'.

(b)

Gemara Menachos: In Perek ha'Kometz (Daf 36. & :) the Gemara states that 'If one did not speak, one recites one B'rachah; whereas if one did, one recites two'.

פ"ה, דעל שתי התפילין קאמר, דמברך ברכה אחת על שתיהן, בלא סח בינתים.

Explanation #1: And Rashi explains there that the Gemara is referring to both Tefilin - that someone who did not speak recites only one B'rachah over both Tefilin.

ודוחק לומר דלא הוצרכו שתי ברכות, ד'להניח' ו'על מצות' אלא כשסח ועבר עבירה?

(c)

Refutation: It is a big Dochek however - to confine the recital of two B'rachos 'Lehani'ach' and 'al Mitzvas' to where one spoke and transgressed an Aveirah!

לכן פר"ת דעל של ראש שהיא גמר מצוה ועיקר, דיש בה ד' בתים ושי"ן - מברך 'על מצות'.

(d)

Explanation #2: Rabeinu Tam therefore explains that over the shel Rosh , which constitutes the completion of the Mitzvah, and it is the main one, since it contains four Batim as well as a 'Shiyn', one recites 'al Mitzvas ... '.

אבל סח, חוזר ומברך שתים על של ראש.

Explanation #2 (cont.): And if one spoke, one goes back and recites both B'rachos over the shel Rosh.

וכן הוא בשימושא רבא דגאונים.

Support: And this is also the opinion of the Shimusha Rabahof the Ge'onim.

ולפר"ת גבי 'סח, מברך שתים' - אם יניח של ראש לבד, דאין מעכבין זה את זה, מברך שתים על של ראש בלבד.

Explanation #2 (cont.): According to the explanation of Rabeinu Tam, with regard to 'If one spoke, one recites two B'rachos' - someone who lays the shel Rosh only, since the one does not hold back the other, must recite two B'rachos.

ומה שלא הזכיר הגמ' 'על של ראש בלבד, מברך שתים' ...

(e)

Implied Question: And the reason why the Gemara does not refer to a case where one does so ...

לפי שאין רגילות כלל להניח זה בלא זה, דתפילין בי בר חבו שכיחי (ב"מ ד' כט:).

Answer: Is because it is unsusual to wear one Tefilah without the other, seeing as 'Tefilin are readily available in the house bar Chavu', as the Gemara says in Bava Metzi'a (Daf 29:).

וכן פי' רבינו תם בתשובותיו, וכן רבינו אלחנן בסדר תקון תפלה שלו כתב כן.

2.

Conclusion: And so Rabeinu Tam wrote specifically in his Teshuvos, as did R. Elchanan in his explanation on Tefilah.
