FOODS FROM A NEVEILAH (Yerushalmi Halachah 1 Daf 2a)

תמן תנינן ביצת נבילה אם יש בה כיוצא בה נמכרת בשוק מותרת ואם לאו אסורה כדברי ב''ש וב''ה אוסרין

(a)

Mishnah (in Eduyos): An egg of a Neveilah (an bird/animal that was not Halachically slaughtered) -

1.

Beis Shamai - If there are others like it in the marketplace, it is permitted; if not, it is prohibited.

2.

Beis Hillel - prohibit it.

מה טעמא דבית שמאי גמורה הייתה עד שלא תתנבל

(b)

Question: What is the reasoning of Beis Shamai? The egg was finished before the bird became a Neveilah.

מעתה אפילו אין כיוצא בה נמכרת בשוק תהא מותרת

(c)

Question: If so, it should be permitted even if there are not others like it in the marketplace.

אם אומר את כן נמצאת מתיר שלל של ביצים

Answer: If you say this, people will eventually wrongly permit eggs that are still part of its spine.

Question: Does Beis Shamai follow the later teaching and Beis Hillel follow the early teaching? (If the Halachah follows Beis Hillel, surely they should correspond with the later teaching?) as follows...

[דף ג עמוד א (עוז והדר)] דא''ר חייה בשם רבי יוחנן בראשונה היו אומרים אין מעמידין לא בקיבת הנבלה ולא בקיבת העכו''ם

R. Chiya quoting R. Yochanan: Originally they said that one may not stand milk (to produce cheese) in the stomach (i.e. in congealed milk found in the stomach of an animal that suckled) of a Neveilah nor in the stomach of an animal slaughtered by an idolater.

חזרו לומר מעמידין בקיבת הנבילה ואין מעמידין בקיבת העכו''ם

They later retracted and said that one may stand milk in the stomach juices of a Neveilah (since the congealed milk is not connected to the stomach) but not in the stomach of an animal slaughtered by an idolater (in case he slaughtered it for idol worship).

ר' יוסי בי רבי בון אמר שמואל בר אבא בעי מה כר''א דרבי לועזר אמר סתם מחשבת עכו''ם לעכו''ם

Question (R. Yosi bei R. Bun heard from Shmuel bar Aba): This conclusion assumes that a gentile will always slaughter for idol worship, like the opinion of R. Elazar?!

רבי יסה בשם רבי יוחנן הכין בראשונה היו אומרים אין מעמידין לא בקיבת הנבילה ולא בקיבת העכו''ם וחזרו לומר מעמידין בין בקיבת הנבילה בין בקיבת העכו''ם

Resolution (R. Yasa quoting R. Yochanan): The correct statement is as follows - Originally, they said that one may not stand milk in the stomach juices of a Neveilah, nor in the stomach juices of an animal slaughtered by a gentile. They later retracted and said that one may stand milk in both the stomach juices of a Neveilah and the stomach juices of an animal slaughtered by a gentile.

R. Yosi: The wording of the Mishnah (in Maseches Chulin) is a support for R. Chiya bar Aba - The stomach juices of an animal slaughtered by a gentile and the stomach juices of a Neveilah are prohibited. This is like the early teaching.

כשירה שינקה מן הטריפה קיבתה אסורה כמשנה הראשונה

(i)

If a Kosher animal nursed from a Tereifah, its stomach juices are prohibited, like the early teaching.

וטרופה שינקה מן הכשירה קיבתה מותרת כמשנה אחרונה

If a Tereifah nursed from a Kosher animal, its stomach juices are permitted, like the later teaching.

One could even say that Beis Shamai and Beis Hillel are like the later teaching....

ביצה גידולי גופה קיבה ממקום אחר באת

(Why is the egg of the Neveilah prohibited?) Because an egg grows in the Neveilah's body (and people might come to eat the Neveilah itself); however, the stomach juices (are permitted) since they are known to come from elsewhere.

ואתיא כהיא דאמר רבי יוסה בי רבי בון בשם רבי יוחנן

This is like the statement of R. Yosa bei R. Bun quoting R. Yochanan -

מעשה בבניו של יהודה בן שמועי שביקעו להם זאבים יותר משלש מאות צאן ובא מעשה לפני חכמים והותרו קיבותיהם אמרו ביצה גידולי גופה קיבה ממקום אחר באת

There was a case about the sons of Yehuda ben Shamui, where wolves attacked more than 300 sheep. The case was brought before the Chachamim and they permitted the stomach juices. They explained that an egg grows in the Neveilah's body but the stomach juices are from elsewhere.
