WORDINGS OF FREEDOM AND GIFTS (Yerushalmi Halachah 8 Daf 25b)

האומר טבי עבדי עשיתי בן חורין עשיתיו בן חורין עושה אני אותו בן חורין הרי הוא בן חורין הרי זה בן חורין הרי זה זכה

(a)

If a person says, "I made my slave Tavi a free man" or "I made him a free man" or "I am making him a free man" or "Behold he is a free man" or "Behold, this one is a free man" - the slave acquires his freedom.

ר' חייא בשם ר' יוחנן [דף כו עמוד א] ובלבד בשטר

(b)

R. Chiya citing R. Yochanan: As long as it was written in a document.

יעשה בן חורין ר' אומר זכה וחכמים אומרים לא זכה.

If he said, "He will be a free man", Rebbi says that he goes free; the Chachamim say that he does not.

האומר שדה פלוני נתתי לפלוני נתונה לו תהא שלו ינחל פלוני בנכסיי יחזיק פלוני בנכסיי לא אמר כלום.

(d)

If a person says, "I gave field ploni to Ploni" or "it is given to Ploni" or "It shall be his" or "Ploni will inherit my property" or "Ploni will take possession of my property" - he has not said anything.

תינתן לו מתנה ר' אומר זכה וחכמים אומרים לא זכה וכופין את היורשים לקיים דברי המת.

(e)

If he said. "...will be given to Ploni as a gift" - Rebbi says that he acquires it; Chachamim say that he does not, and we force the inheritors to fulfill the words of the dead.

תני רבן שמעון בן גמליאל אומר אף הכותב דיאתימון בלעז הרי זו כמתנה.

(f)

Beraisa (R. Shimon ben Gamliel): Even if a person writes the field is a "diatimon" (gift in Aramaic), it is a valid gift.

ר' חגין בשם רבי יהושע בן לוי חיזרתי על כל בעלי לשונות לידע מהו דיאתימון ולא אמר לי אדם דבר.
