ACQUIRING THE OFFSPRING OF AN ANIMAL (Yerushalmi Halachah 1 Daf 8b)

רב חסדא אמר משך בהמה זו לקנות קנה

(a)

Rav Chisda: If a person took possession of an animal in order to acquire it, it is acquired.

לקנות וולדתיה [לא] קנה

...in order to acquire its offspring, they are (not) acquired. (Note: The text changes made in this sugya are made by the Pnei Moshe from the Yerushalmi in Kidushin Perek 1, Halacha 4.)

לקנות היא וולדותיה (לא) קנה

2.

...in order to acquire it and its offspring, they are acquired.

א"ר נסה הדא דתימר בשלא היתה עברה אבל אם היתה עברה עשו אותה כאחד מאיבריה.

(b)

Rav Nasa: This (in order to acquire its offspring, they are not acquired) applies when the animal is not pregnant, as if it is, its foetus is considered to be one of its limbs.

והתני המוכר עוברי בהמתו לחבירו לא עשה כלום

(c)

Question (Beraisa): One who sells the foetus of his animal has not done anything.

וולדי שפחתו לחבירו לא עשה כלום

...the offspring of his slave woman, he has not done anything.

מעשרות שדה לחבירו לא עשה כלום

2.

...the maaseros of a field, he has not done anything.

אויר חורבתו לחבירו לא עשה כלום.

...the airspace of his abandoned house, he has not done anything...?

אלא מוכר לו בהמה [דף ט עמוד א] ומשייר לו עוברה מוכר לו שפחה ומשייר לו וולדה מוכר לו שדה ומשייר לו מעשרות מוכר לו חורבה ומשייר לו אוירה.

(d)

Answer: Rather, he sells him his animal and retains the foetus for himself; he sells him his slave woman and retains her offspring for himself; he sells him his field and retains the maaseros for himself; he sells him his abandoned house and retains the airspace for himself.
