DISTANCING FROM THE CITY (Yerushalmi Halachah 7 Daf 6a)

[דף ו עמוד א] משנה מרחיקין את האילן מן העיר עשרים וחמש אמה והחרוב והשקמה חמשים אמה

(a)

(Mishnah): One must distance a tree from the city by 25 amos, and for a carob and sycamore tree, 50 amos.

אבא שאול אומר כל אילן סרק חמשים אמה אם העיר קדמה קוצץ ואינו נותן דמים ואם האילן קדם קוצץ ונותן דמים

(b)

Abba Shaul: Any non-fruit growing tree must be distanced 50 amos. If the city was built first, he must cut down the tree but does not reimburse for it. If the tree was first, he can also cut it down, but he must reimburse the owner.

ספק זה קדם וזה קדם קוצץ ואינו נותן דמים

(c)

If it is unknown which came first, he can cut it down without reimbursing the owner.

מרחיקין גורן קבוע' מן העיר חמשים אמה

(d)

One must distance a fixed granary from the city by 50 amos (as the chaff that is blown away by the wind is damaging to the city dwellers. A fixed granary is defined as a pile of produce large enough that it is winnowed with a shovel.)

לא יעשה אדם גורן קבועה בתוך שלו אלא אם כן יש לו חמשים אמה לכל רוח מרחיק מנטיעותיו של חבירו ומנירו כדי שלא יזיק

(e)

A person should not make himself a fixed granary inside his property unless in every direction there is a space of 50 amos that does not contain saplings and has not been ploughed.

גמרא משם שעומד ומאפיל או משם שניאו רע.

(f)

(Gemara): (Why must a tree be distanced from the city?) Is it because a tree that is nearby will overshadow the people of the city or is it because it damages the aesthetics of the city?

Question: What is the practical difference between the two?

היה עומד בתוך שלו אין תימר משם שעומד ומאפיל בתוך שלו מותר ואין תימר משם שניאו רע אפילו בתוך שלו אסור

(h)

Answer: When the tree is planted within his property. If the problem is overshadowing, he will only overshadow his own land, which is his choice. If the problem is the aesthetics of the city, even within his property would be problematic. The Gemara does not answer the question.
