OPENING A SHOP (Yerushalmi Halachah 3 Daf 4b)

משנה לא יפתח אדם חנות של נחתומין ושל צבעין תחת אוצרו של חבירו ולא רפת בקר

(a)

(Mishnah): A person may not open a bakery or dyer's shop underneath his neighbor's storeroom nor may he build his barn there.

באמת ביין התירו אבל לא רפת הבקר

(b)

They permitted opening it under a wine store but not a barn (as the heat is beneficial to the wine but not to the animals.)

חנות שבחצר יכול הוא למחות בידו ולומר לו איני יכול לישן לא מקול הנכנסים ולא מקול היוצאים

A shop in a courtyard - a neighbor may protest it, saying, "I cannot sleep because of the noise of the people coming and going!"

עושה כלים יוצא ומוכר בשוק אבל אינו יכול למחות בידו ולומר לו איני יכול לישן מקול הפטיש ולא מקול הריחים ולא מקול התינוקות

(d)

Craftsman may produce vessels and sell them in the market and a neighbor may not protest, saying, "I cannot sleep because of the noise of the hammer or the millstone or the children."

גמרא רבי יעקב בר אחא פני חד חליטר מן איסטיב לאיסטיב.

(e)

(Gemara): R. Yaakov bar Acha moved a baker from one neighborhood to another (to avoid baking underneath a neighbor's storeroom).

ר' אבדומי אחי ר' יוסי הוה חד חליטר שרי תחותוהי עבר ר' אחא ולא מחא

R. Yosi's brother, R. Avdumi, had a baker living underneath him. R. Acha passed by there and he did not object to the baker being there.

אמר רבנן עברין ולא מחוי

R. Avdumi to R. Acha: How could the Chachamim pass by and not protest this?

כעס עלוי ר' אחא איבאש רבי אבדומי אחי ר' יוסה איבאש.

R. Acha became angry at R. Avdumi for saying this. R. Avdumi became sick and then deteriorated even more.

R. Avdumi's brother R. Yosi went to visit him (and saw that nobody was helping him, because R. Acha was angry with him).

אמר איזיל ואיבעי מיניה

R. Yosi to R. Avdumi: I will go and appease R. Acha.

אזל ומר בי דינא ורחם עלוי בי דינא ועתד ליה תכריכין.

R. Yosi went and told the Beis Din (with R. Acha at its head), that R. Avdumi was sick. (R. Acha and his) Beis Din took pity on him and told them to prepare burial shrouds.

חד בר נש זבין כל דרתיה שייר בה חד מסטובא והוה עליל ויתיב ליה עליה

A person once sold his whole courtyard with the houses. He withheld for himself a small attic and would regularly go and sit there.

אתא עובדא קומי רבי יונה בי רבי יוסי אמרין לא כולה מינך מיעל ויתיב עליה וחמי מיעל ונפק גו ביתיה.

The case came before R. Yona and R. Yosa. The buyer (who now lived in the courtyard and its houses) said that he cannot avoid the seller - since he regularly goes and sits in his attic, he can see all of the comings and goings in the buyer's home. (The Beis Din ruled in favor of the buyer that the seller can no longer continue to come and go freely).

חד בר נש זבין פלגא דרתיה שייר בה חד נחתומר

(h)

A person once sold half of his courtyard and house and allowed a baker to remain there (in the other half).

אתא עובדא קומיה רבי יונה ורבי יוסה אמרין אתת את עלוי הוא לא אתא עלך ותני כן אם קדמה הרפת או חנות לאוצר אין יכול למחות.

The case came before R. Yona and R. Yosa. (The buyer wanted to evict the baker. They said to the buyer, "You came to the baker!" (i.e. he preceded you), and we have learned (meaning that it can be deduced from out Mishnah) that if the cowshed or shop preceded the storeroom, the storeroom owner cannot object.

תני באמת ביין התירו אף על פי שממעטו אלא שמשביחו.

(i)

Based on our Mishnah, the Beraisa taught - They permitted opening a bakery under a wine store - even though the heat rising from the bakery reduces the wine, ultimately it improves it.

רב הושעיה כד שמע הדין תנייה יהב חמריה גו אגריה דבני אסריח חמריה אמר המשנה היטעתי לא שהיטעתי המשנה אלא דריחא דבני מסרי חמריה.

(j)

When Rav Hoshiyah heard this Beraisa, he left his wine on the roof of the bathhouse, thinking that it would improve the wine, but the wine, in fact, spoilt. He first thought that the Beraisa mislead him, but he later realized that he had misunderstood the Beraisa - although heat is good for wine, the smell of the bathhouse damages it.

תני [דף ה עמוד א] לשכינו יכול לחזור בו משקיבל עליו אינו יכול לחזור בו.

(k)

Beraisa (Chachamim): If the cowshed owner wishes to rent it out to another person, the neighbor can say that he only agreed to the owner using it as a cowshed, but not anyone else. But once he agrees to allow the renter, he can no longer retract.

רשב"ג אומר אף משקיבל עליו יכול לחזור בו דו יכיל מימר ליה אינון אזלין ואתיין להכא בעיין לך ולא משכחין לך ומרבין עלינו הדרך.

Rabban Shimon ben Gamliel: Even then he can retract, as he could say, "After you leave, the people who used to come to see you will continue to come and ask me where you are, so there are too many comings and goings in the courtyard".

רבי חנינה ור' מנא חד אמר מהו לשכינו מישרתיה גו דרתיה משקיבל עליו אין יכול לחזור בו.

(l)

R. Chanina and R. Mana disagreed: One said that the case of the Beraisa where the owner wishes to rent it out to another person and if the neighbor agreed, he cannot retract, it is referring to bringing in a new tenant to a pre-existing cowshed or shop underneath him. However, for the tenant to then make a new cowshed or open a shop, the neighbor could still retract and object.

(רב הונא) [חרנה] אמר מהו לשכינו מיפתח ליה חנות. משקיבל עליו אין יכול לחזור בו.

The other one: It is referring to opening a new shop - even then, if the neighbor agreed, he cannot retract.

Mishnah in Maseches Kesuvos: About any blemish of the husband that she accepted coming into the marriage, R. Meir says that she can say, "I thought that I could bear it but I now realize that I cannot".

אבל אינו יכול למחות ולומר לו איני יכול לישן מקול הפטיש ולא מקול הריחים או מקול התינוקות.

The Mishnah taught: ...And a neighbor may not protest, saying, "I cannot sleep because of the noise of the hammer or the millstone or the children."

אילין דמלפין טלייא ואילין דעבדין מסוגיין אילין לאילין יכלין חבריהון למימחי בידיהון

The noise of children refers to the noise of their Torah learning, but he can protest the noise of their being taught signals to communicate with their friends.

דו יכיל מימר ליה אינון אזלין ואתיין בעיין לך ולא משכחין יתן והן מרבין עלינו את הדרך.

2.

The neighbor could (also) complain that the one who brings the children is increasing the comings and goings in the courtyard.

אילין ציפוראי ממחין אילין לאילין מסמריה דנווליה.

(o)

The people of Tzipori would protest when a resident of a courtyard would make a garbage dump in the courtyard, because of the heat that it produced.

הורי ר' אבימי בר טובי מיתן חד נוול בין כותל לכותל

(p)

R. Avimi bar Tuvi ruled that one person may make a dump between two walls.

הורי רבי יצחק בר חקילה מרחקת אילין מרושתיה מכותלה ד' אמות.

(q)

R. Yitzchak bar Chakilah ruled that the place used for chopping cedar wood should be distanced four amos from the wall.

א"ר יוסי בי ר' בון אילין עמודיא דרכינין מכוח קריית אינון רכינין.

(r)

R. Yosi bei R. Bun: The reason that we see house walls becoming softer is because cedar wood is chopped nearby.

שורא דחמץ מן קל נורי פרסייא נפל:

(s)

When the place where clothes are soaked with dog excrement for washing, is next to a wall, the wall becomes so weak that it can fall down just from the roar of the lion cubs in Persia. (Therefore, when soaking clothes in this way, they must be distanced from a wall to prevent damage.)
