THE ARGUMENT OF R. NECHEMYAH AND RABANAN (Yerushalmi Perek 17 Halachah 4 Daf 83a)

מתני' כל הכלים ניטלין בשבת חוץ מן המסר הגדול ויתד של מחרישה

(a)

(Mishnah - R. Yosi): Any Kli may be taken on Shabbos, except for a big saw or the blade of a plow. (People do not use them for anything else.)

כל הכלים ניטלין לצורך ושלא לצורך

(b)

(Mishnah): All Kelim may be moved for a need or without a need;

רבי נחמיה אומר אין ניטלין אלא לצורך:

R. Nechemyah says, they may be moved only for a need.

גמ' רב יהודה בשם רב הלכה כרבי נחמיה דאמר אין ניטלין אלא לצורך.

(Gemara - Rav Yehudah citing Rav): The Halachah follows R. Nechemyah, who says that they may be moved only for a need.

ר' יוחנן ורבנן דתמן חד אמר לצורך לצורך גופו. שלא לצורך שלא לצורך גופו. ר' נחמיה אומר אין ניטלין אלא לצורך גופו.

R. Yochanan and Rabanan there (in Bavel) - one of them said that "for a need'' is to use the Kli itself. "Not for a need'' is not to use the Kli itself. R. Nechemyah says, that they may be moved only to use the Kli itself;

וחרנה אמר לצורך לצורך גופו ולצורך מקומו. שלא לצורך שלא לצורך גופו ושלא לצורך מקומו. רבי נחמיה אומר אין ניטלין אלא לצורך גופו ולצורך מקומו.

The other said that "for a need'' is to use the Kli or its place. "Not for a need'' is not to use the Kli and not its place. R. Nechemyah says, that they may be moved only to use the Kli or its place.

תני א''ר יודן לא נחלקו ב''ש וב''ה על המלאים שמטלטלין אותן שלא לצורך. ועל הריקנין שיש בדעתו למלותן.

(R. Yudan - Beraisa): Beis Shamai and Beis Hillel did not argue about Kelim full [of food]. One may move them [even] not for a need, and [also] empty Kelim that he intends to fill them;

על מה נחלקו על שאין בדעתו למלותן. שב''ש אוסרין וב''ה מתירין.

What do they argue about? [Empty Kelim] that he does not intend to fill them. Beis Shamai forbid, and Beis Hillel permit.

אתי דב''ש כרבי נחמיה. את אמרת הלכה כרבי נחמיה ולא הלכה כב''ש:

Question: Beis Shamai hold like R. Nechemyah. How did you (Rav Yehudah) say that the Halachah follows R. Nechemyah? The Halachah does not follow Beis Shamai! (PNEI MOSHE)

WHEN ONE MAY MOVE BROKEN KELIM (Yerushalmi Perek 17 Halachah 5 Daf 83a)

מתני' כל הכלים הניטלין בשבת שבריהן ניטלין ובלבד שיהו עושין מלאכה שברי עריבה לכסות בהן את פי החבית ושל זכוכית לכסות בהן את פי הפך

(a)

(Mishnah): If a Kli may be moved, its fragments may be moved with it, on condition that they have a use, e.g. pieces of a kneading trough to cover the opening of a barrel, or pieces of glass to cover the opening of a flask;

רבי יהודה אומר ובלבד שיהו עושין מעין מלאכתן שברי עריבה [דף פג עמוד ב] לצוק לתוכן מקפה ושל זכוכית לצוק בתוכן שמן:

R. Yehudah says, the fragments may be moved only if they have a use like the original function of the Kli, e.g. pieces of a trough to pour thick porridge into it, or pieces of glass to pour oil into them.

[דף קב עמוד א (עוז והדר)] גמ' תמן תנינן זכוכית לגרוד בה ראש הכרכד. והכא הוא אמר הכין.

(c)

(Gemara) Question: A Mishnah (8:6) says that the Shi'ur for glass is to scrape the end of the spindle, and here you say so (enough to cover a flask)?!

רבי אחא ר' מיישא בשם רבנן דקיסרי כאן בעבה כאן בחדה.

Answer #1 (R. Acha citing R. Maisha citing Rabanan of Kisari): Here we discuss thick glass, and there we discuss thin glass.
