SOMEONE LIABLE MULTIPLE MISOS (Yerushalmi Halachah 6 Daf 48a)

משנה מי שנתחייב שתי מיתות בית דין יידון בחמורה עבר עבירה שיש בה שתי מיתות יידון בחמורה

(a)

(Mishnah): One who is Chayav two different Misos Beis Din receives the more stringent one. If one is liable two Misos for one transgression, he receives the more stringent one;

ר' יוסי אומר יידון בזיקה הראשונה שבאות עליו

R. Yosi says, he receives the one that arose first (this will be explained).

מי שלקה ושנה ב"ד כונסין אותו לכיפה ומאכילין אותו שעורים עד שכריסו נבקעת

If someone was lashed twice, Beis Din put him in Kipah (a cell) and [feed him minimally, and later] feed him barley, until his stomach bursts.

ההורג את הנפשות שלא בעדים כונסין אותו לכיפה ומאכילין אותו לחם צר ומים לחץ:

If one murdered without witnesses, we put him in Kipah and feed him meager amounts of bread and water [and then feed him barley, so his stomach bursts].

גמרא תמן תנינן תני רבי יוסי אומר ידון בזיקה הראשונה שבאת עליו.

(Gemara) Citation (Beraisa - R. Yosi): He is judged for the first Chiyuv [Misah] that came on him;

כיצד חמותו ונעשית אשת איש הרי זו בשריפה אשת איש ואח"כ נעשית חמותו בחניקה.

How is this? If his mother-in-law became an Eshes Ish, he is burned. If she was an Eshes Ish and became his mother-in-law, he gets Chenek.

בא על חמותו (והיי דא לה חמותו וכלתו - צפנת פענח מוחקו) היך עבידא גבר נסב (איתא) [צ"ל איתתא - הגהות ר' יוסף דיננער] ולברתיה דאחוה ולברתיה דאחתיה.

If one had Bi'ah with his mother-in-law (he can be liable for his mother-in-law, his mother-in-law's mother, and his father-in-law's mother - Kerisus 3:6). How is this? A man married a woman (Leah), and her brother's daughter, and her sister's daughter;

אתא על סבתא חייב עליה משום חמותו ואם חמותו ואם חמיו.

If he had Bi'ah with the grandmother (of Leah's nieces, i.e. Leah's mother), he is liable for his mother-in-law, his mother-in-law's mother, and his father-in-law's mother.

חמותו וכלתו כאחת מה אמר בה ר' יוסי חומר בקל מה אמר בה רבי יוסי שני איסורין כאחת מה אמר בה רבי יוסי.

Question: If a woman became his mother-in-law and his daughter-in-law at once, what does R. Yosi say? (E.g. he and his son stipulated that their Kidushin take effect at the same moment.) If a stringent Isur came after a light Isur, what does R. Yosi say? If two Isurim came at once, what does R. Yosi say?

אמרין כמה דאישתאלת על דר' יוסי כך אישתאלת על דר' ישמעאל דתני בשם ר' ישמעאל נתאלמנה ונתגרש' נתחללה זינת ואחר כך בא עליה (אינו חייב אלא אחת) [צ"ל חייב על כל אחת ואחת - פני משה] זינת ונתחללה [צ"ל נתגרשה ונתאלמנה - פני משה] ואחר כך בא עליה (חייב על כל אחת ואחת) [צ"ל אינו חייב אלא אחת - פני משה]

Remark: Just like you asked according to R. Yosi, you can ask according to R. Yishmael, for a Beraisa teaches in the name of R. Yishmael that if a woman became widowed, divorced, a Chalalah and a Zonah, and afterwards [a Kohen Gadol] had Bi'ah with her, he is liable for each one. If she became a Zonah, Chalalah, was divorced and widowed, he is liable only once;

נתאלמנה נתגרשה כאחת (עמוד ב) מה אמר בה ר' ישמעאל חומר בקל מה אמר בה ר' ישמעאל שני איסורין כאחת מה אמר בה ר' ישמעאל.

If she became widowed and divorced at once, what does R. Yishmael say? (E.g. her husband stipulated that her Get take effect when he dies - GILYONEI HA'SHAS.) If a stringent Isur came after a light Isur, what does R. Yishmael say? If two Isurim (stringent and lenient) came at once, what does R. Yishmael say? (These questions are not answered.)

Note: There is an implied question. Our Mishnah says that he murdered without witnesses. Surely we need witnesses to put him in Kipah!

רב אמר במפנים עדיו היא מתניתא

Answer #1 (Rav): In our Mishnah, his witnesses were separated (did not see the testimony together. Therefore, we cannot execute him, but we put him in Kipah.)

Answer #2 (R. Yosi ben Chaninah): [The case is, the murderer] did not want to accept the warning (GILYONEI HA'SHAS, CHOMAS YERUSHALAYIM).
