ERUVIN FOR THE TWO DAYS OF YOM TOV (Yerushalmi Perek 3 Halachah 8 Daf 25b)

מתני' רבי יודה אומר ראש השנה שהיה ירא שמא תתעבר מערב אדם שני עירובין

(a)

(Mishnah - R. Yehudah): [In Chutz la'Aretz, where people do not hear about which day was made Rosh Chodesh until later in the month,] if one fears that Rosh Hashanah will be [a day later because Elul will be] Me'ubar (30 days; it is normally 29), he can make two [different] Eruvin [because only one of them takes effect, for the day that is really Yom Tov. The other day is Chol, and requires no Eruv];

ואומר עירובי הראשון למזרח והשני למערב הראשון למערב והשני למזרח

He can make the Eruv for the first day [of Safek Yom Tov] in the east, and for the second day in the west, or vice-versa;

עירובי הראשון והשני כבני עירי השני והראשון כבני עירי

He can be Me'arev just for the first day, and the second day he is like residents of his city, or vice-versa.

Chachamim did not agree to him.

גמ' דאיתפלגון שירי פתילה שירי מדורה שירי שמן שכבו בשבת מהו להדליקה בי''ט רב ורבי חנינא תריהון אמרין אסור ר''י אמר מותר.

(Gemara): [Amora'im] argued about remnants of a wick, remnants of a bonfire, remnants of oil that extinguished on Shabbos - may one light them on Shabbos? Rav and R. Chanina, both of them forbid. R. Yochanan permits.

Question (R. Mana, to R. Yudan): What is the relevance of a wick (that extinguished on Shabbos, which is forbidden due to Muktzah) to an egg [laid on Yom Tov, which is due to Hachanah?! In Beitzah, the Gemara connects them.]

א''ל מן מה דנן חמיין רבנן מדמיי לה הדא אמרה היא הדא היא הדא.

Answer (R. Yudan): Since we find that Chachamim equate them, this teaches that they are the same (both are due to Hachanah).

משום ד' זקנים אמרו הנאכל עירובו בראשון הרי הוא כבני עירו בשני

In the name of four Chachamim, they said that if his Eruv was eaten on the first, he is like residents of his city on the second.

ר' חונה בשם רב הלכה כד' זקנים.

(R. Chunah citing Rav): The Halachah follows the four Chachamim.

רב חסדא בעא מחלפא שיטתיה דרב תמן איעבד לה שתי קדושות וכא איעבד לה קדושה אחת.

Question (Rav Chisda): Rav contradicts himself! There (Eruv), he considers [Shabbos and Yom Tov] to be two Kedushos, and here he considers them to be one Kedushah!

(R. Acha from his Rebbi, and R. Yosi himself): The four Chachamim hold like R. Eliezer [that they are two Kedushos].

אמר רבי מנא קומי רבי יוסה ר''מ ור' יודה אין הלכה (כר') [צ''ל כר''מ ור' - שערי תורת ארץ ישראל] יודה בארבעה זקנים כר''א.

Question (R. Mana, to R. Yosah): R. Meir and R. Yehudah [say that Safek Eruv is Chamar Gamal]. Does the Halachah not follow R. Meir and R. Yehudah?! Why did four Chachamim rule like R. Eliezer?!

[דף כו עמוד א] מה אין תמן שלא זכה עירוב (לא הייתי) [צ''ל את - שערי תורת ארץ ישראל] אומר שיעקור את רגליו מבני עירו כאן שזכה לו עירובו לא כל שכן.

There, his Eruv did not acquire for him, and you say that he uproots himself from the Techum of people of his city. Here, his Eruv acquired for him [on the first day, but it was consumed]. All the more so [we should say that he uproots himself from the Techum of Bnei Iro, also for the second day! We explained this like SHA'AREI TORAS ERETZ YISRAEL.]

עירב בככר בראשון מערב בככר בשני ובלבד באותו הככר עירב ברגלו בראשון מערב ברגליו בשני.

If one was Me'arev with a loaf on the first day, he may be Me'arev with a loaf on the second day, as long as it is the same loaf. If one was Me'arev with his feet (walked to where he wants to acquire Shevisah) a loaf on the first day, he may be Me'arev with his feet on the second day.

עירב ברגליו (מערב בככר בככר לא) [צ''ל לא מערב בככר בככר - קרבן העדה] יערב ברגליו.

If one was Me'arev with his feet [on the first day], he may not be Me'arev with a loaf [on the second day]. If one was Me'arev with a loaf [on the first day], he may be Me'arev with his feet.

היך מה דאת אמר תמן ברגליו לא יערב בככר ודכוותה בככר לא יערב ברגליו.

Question: How do you say that if one was Me'arev with his feet, he not may be Me'arev with a loaf [for this is like Hachanah? For the same reason, you should similarly say that] if one was Me'arev with a loaf, he may not be Me'arev with his feet!

להקל לעני שאין לו ככר.

Answer #1: This is to be lenient for an Oni who does not have [another] loaf. (His Eruv for the first day was eaten.)

Objection: Just like you say there that if one was Me'arev with a loaf, he may be Me'arev with his feet, you should similarly say that if one was Me'arev with his feet, he may be Me'arev with a loaf!

היך מה דאת אמר תמן ברגליו לא יערב בככר ודכוותה בככר לא יערב ברגליו

[Rather, you must say that the Heter to be Me'arev with a loaf or his feet is not to be lenient for an Ashir and Oni, rather,] just like you say there that if one was Me'arev with his feet, he not may be Me'arev with a loaf, you should similarly say that if one was Me'arev with a loaf, he may not be Me'arev with his feet!

Answer #2 (R. Avin citing Rabanan there (in Bavel)): [Rabanan] consider him like one who goes to his city. (One who is Me'arev with his feet, it does not look like Hachanah.)
