HETER THROUGH TZURAS HA'PESACH (Yerushalmi Perek 1 Halachah 1 Daf 5b)

(a)

If there are four Amos in between [the small Mavuy and the big Mavuy], it is distanced [so a Lechi or Korah is needed for each one].

תני רבי הושעיה פתחים פתוחין לרשות הרבים נפתחים נעשה מקומם ר''ה ננעלים נעשה מקומם רשות היחיד

(R. Hoshayah - Beraisa): If openings [from a Mavuy] to Reshus ha'Rabim became breached on Shabbos, their place becomes Reshus ha'Rabim. If they became locked, their place becomes Reshus ha'Yachid;

מבואות המפולשים לים כמפולשים לבקעה

Mavo'os open to the sea are like open to a valley. (They need Lechi or Korah on one side, and Tzuras ha'Pesach on the other.)

וההן שקקה דר' חנין לא צריך צורת פתח שהוא כמתלקט עשרה טפחים מתוך שלש תקנה תיקנו בו כדי להתיר בתים שלמטן:

The street of R. Chanin (it was open to the sea) does not need Tzuras ha'Pesach, for the slope rises 10 Tefachim amidst three [Amos, so it is like a wall]. They made a Tikun [Tzuras ha'Pesach] for it due to the houses below (far from the slope, lest it look like they carry without a Heter).

אם יש לו צורת פתח אף על פי שהוא רחב מעשר אמות אינו צריך למעט:

(Mishnah): If it has Tzuras ha'Pesach, even though it is wider than 10 Amos, he need not diminish it.

Chananyah bar Shilmiya was sitting and teaching [this to] Chiyah, Rav's son. Rav stuck his head out of the window, and said "this is not so.'' (Even if it has Tzuras ha'Pesach, if it is wider than 10, it must be reduced.)

א''ל ולא ניתנייה כן א''ל דתניתיה ואודעיה דלית כן

Chananyah asked "should I not teach this to [your son]?'' Rav said "teach him, but inform him that this is not the Halachah'' (PNEI MOSHE).

אבא בר הונא אמר צורת פתח שאמרו קנה מיכן וקנה מיכן וגמייא על גביהן

(Ava bar Huna): Tzuras ha'Pesach is a stick on each side and [even] a reed rope on top of them.

רבי ינאי בי רבי ישמעאל בשם רשב''ל [דף ו עמוד א] ציר וכן ציר לא יהא מחוסר אלא דלת.

(R. Yanai bei R. Yishmael citing Reish Lakish): It needs Tzir and Ken Tzir (a hinge-pin, i.e. a pole on which a door swings, and a base to house the bottom of the Tzir, i.e. a hole below in the floor). It must lack only a door.

תני ר' חייה כיצד מתירין רה''ר רבי יהודה אומר לחי מיכן ולחי מיכן קורה מיכן וקורה מיכן

(R. Chiyah - Beraisa): How do we permit [a Mavuy Mefulash to] Reshus ha'Rabim? R. Yehudah says, he puts a Lechi on this side and a Lechi on the other side, or a Korah on this side and a Korah on the other side;

וחכמים אומרים לחי וקורה מיכן ועושה צורת פתח מיכן

Chachamim say, he puts a Lechi or Korah on this side, and Tzuras ha'Pesach on the other side.

רבי ירמיה בשם רבי שמואל בר רב יצחק ציר וכן ציר לא יהא מחוסר אלא דלת

(R. Yirmeyah citing R. Shmuel bar Rav Yitzchak): [Tzuras ha'Pesach] needs Tzir and Ken Tzir. It must lack only a door.

אמרה רבי ירמיה קומי רבי זעירה

R. Yirmeyah said this in front of R. Ze'ira;

א''ל ומה בידך ר' אילא בשם רבי יוחנן צורת הפתח שאמרו קנה מיכן וקנה מיכן וגמי על גביהן

R. Ze'ira: What do you have?! (Your teaching is not the Halachah.) R. Ila said in the name of R. Yochanan that Tzuras ha'Pesach that [Chachamim] said is a stick on each side and [even] a reed rope on top of them.

א''ר יוסה רבנן דהכא כדעתון ורבנין דתמן כדעתון

(R. Yosah): Rabanan here (in Eretz Yisrael) hold like their opinion [elsewhere], and Rabanan there (in Bavel) hold like their opinion [elsewhere];

Rabanan there, who say that Tzuras ha'Pesach that was said is a stick on each side and even a reed rope on top of them, and they say that the Halachah does not follow [our Mishnah, that Tzuras ha'Pesach permits an opening more than 10 Amos];

ורבנן דהכא דאינון אמרין ציר וכן ציר לא יהא מחוסר אלא דלת ואינון אמרין דאית כן

Rabanan here, who say that it needs Tzir and Ken Tzir, and it must lack only a door, they say that the Halachah follows [our Mishnah].

חנניה בן אחי ר' יהושע אומר בית שמאי אומרים דלת מיכן ודלת מיכן וכשהוא מכניס (מוציא ונועל) [צ''ל ומוציא נועל - פני מאיר]

(Chananyah ben Achi R. Yehoshua): Beis Shamai say that [a Mavuy Mefulash] needs a door on this side and a door on the other side, and when he enters or leaves, he locks it;

ובית הלל אומרין דלת מיכן (וצורת פתח) [צ''ל ולחי או קורה - פני מאיר] מיכן.

Beis Hillel say, [it suffices] a door on this side and a Tzuras ha'Pesach on the other side.

(Shmuel): The Halachah follows Chananyah ben Achi R. Yehoshua.

Question: Is this is not like the first [Beraisa, in which Chachamim obligate Lechi or Korah on one side, and Tzuras ha'Pesach on the other? Since they do not obligate locking the door, a door is no more than Tzuras ha'Pesach, which must include Tzir and Ken Tzir!]

Answer (R. Ba): Through a door, he can lock it [and block traffic. We explained this like PNEI MEIR.]

R. Acha ruled for people who make Tzuras ha'Pesach must enter it inside [the Mavuy] four Amos. (Since it is merely a stick on each side and one on top of them, if it is close to traffic of Reshus ha'Rabim, it is prone to be knocked down - SHA'AREI TORAS ERETZ YISRAEL. This does not apply to a Korah, which rests on the walls of the Mavuy.) R. Eivun ruled like this.
