ITEMS THAT DO NOT INVOLVE OVERCHARGING (Yerushalmi Halachah 6 Daf 18a)

[דף יח עמוד א] משנה ואילו דברים שאין להם הונייה העבדים והשטרות והקרקעות וההקדישות אין בהן לא תשלומי כפל ולא תשלומי ארבעה וחמשה

(a)

(Mishnah): There is no prohibition against overcharging for the following things - slaves, documents, fields and consecrated items. There is also no double payment nor payment of four or five.

שומר חנם אינו נשבע ונושא שכר אינו משלם

An unpaid watchman does not need to swear and a paid watchman does not pay.

ר' שמעון אומר קדשים שהוא חייב באחריותן יש להן הונייה ושאינו חייב באחריותן אין להן הונייה

R. Shimon: (Disagreeing with (a)) For consecrated items for which a person is responsible, there is a prohibition of overcharging. For those which a person is not responsible, there is no prohibition of overcharging.

רבי יהודה אומר אף ספר תורה ובהמה ומרגלית אין להן הונייה

(d)

R. Yehudah: There is even no prohibition of overcharging for a Sefer Torah, for animals and for diamonds.

אמרו לו לא אמרו אלא את אילו:

Chachamim: They only exempt the earlier cases (in (a)).

גמרא תני רבי יודה אומר אף ספר תורה בהמה ומרגלית אין להן אונאה. ספר תורה אין קץ לדמיו. בהמה ומרגלית צריכין לזווגם.

(Gemara) - Beraisa (R. Yehudah): There is even no prohibition of overcharging for a Sefer Torah, for animals and for diamonds - a Sefer Torah is priceless; animals and diamonds need to be matched up (with the ones that the owner already has, so a specific price cannot be put on them).

Beraisa (R. Yehudah ben Beseirah): A sword, a horse and a shield during war do not involve a prohibition of overcharging.
