(a)

(Mishnah): If Reuven left his jug in a Reshus ha'Rabim, and Shimon came and tripped on it, and it broke, Shimon is exempt from paying for it.

If Shimon was hurt by it, (Reuven,) the owner of the Chavis (barrel) must pay the damage.

(Gemara) Question: Do people not normally leave [Kelim] in Reshus ha'Rabim?! (Why is Shimon exempt from paying for it, and why is he paid if he was hurt? He should have avoided it!)

Answer #1 (Rav): The case is, Reuven filled the entire [width of] Reshus ha'Rabim [with jugs].

Inference: If he did not fill the entire Reshus ha'Rabim, [Shimon would be liable, for] people normally leave [Kelim] in Reshus ha'Rabim. (We explained this like MAHARA FULDA.)

Answer #2 (Shmuel): Either he filled the entire Reshus ha'Rabim, or [the jug] was in a corner (out of sight).

Answer #3 (R. Lazar): Even if he did not fill the entire Reshus ha'Rabim, [Shimon is exempt, for he need not walk around it. Do not say that he must move it,] for if he will take it from here and put it here (elsewhere), he made a Bor (obstacle, and he is liable for it);

Question: If [the Kli] filled the entire [width of] Reshus ha'Rabim, [he cannot move it, for] if he will take it from here and put it here, he made a Bor;

Rather, he takes a stick and breaks it - or, should he pass over it, and if it breaks, it breaks?

(b)

Answer: We learn from the following [Beraisa]. If Levi's ox came upon Yehudah's ox to kill it, and Yehudah removed his ox from underneath, or the ox removed itself and Levi's ox fell and died, Yehudah is exempt. If [Yehudah] pushed it and it fell and died, he is liable.

Levi cannot tell him 'had you left it (not removed your ox, even if mine killed it, I would have paid you your damage (loss. This shows that one may take the law into his own hands, even if not needed to avoid a loss!)

Rejection: No - Yehudah can tell him, had I left it, you would have given to me [only] half-damage.

Question: Exert yourself [and you will find the answer]! If [Levi's ox] was Mu'ad [he cannot say so, for it pays full damage]!

Answer: [Yehudah can say] I need not heed you [and let your ox kill mine], and I will need to go with you to Beis Din [until I force you to pay me. However, when there is no toil, one may not take the law into his own hands.]
