DECREES AGAINST FOOD OF NOCHRIM (Yerushalmi Perek 1 Halachah 4 Daf 10a)

אמרון קומי רבי חייא רובא תני רבי שמעון בן יוחי [דברים ב ו] אוכל תשברו מאתם בכסף ואכלתם וגם מים תכרו מאתם וגומר. מה מים שלא נשתנו מברייתן אף כל דבר שלא נשתנה מברייתו.

(a)

They said the following Beraisa in front of R. Chiya Raba. R. Shimon ben Yochai says, "Ochel Tishberu me'Itam ba'Kesef va'Achaltem v'Gam Mayim Tichru me'Itam...'' - just like water was not changed from its creation, also any [food of Nochrim] that was not changed from its creation [is permitted].

התיבון הרי מוטלייה ופנקריסים וקובטיות וקליות וחמין שלהן הרי אלו מותרין.

Question: Mutaliya (seeds soaked in hot water) leeks [that are eaten raw], parched grain and hot water [of Nochrim] are permitted [even though they changed]!

ניחא כולהן שהן יכולין להשרות ולהחזיר כמו שהיו קליות. למה

Partial answer: This is fine for all [but one] of them, for through soaking, they can return to like they were. However, why is parched grain [permitted? It cannot return to like it was!]

א''ר יוסי בי ר' בון בשם רב כל האוכל שהוא נאכל חי כמות שהוא אין בו משום תבשילי עכו''ם. ויוצאין בו משום עירובי תבשילין.

Answer (R. Yosi bei R. Bun citing Rav): Anything that is eaten raw, like it is, [the Isur of] Bishul Akum does not apply to it, and one is Yotzei through it for Eruvei Tavshilin [if it was cooked, even via a Nochri].

Question: How does Rav establish the verse that [the Beraisa said in front of] R. Chiya Raba expounded, "Ochel Tishberu me'Itam''?

באוכל תשברו. האכלתו שברתו. שאם היה קשה עליך (כאוכל) [צ''ל באוכל - שערי תורת ארץ ישראל, הגר''ח קניבסקי שליט''א] תשברו. ואם לאו הכרע עליו כסף.

Answer: Through food, you will break [their evil intent]. If you fed him, you broke him. If he was harsh to you, break him with food. If not (this did not change him), weigh for him (give a gift of) money.

אמרין כן הוה רבי יונתן עבד. כד הוה חמי בר נש רב עליל לקרתיה הוה משלח ליה איקרין.

They say that so R. Yonason did. When he saw a powerful officer come to the city, he would send to him gifts of food.

מיי אמר דאין הוה דיין דייתם או דיין דארמלה נישכח אפין מפויסיה עלוי.

What is the reason? If a case of an orphan or widow would arise, [R. Yonason] would be able to appease [the officer].
