BAVA BASRA 2-8 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to Rav Weiner -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.


1. Herod tested Bava ben Buta to see if he would curse him.
2. Bava ben Buta passed the test, refusing to say anything negative about Herod.
3. Herod remarked that had he known that the sages were so loyal, he never would have killed them.
4. If a person erected three walls around his neighbor's field, his neighbor does not have to share the cost.
5. If he erected a fourth wall, causing his neighbor's field to be guarded from animals, his neighbor must pay for this benefit.


1. Herod decided to test Bava ben Buta, whom he had blinded, by disguising his voice and asking Bava ben Buta to curse the king. He wanted to see if Bava ben Buta would curse him or say anything negative about him.
2. He kept explaining that one may not curse a king or a rich man even if he is an evildoer.
3. Herod was advised by Bava ben Buta that in order to atone for the great sin of killing the sages, he should renovate the Beis ha'Mikdash.
4. The case is where a person owns fields surrounding another person's field, and he erects three walls alongside his friend's field on three sides. Since his friend's field is still open on one side, his friend did not receive any benefit from the surrounding walls and therefore does not have to share in the cost.
5. Tana Kama: He must pay only for half the costs of the cheapest walls that would provide this benefit. Rebbi Yosi: He must pay for half of the actual cost of these walls.
