A BIT MORE

1. The Sha'ar Nikanor is one of the gates of the Azarah and the Metzora stands there and stretches his hands into the Azarah and the Kohen places the blood of his Asham on him. A Yoledes and Zavim and Zavos stand there when their Korbanos are brought because it is a Mitzvah to stand over one's Korbanos and this is the closest they are allowed to stand since they are Mechusrei Kaparah and it is forbidden for them to enter the Azarah.

2. Rebbi Yehudah says that this is learned from a Pasuk and Rebbi Shimon who is Doresh the reason for the Pasuk says that the reason is so that one Sotah will not be encouraged by the obstinacy of her friend.

3. Since Rebbi Shimon holds that the reason that more than one Sotah may not be given to drink is so that one Sotah will not be encouraged. In this there is no concern since she is shaking. However Rebbi Yehudah holds that even in this case it is forbidden to given more than one Sotah to drink.

4. Therefore one Kohen may not give to drink two Sotos or be Metaher two Metzora'im at the same time and one Beis Din shall not execute two servants or break the neck of two Agalos Arufos at the same time. However for two Kohanim and two Batei Dinim it is permitted.

5. Therefore a woman is not disrobed when she is stoned.

6. Therefore a woman is disrobed when she is stoned in order to make it less painful.

7. Someone who is Chayav Sekilah will fall off a roof or will be torn up by an animal; someone who is Chayav Sereifah will be burned in a fire or will be bitten by a snake; someone who is Chayav Hereg will be killed by the king or by bandits; and someone who is Chayav Chenek will drown or will die by choking.

8. Although a sin may not be punished immediately, however eventually it will be included among other sins and he will be punished for all of them together.

BRIEF INSIGHT

MISOS BEIS DIN

Although once the Beis ha'Mikdash was destroyed the Sanhedrin was Batel, however the Din of four Misos Beis Din is not Batel. Someone who is Chayav Sekilah will fall off a roof or will be torn up by an animal, someone who is Chayav Sereifah will be burned in a fire or will be bitten by a snake; someone who is Hereg will be killed by the king or by bandits. Rashi says that the Misah by the King is death by sword. The Maharitz Chiyus says that it is not only Nochriish kings who kill by sword. Jewish kings also kill only by sword. The Rambam says that a king has the right to kill someone who defies him or disgraces him but he may only kill by sword.

QUICK HALACHAH

AN EGLAH ARUFAH

The master is the one who does the execution of his servant and not his son or his Shali'ach or the Shali'ach Beis Din. He may not execute two servants at once because Mitzvos may not be done in clusters. (Rambam Hilchos Avadim 3:9 )
