YEVAMOS 57-58 (13-14 Tamuz) - Dedicated by Andy & Nancy Neff in honor of the completion of thirty days since the passing of Leah Miriam bat Yisroel (Lucy) Rabin. Beloved mother of Nancy Neff, Valerie, Doug and Andy Rabin, and wife of Sidney Rabin, Lucy Rabin was Nifteres this past 14th of Sivan.

SUMMARY

If a Kohen becomes a Petzu'a Daka, his wife may continue eating Terumah if they did not have relations after he became a Petzu'a Daka.
 
The servants of a Kohen who is a Petzu'a Daka may eat Terumah.
 
Rebbi Yehudah: A Kohen may not marry a Bas Ger. Rebbi Yosi: He may marry a Bas Ger.
 
Rebbi Yehudah: A Ger is regarded as part of the Kahal, and the daughter of a Ger may not marry a Petzu'a Daka. Rebbi Yosi: A Ger is not regarded as part of the Kahal, and thus the daughter of a Ger may marry a Petzu'a Daka.
 
Rebbi Eliezer ben Yakov: A Bas Ger may not marry a Kohen unless his mother is from Yisrael.
 
Rebbi Eliezer ben Yakov: A Bas Ger whose mother is from Yisrael may marry a Petzu'a Daka. (1)
 
Rav: If a Kohen Gadol is Mekadesh a widow with Chupah, she becomes Pasul to Kehunah. Shmuel: Kidushin to a Kohen Gadol with Chupah does not disqualify her to Kehunah. (2)
 
Rav agrees that if the widow is less than three years old, her Chupah with a Kohen Gadol does not disqualify her, because she is not old enough for Bi'ah.
 
A girl who is three years old is not old enough for Bi'ah, and therefore all of the relevant consequences of Bi'ah do not apply. (3)
 
A girl who is less than three years old does not become Pasul with Bi'ah or Chupah.

A BIT MORE

1. If her husband is a Kohen, she may eat Terumah.
 
2. If the widow is a Bas Kohen, she may not eat Terumah once she performs Chupah with him.
 
3. A man can be Mekadesh her with Bi'ah and she can be acquired with Yibum. If she was married off by her father to one man and another man has relations with her, he is liable for punishment. If she is a Nidah she conveys Tum'ah to a man who has relations with her. If she marries a Kohen, she may eat Terumah, and if a Mamzer or any other of the Pesulim has relations with her, she becomes Pasul for Kehunah.

BRIEF INSIGHT

A PETZU'A DAKA AND A MAMZERES
 
The Gemara says that there is a dispute between the Tana'im whether a Petzu'a Daka may marry a Bas Ger. What is the law in the case of a Mamzeres? May a Petzu'a Daka marry a Mamzeres? This is the subject of a dispute between the Rambam and the Ra'avad. The Aruch la'Ner cites proof from the Gemara here for the opinion of the Rambam, that a Petzu'a Daka may not marry a Mamzeres. The Gemara says that the only situation in which the wife of a Kohen Petzu'a Daka may eat Terumah is in the case that he became a Petzu'a Daka after the marriage. If a Petzu'a Daka would be allowed to marry a Mamzeres, that would be another case in which the wife of a Kohen Petzu'a Daka may eat Terumah! This is proof for the opinion of the Rambam that a Mamzeres may not marry a Petzu'a Daka.

QUICK HALACHAH

A BAS GER
 
If a Ger marries a Giyores, the daughter, daughter of a daughter, and so on throughout the generations, may not marry a Kohen l'Chatchilah, even though she was conceived and born in sanctity. However, if she does marry a Kohen, he does not have to divorce her.
 
The Rambam explains that b'Di'eved he does not have to divorce her because she was conceived and born in sanctity. The implication is that if she was not conceived in sanctity, even though she was born in sanctity, if she marries a Kohen he must divorce her. (Beis Shmuel)
