THE THINGS THAT ARE MEKADESH (Yerushalmi Orlah Perek 3 Halachah 4 Daf 19a)

(a)

(Mishnah): If one had bundles of clover of Kil'ai ha'Kerem, they must be burned. If they became mixed with other [permitted bundles], all must be burned. R. Meir says so;

Chachamim say, they are Batel in 201 [bundles].

R. Yochanan and Reish Lakish argued - one said that according to R. Meir, 10 things are Mekadesh, and one said that according to R. Meir, everything [normally counted] is Mekadesh.

R. Yakov bar Acha heard that a Mishnah argues with the one who says that everything [normally counted] is Mekadesh;

(Mishnah - R. Yehudah): Pomegranates of Badan and leeks of Geva were mentioned only that they are tithed Vadai everywhere (Kusim live there, and they do not tithe what they sell. They are not Mekadesh. (In the Reisha, R. Meir says that pomegranates of Badan are Mekadesh.)

Is it not normal to count other pomegranates?! (If R. Meir held that everything normally counted is Mekadesh, he would say so about all pomegranates!)

Defense (of the one who says that everything is Mekadesh): Pomegranates of Badan, because they are dear, it is normal to count them. Other pomegranates, since they are not dear, it is not normal to count them. (We explained this like GRA.)

Note: The Gemara seems to conclude like what it just said was astounding, that not all pomegranates are counted. Perhaps it initially understood 'Kol (all) that is [even sometimes] counted', and concludes 'Es (what) is (always) counted.' We find a retraction like this in Yevamos 81a. R. SHLOMO SIRILIYO alludes to this. R. AKIVA EIGER (Kelim 17:5) says that R. Meir and R. Yehudah argue about whether other pomegranates are sometimes counted.

(Mishnah): These are [the things that are Mekadesh] - nuts of Parech, pomegranates of Badan, sealed barrels (of wine), Chilfos Tardin (an esteemed species of beet - ME'IRI Yevamos 81b), large stalks of cabbage, and Greek gourds;

R. Akiva says, even, loaves of a Ba'al ha'Bayis.

What is proper for Orlah can be of Orlah. What is proper for Kil'ai ha'Kerem can be of Kil'ai ha'Kerem.

(Gemara - R. Yonah) Inference: [Nuts of Parech are Mekadesh,] but almonds of Parech are not. (MAHARA FULDA, GRA).

Our Mishnah discusses a sealed barrel among sealed [barrels], but a sealed barrel among open, and it was opened, or an open [barrel] among sealed, and it became sealed, it [can be Batel, but] in needs another Shi'ur (for Orlah and Kil'ai ha'Kerem, 201).

Question: How can an open [barrel be mixed] among sealed? (It is recognized which is open! Also, it is not Chidush that an open barrel is Batel! - MEICHAL HA'MAYIM)

Answer (R. Ze'ira): The case is, [the Ba'al ha'Bayis who sold it sealed it feebly]. It is considered open regarding a grocer (who seals barrels well, so the wine will last a long time), but sealed regarding a Ba'al ha'Bayis.

Question: It was taught that it was sealed! (If it was properly sealed, it should be Mekadesh!)

Answer: The case is, the Ba'al ha'Bayis took it back [so it returns to be considered sealed. It is all one case - it was sealed, it became considered open when he sold it to the grocer, and it became considered sealed again when he took it back. Even though now it is among other feebly sealed barrels, since before it was considered open among sealed, and it was not Mekadesh, the same applies now - MAHARA FULDA.]

(R. Krispa citing R. Yochanan): All these gourds and cabbages that we eat [raw], they are Yevani gourd.

Question (R. Yonah): (The Mishnah said, what is proper for Orlah...) Why don't we say also 'what is proper for Terumah...'?
