MATTERS DUE TO ISUREI HANA'AH (Yerushalmi Orlah Perek 3 Halachah 3 Daf 18b)

(a)

(Mishnah): If a Tavshil was cooked with peels of Orlah, it must be burned. If it was mixed with others, it is Batel in 201.

If an oven was heated with (the fuel for the fire was) peels of Orlah, and he baked bread in it, the bread must be burned. If it was mixed with others, it is Batel in 201.

(Gemara - Aba bar Yirmeyah citing Kahana bar Yirmeyah citing Shmuel, and R. Ba citing R. Chiya citing R. Yochanan): Coals of Orlah that extinguished, they are permitted.

(d)

Question: Does a Tosefta (Orlah 1:7) not teach this?! If an oven [that was heated with peels of Orlah] is new, it must be destroyed (the first time it is heated, it solidifies). If it is old, it must cool off (before cooking in it, lest one benefit from Orlah. If he baked or cooked through the coals [after they extinguished, the food] is permitted.)

Answer #1 (R. Chinena): [The Seifa] does not [teach that what he cooked through the coals is permitted, therefore we need the teaching of Shmuel and R. Yochanan].

Answer #2 (R. Mana): [The Seifa] does [teach so, i.e.] when he brought moist [Heter] wood, and dried it through [coals of] peels of Orlah. (What he cooked through coals of the Heter is permitted, even though Isur dried the Heter. We explained this like SEDEI YEHOSHUA, GRA.)

If rocks from Bayis ha'Menuga were burned and made into plaster, some teach that they left their Tum'ah, and some teach that they did not leave their Tum'ah;

The one who says that they left their Tum'ah, they are permitted. The one who says that they did not leave their Tum'ah, they are forbidden.

Retraction: Even the one who says that they left their Tum'ah, they are forbidden, for it says "Tzara'as Mam'eres" - put a curse on it, and do not benefit from it.

(R. Avahu citing R. Yochanan): All Nisrafim (Isur Hana'ah that should be burned), their ashes are permitted, except for [ashes] from idolatry.

Answer (R. Yochanan): There is different, for it says "Netitzah" (the Torah did not say to burn it, rather, to wreck it. MESHIV DAVAR 2:104 - the Makshan thought that even so, once the Mitzvah was done, the ashes should be permitted.)
