[דף כט עמוד א] תמן תנינן חלת עם הארץ והמדומע והלקוח בכסף מעשר ושירי מנחות פטורין מן הדמאי.

(a)

Mishnah in Maseches Damai: The following are exempt from the law of Damai (that requires a person who received produce from an Am Ha'aretz - an ignoramus who is not careful with Tumah and Taharah - to separate Maaseros because of a concern that the am ha'aretz did not do so) - 1) If an am ha'aretz gave dough to a chaver (a person who is careful about Tumah and Taharah) kneader and the kneader wishes to separate chalah (the portion of the dough that is given to the Kohen and must be kept Tahor); 2) If produce of Terumah became mixed with regular produce when in the possession of an am ha'aretz; 3) Produce bought with Maaser Sheni money; 4) The remainder of a Minchah sacrifice (i.e. the majority part that was not burnt on the altar, that is eaten by the Kohanim).

תני וכולם שיקרא שם לתרומת מעשר או למעשר שני שלהם [דף לא עמוד ב (עוז והדר)] מה שעשה עשוי

Beraisa: In all of these cases, if he declared part of them to be Terumas Maaser or Maaser Sheni (even though it was exempt from this) the declaration takes effect.

R. Elazar: The Beraisa means except for the case of the Minchah sacrifice.

ר' ירמיה אמר השאר במחלוקת.

R. Yirmiyah: The law of the Beraisa is the subject of a dispute.

רבי יוסה בעי היי דא מחלוקת. מה אנן קיימין אין כר''מ הוא מעשר שני הוא שירי מנחות לא עשה כלום. אין כר' יודה מה שעשה עשוי.

R. Yosa: About what is the dispute? If the tana of the Beraisa is R. Meir, he views Maaser Sheni in the same way as the remainder of the Minchah, that it is considered to be the 'property of Hashem'?! If it is R. Yehudah, even for the Minchah, the declaration to separate Maaseros take effect?!

R. Mana: I went to Kisarin and heard Rav Chizkiyah teaching our Mishnah, that one who betrothed using his portion of Kodshim, whether Kodshei Kodshim or Kodshim Kalim, she is not betrothed...

רבי לעזר אמר דברי הכל. ר' יוחנן אמר במחלוקת ואמרית ליה מנן שמיע לך הדא מילתא

R. Elazar said that all agree to this and R. Yochanan said that it was said only by R. Meir (see above 1) (f)). And I (R. Mana) asked, from where did you learn this about R. Elazar?

אמר לי מרבי ירמיה

R. Chizkiyah: I heard it from R. Yirmiyah.

ואמרית יאות דהוא שמע הדא דרבי לעזר רבי לעזר דברי הכל הוא דאמר במחלוקת

R. Mana: I said that I now understand - (R. Yirmiyah said that there is a dispute over the law of the Beraisa about all of the cases other than the Minchah sacrifice. He heard that R. Elazar's statement that 'if one who betrothed with Kodshim, she is not betrothed' was also agreed to by R. Yehudah. R. Yirmiyah came and

רבי יוסי דלא שמיעא ליה צריכה הוא דו אמר היי דא מחלוקת. אין כרבי מאיר היא מעשר היא שירי מנחות לא עשה כלום. אין כר' יודה מה שעשה עשוי.

R. Yosi did not hear the subject of the dispute, so he asked what the dispute is about- if it is according to R. Meir, both for Maaser and for the Minchah, he has not done anything. If it is according to R. Yehudah, it takes effect.

כך דמך ר' מאיר גזר ר' יודה ואמר אל ייכנסו תלמידיו של רבי מאיר כאן. דחק סומכוס ועאל. אמר המקדש בקדשי קדשים. ואשה נכנסת היא לעזרה.

When R. Meir died, R. Yehudah decreed that none of R. Meir's students were permitted to enter (the study hall), as they are all argumentative. Sumchus pushed his way through and asked about one who betrothed with Kodshei Kodshim - could a woman enter the Azarah?

אמר ליה במקדש על ידי שליח.

(h)

Answer: She accepted it through a shaliach.

כמה קידשה רבי לעזר אמר בגופו רבי יוחנן אמר בטובת הנייה שבו.

How is exactly did he betroth her? R. Elazar with the sacrifice itself. R. Yochanan said with its tovas hana'ah (i.e. the benefit that she can now sell it to someone).

או נאמר ולא פליגין מה דאמר רבי לעזר בגופו בחזקת טובת הנייה שבו.

(j)

Or say that R. Elazar and R.Yochanan do not disagree, as R. Elazar also meant that he betroths her with its benefit.

R. Chizkiyah/ Rav Baybei citing R. Elazar: One can betroth with coins upon which Maaser Sheni was redeemed (as the only problem is betrothing with actual Maaser Sheni produce).
