DAF DISCUSSIONS - BEITZAH 32

Barry Kagan asked:

Hi,

On Lamed Beis, amud Beis, the last mishna on the amud, it says that you cannot place two barrels on a stove and then place a pan on top of them - Rashi says the reason it is asur is becasue it is "mechzi K'ohel" and "dome l'Boneh".

Firstly, why the expressions, "Mechzi" and "dome" and secondly, the gemara that discusses this section ends up with the miskana that the reason the case of the mishna is asur is because of boneh - so why does Rasi say it is mechzi "k'ohel" i.e. Rashi should have said "K'salka Deitach" that mechzi k'ohel.

Hope this make sense. I'd appreciate a response.

Thanks for all your work. Regards,

Barry Kagan, London, England

The Kollel replies:

It is clear in the end of the Sugya that it actually is only Mechzi, for the Gemara's Maskanah is that a Shinuy helps (i.e. first placing the pot and then bringing the Chavis). It is not considered an actual act of Boneh since it is not for being constructed l'Kiyum, to remain standing.

The Gemara you mentioned is merely showing the difference between stones of the Beis ha'Kisei and the case of the pot. It asserts that since no Ohel is made by the Avnei Beis ha'Kisei, there is no need to prohibit it with a Gezeirah.
