It says if the first born puts out his head alive and then dies, the second born is not a bechor regarding inheritance. But if it put out its head and died that day, it would be nonviable. Then it seems as if the secondborn WOULD be a bechor re inheritance! Isn't it the first viable child?

See the first Mishnah of the eigth Perek of Bechoros. Viability is only when the father agonizes over his death. A full term baby who dies pre-empts Bechorah.
