When the resurrection of the dead will occur moshe rebbeinu will be alive...correct?
If according to the gemara on horiyos 11b that says "no one will be higher than the king except hashem."
How does one make sense with this sugyah?

The Or ha'Chayim writes in Parshas Vayechi (Bereshis 49:11, end of DH Osri): "In future times, there will be revealed in the world the root of the Kingdom of Moshe, who himself is Melech ha'Mashi'ach." Now that we know that Moshe Rabeinu himself is the Mashi'ach, we can understand the Gemara in Horayos.

The Or ha'Chayim there writes that the Neshamah of Moshe Rabeinu is included in the twelve Shevatim of Yisrael. The branch of Shivtei David is in Moshe.

I do not think that he can be the same person because it is written that Mashi'ach ben David will pray that Mashi'ach ben Yosef should not be killed.
In fact, the Gemara (Sukah 52a) tells us that Mashi'ach ben David saw that Mashi'ach ben Yosef was killed so it would be difficult to say that this is the same person.

Incidentally, I saw this referenced in terms of why Eliyahu will be the one to resolve the "Teiku" if at the time Moshe will be alive.
The answer is that Eliyahu has been among us coming to Brisim and Sedarim. He understands the needs of the people in applied Halachah and that is why he is the one to judge.

It says in the artscroll sukkah on 52a that the ramchal said the decree of the death of mashiach ben yosef is canceled. The gemara itself says that mashiach ben yosef will be mourned! How could the ramchal argue a gemara??
1) The Rambam (Hilchos Yesodei ha'Torah 10:4) writes that if a prophet predicts that a disaster will befall but then it does not happen, this does not mean that his Nevu'ah has been discredited, because Hash-m is patient and merciful and changes the decree. It may be that the poeple did Teshuvah, as in the case of the people of Ninveh, and they were forgiven.
2) The Ben Ish Chai (Parshas Beshalach #20) writes that in the Shemoneh Esreh, in the Berachah of Boneh Yerushalayim, when we say "and the throne of Your servant, David, You should establish speedily," one should have Kavanah that Mashi'ach ben Yosef should not be killed by the wicked king ("Armilus") who will be the chief adversary of the Mashi'ach.
3) I also saw an explanation based on the very last verses of Tanach, at the end of Sefer Mal'achi (the last Navi). The verse says, "Remember the Torah of Moshe...." The next verse says, "Behold, I will send to you Eliyah ha'Navi...," and the very last verse of Tanach says, "And he will return the heart of the fathers on the sons...."
This is hinting that the first thing we must do is to learn and remember the Torah of Moshe. Then Hash-m will send Eliyahu, who is a Talmid of Moshe Rabeinu, and Eliyahu will restore the heart of the fathers. This means that he will resolve all the doubts that we have in the Torah (Rabeinu Menachem Azariya of Panu in Asarah Ma'amarim, Ma'amar of Chikur ha'Din 5:2, page 315).
4) This is hinted to in the Torah itself, because at the beginning of Sefer Devarim (1:5) it states "Ho'il Moshe" -- Moshe Rabeinu started to explain all the Torah. The Hebrew word "Ho'il" contains the same letters as the word "Eliyahu." This is a hint that just as Moshe Rabeinu expalined the Torah, Eliyahu ha'Navi will explain the Torah (Shach on the Torah, Parshas Devarim, end of page 513).
5) Eliyahu ha'Navi is a Talmid of Moshe Rabeinu. We learn from this the power of a Talmid. Even though the Rebbi is alive, the Talmid still has his special role, to explain the words of his teacher.
