Aharon Braha asked:

Haqatan Aharon Braha HY"V, Milan, Italy

The Kollel replies:

RABBOSAI-

You attempted to respond to the question you were asked, about an apparent contradiction in the gemorah, where it starts of saying one that paskens where his rebbi is deserves death, and then the gemmorah says he loses his position of Gedulah, by saying there is a difference whether there are witnesses etc or not. When there are witnesses he dies.

It seems to me that the punishment of death for deciding the halacha where one;s rebbi is, is NOT a death sentence to be carried out by Bais Din, rather it seems it is a halacha of Misah biday shomayim. Heaven causes the person to die. The proof seems to be from Shmuel Hanovi. The gemorah in Berochos says that Eli Hacohen told Channa that Shmuel Paskened a halacha in Eli's presence and as such he will die. Channa asked that he be forgiven because this was the child she prayed for. Now if this was a question of death via Bais din, then how could Eli forgive him? The Averah was done! Teshuva and forgiveness does not absolve one from the a death sentence Once it has been decided by the Bais din! Additionally, we know that Shmuel Hanovi at that point was a child, just brought there by his mother, he was certainly not 13 (Unless I am mistaken) and therefore he would not have been liable for a death sentence! Also, were it possible to be forgiven, after the deed was done, why then did Nodov and avihu die for paskening before Moshe? Do we think that Moshe did not forgive them? (And that which the gemmorah is Megillah says, how did Chulda say prophecy when Yirmiyahu was around? That is tantamount to Paskening before one's rebbi. The gemmorah answers either Yirmiyahu was away, so it was no problem, OR since Chulda was related to Yirmiyahu, Yirmiyahu did not care. That gemmorah does not means that in retrospect Yirmiyahu forgave Chulda, rather Chulda knew that she was always allowed to prophecize, even when Yirmiyahu was around, because he was happy that she prophecize. But if he did not forgive her in advance she could not have said any prophecy!)

The Kollel replies:
