question if it is permissble to open up a store next to nother store (of the same kind)

if there is a range (e.g) after 2 miles i can build a store what jurisdiction does one ba'al store have over another what are the restriciton

ad is it considered stealing from another man income ? what right does he have to stopanother man from doing that are there any sights you can turn me to to look

The Kollel replies:

In general, the Halachos of "Masig Gevul" and "Yored l'Umnaso Shel Chaveiro" are complicated and require the consultation of a Halachic authority. The Halachos are so complex that the Chazon Ish writes in his Sefer Emunah u'Bitachon that oftentimes people with insufficient knowledge will consider the new shopowner a "Rodef" for opening his store, when actually it is the old shopowner who is a "Rodef" for trying to stop him.

The basic Halachos are found in Choshen Mishpat 156. In general, if the new storeowner is a local resident, then there is no Halachah of "Yored l'Umnaso," but still a Rav should be consulted. Also, the Halachos relate to a single "Mavoy" (alleyway), but in our modern age of transportation things are different. Therefore, it is necessary to discuss the issue in person with a Rav who is well-versed in Choshen Mishpat.
