The Gemara on Daf 3 writes that all though "u'Bi'er" means Mechalya Karna, as we see from the verse of "Ad Tumo," still we learn that Shen is Chayav even by Lo Mechalya Karna, from Regel. However, here the Gemara asks that every case where the animal eats should be Patur, and the only case of Shen is Tinfah Peros. On this, the Gemara asks that we cannot have that Shen should only exist in a case of Lo Mechalya Karna.
