DAF DISCUSSIONS - BAVA KAMA 103

Michael asked:

What about if the person he gave the money is a buyer(for a profession) and not an investor. He only job is to buy, not to have any goods on hand. Such as realtor or a buyer for a store.

Thank you

Michael, Highland Park, NJ

The Kollel replies:

Since you did not elaborate on your question, I'll do my best. Feel free to write back if your actual question remains unanswered.

In the case of Rav Kahana, the Gemara's conclusion is that Rav Kahana gave the money in advance and was planning to receive delivery of the goods. However, since there were no actual goods available when he gave the money, and he did not make a Kinyan the actual flax was not his.

If someone is a buyer for a store, he is merely a Shaliach; any Kinyan that he makes will revert back to the store. If he makes a mistake in what he purchases, in certain cases the employer can say that he is liable for that was not what he was sent for.(This will generally not apply when he is a steady employee.
