DAF DISCUSSIONS - KIDUSHIN 20

Selwyn Wacks asked:

DEAR KOLLEL

RASHI-DIVREI HAMATCHIL "M'DEREBBE YOSI BEREBBI HANINA"

WHAT DOES RASHI MEAN BY "HASHUD" ON SHVI'IS?

SURELY HE IS PUNISHED FOR ACTUALLY TRANSGRESSING AVAK SHMITTA AND NOT JUST FOR BEING SUSPECT?

OR IS RASHI HINTING AT MAARIS AYIN?

I THANK YOU IN ADVANCE FOR YOUR TIME AND TROUBLE

Selwyn Wacks, Johannesburg,South Africa

The Kollel replies:

The word "Chashud" is borrowed from other Sugyos, such as Nedarim 58, Bechoros 30, Avodah Zarah 15b in Rashi, etc. In all these cases, the Chashud is one who generally transgresses and not merely someone who transgressed one time.
