ANY BI'AH OF YIBUM ACQUIRES (Yerushalmi Perek 6 Halachah 1 Daf 34b)

מתני' הבא על יבמתו בין בשוגג בין במזיד בין באונס בין ברצון אפילו הוא שוגג והיא מזידה הוא מזיד והיא שוגגת הוא אנוס והיא לא אנוסה היא אנוסה והוא לא אנוס

(a)

(Mishnah): If a Yavam had Bi'ah with his Yevamah he acquired her, whether he was Shogeg or Mezid (intending), whether forced or willing, even if he was Shogeg and she was Mezidah, or vice-versa, or he was forced and she was not, or vice-versa;

אחד המערה ואחד הגומר קנה ולא חלק בין ביאה לביאה:

Whether he did Ha'ara'ah (only the first stage of Bi'ah) or a full [Bi'ah] he acquired, and we do not distinguish different kinds of Bi'ah.

גמ' אנן תנינן אפילו הוא שוגג והיא מזידה הוא מזיד והיא שוגגת. תני רבי חייה אפילו שניהן שוגגין. אפילו שניהן מזידין.

(c)

(Gemara): Our Mishnah taught 'even if he was Shogeg and she was Mezidah, or he was Mezid and she was Shogeges.' R. Chiya taught, even if both of them were Shogeg, even if both of them were Mezid.

הוון בעיי מימר בפיקח שיש בו דעת שהוא קונה בין לדעת בין שלא לדעת. וחרש שאין בו דעת לא יקנה אלא לדעת.

(d)

Assumption: They wanted to say that a Pike'ach, who has Da'as, acquires with Da'as or without Da'as. A Cheresh (deafmute), who has no Da'as, acquires only with Da'as (i.e. since he cannot have Da'as, he cannot acquire - Ein Ra'uy l'Bilah, Bilah Me'akeves Bo).

אשכח תני רבי חייה אחד החרש ואחד השוטה שבעלו קנו ופטרו את הצרות

Rejection: A Beraisa was found saying that the same applies to a Cheresh or lunatic - if he had Bi'ah [with his Yevamah], he acquired her and exempted the Tzaros. (We explained this like PNEI MOSHE.)

[דברים כה ה] יבמה יבא עליה לדעתו ולקחה לו לאשה שלא לדעתו. ויבמה אפילו על (כרחה) [צ"ל כרחו].

(f)

"Yevamah Yavo Aleha" - with his Da'as. [Had it said only this, we would say that Yibum requires intent. The Torah added] "V'Lakchah Lo l'Ishah" - [even] without his Da'as. "V'Yibmah" - even Bal Korcho (against his will, e.g. he intended for Bi'ah with his wife, and they stuck his Yevamah's Ervah onto his Ever. SHIREI KORBAN - the Gemara will make three more Drashos from these same words. All are equal. There is no reason to favor one over the others, therefore we learn all of them.)

יבמה יבא עליה לדעתה. ולקחה לו לאשה שלא לדעתה. ויבמה אפי' על כרחה.

"Yevamah Yavo Aleha" - with her Da'as. "V'Lakchah Lo l'Ishah" - [even] without her Da'as. "V'Yibmah" - even Bal Korchah (against her will).

יבמה יבא עליה כדרכה. ולקחה לו לאשה שלא כדרכה. ויבמה אפי' מן הצד.

"Yevamah Yavo Aleha" - normal [Bi'ah]. "V'Lakchah Lo l'Ishah" - [even] Lo k'Darkah (in the anus). "V'Yibmah" - even from the side (Hatiyah; the Ever is angled and does not break the Besulim - OHR SOMAYACH, Hilchos Isurei Bi'ah 17:13, SEFER NIR).

יבמה יבא עליה ביאה גמורה. ולקחה לו לאשה ביאה [דף לה עמוד א] שאינה גמורה. ויבמה אפילו בהערייה

"Yevamah Yavo Aleha" - full Bi'ah. "V'Lakchah Lo l'Ishah" - [even] not full Bi'ah. "V'Yibmah" - even Ha'ara'ah.

Answer #1 (Rav Yehudah citing Rav and Shmuel): It is until the finger (a euphemism for the Ever) is seen between the two sides of the Ervah (the Bavli calls this Neshikah, i.e. the genitals touch).

רבי יוחנן אמר עד שתיכנס העטרה.
